Having regard to the facts and circumstances of<br \/>\nthe case, this application is taken up for hearing today.\n<\/p>\n<p>2.\tThis<br \/>\nis an application preferred by the applicant under Section 389 of the<br \/>\nCode of Criminal Procedure seeking bail against the judgment and<br \/>\norder of conviction and sentence passed by the learned Special Judge<br \/>\n(ACB), Kheda at Nadiad in Special A.C.B. Case No.14 of 2005 dated<br \/>\n28.9.2010 by which the learned Judge has convicted the applicant for<br \/>\nthe offence punishable under Sections 7  of the Prevention of<br \/>\nCorruption Act to undergo 4 years R.I. with total fine of Rs.20,000\/-<br \/>\nand in default of the same, to further undergo R.I. for one year and<br \/>\nalso sentenced the applicant to undergo four years R.I. and fine of<br \/>\nRs.20,000\/-, in default, to undergo one year R.I. for the offence<br \/>\nunder Sections 13(1) (d) of the Act.\n<\/p>\n<p>3.\tLearned<br \/>\nadvocate Mr.Pancholi for the applicant submitted that the applicant<br \/>\nhas already paid the fine imposed by the learned Judge. Considering<br \/>\nthe fact that the appeal is arising from the short sentence imposed<br \/>\nby the learned Judge and considering the pendency of large number of<br \/>\nmatters, I am of the view that the applicant deserves to be enlarged<br \/>\non bail on his furnishing a bond of Rs.10,000\/- (Rupees ten thousand<br \/>\nonly) with one surety of the like amount to the satisfaction of the<br \/>\nTrial Court and subject to the conditions that :-\n<\/p>\n<p>(i)\tThe<br \/>\napplicant shall not leave the territorial limits of the State of<br \/>\nGujarat without prior permission of this Court.\n<\/p>\n<p>(ii)\tThe<br \/>\napplicant shall not involve himself in such or similar offence<br \/>\nhereafter.\n<\/p>\n<p>(iii)\tThe<br \/>\napplicant shall surrender his passport, if any, before the Trial<br \/>\nCourt concerned.\n<\/p>\n<p>4.\tIn<br \/>\nthe meanwhile, the the substantive sentence imposed by the learned<br \/>\nSpecial Judge (ACB), Kheda at Nadiad in Special A.C.B.
