Shelat appearing on behalf of appellant<br \/>\n?  GSRTC, learned advocate Mr. Mehul Sharad Shah appearing on behalf<br \/>\nof respondent No.9, learned advocate Mr. Maulik J. Shelat appearing<br \/>\non behalf of respondent No.11 and learned advocate Mr. Harshad K.<br \/>\nPatel appearing on behalf of respondents ?  claimants.\n<\/p>\n<p>\tAll<br \/>\nthese three appeals, this Court has admitted on 15th April<br \/>\n2008 and in the applicant ?  appellant has not pressed the stay<br \/>\napplication on 15th April 2008.\n<\/p>\n<p>\tIn<br \/>\ngroup of these appeals, Corporation has challenged the interim award<br \/>\npassed by Motor Accident Claims Tribunal, Sabarkantha at Himatnagar<br \/>\ndated 13th September 2002. The Claims Tribunal has awarded<br \/>\ninterim compensation in favour of respondent claimant under Section<br \/>\n140 of MV Act. These are the interim award, where, Rs.50,000\/- has<br \/>\nbeen awarded by Claims Tribunal which is required to be paid by<br \/>\nappellant &#8211; Corporation and two Insurance Companies, therefore, it<br \/>\nshould be divided between three in their respective share.\n<\/p>\n<p>\tLearned<br \/>\nadvocate Mr. Mitul Shelat raised contention that it is really a fraud<br \/>\ncommitted by claimants claiming the said amount from the Corporation.<br \/>\nApart from that, now, question is that main application is pending<br \/>\nbefore the Claims Tribunal which shall have to be decided by the<br \/>\nClaims Tribunal in accordance with law giving reasonable opportunity<br \/>\nof hearing to the concerned parties. Therefore, so long, an<br \/>\napplication under Section 166 of the MV Act is not decided, these<br \/>\nappeals shall have to remain pending before this Court. Instead of<br \/>\nthat, if, these appeals are disposed of by this Court today without<br \/>\nexpressing any opinion on merits and with a direction to Corporation<br \/>\nto deposit the entire awarded amount together with cost and interest<br \/>\naccording to respective share before the Claims Tribunal and out of<br \/>\nthat amount, only interest is available to the respondents claimants<br \/>\nwhich will meet the end of justice between the parties.\n<\/p>\n<p>\tIn<br \/>\nview of above observations made by this Court, the present all the<br \/>\nthree appeals are disposed of without expressing any opinion on<br \/>\nmerits with a direction to appellant ?  Corporation to deposit the<br \/>\namount together with cost and interest of respective share as per<br \/>\ninterim award passed by Claims Tribunal within a period of six weeks<br \/>\nfrom the date of receiving the copy of the said order.\n<\/p>\n<p>\tAfter<br \/>\nrealising the amount from the Corporation, it is directed to Claims<br \/>\nTribunal concerned to invest the entire amount in any Nationalised<br \/>\nBank for a period of three years with a periodical renewal in the<br \/>\nname of respondent claimant. Though FDR is in the name of respondent<br \/>\nclaimant but to be remained with the Nazir of the Claims Tribunal.<br \/>\nThe respondent claimant Pandor Nayanaben Wd\/o. Govindbhai Nanjibhai<br \/>\nis entitled the interest upon the said FDR till the application under<br \/>\nSection 166 of the MV Act is decided by the Claims Tribunal<br \/>\nconcerned.\n<\/p>\n<p>\tIt<br \/>\nis further directed to Claims Tribunal concerned to decide all the<br \/>\ngroup of claim petitions filed by the respective claimants arising<br \/>\nout of same accident as early as possible within a period of six<br \/>\nmonths from the date of receiving the copy of the said order.\n<\/p>\n<p>\tThe<br \/>\nrespondents claimants shall not withdraw the main application filed<br \/>\nunder Section 166 of the MV Act and shall not abandon the main<br \/>\nproceedings and Claims Tribunal shall have to decide main application<br \/>\nindependently without influence by interim award passed by Claims<br \/>\nTribunal in accordance with law.\n<\/p>\n<p>\tAccordingly,<br \/>\nthese appears are disposed of without expressing any opinion on<br \/>\nmerits.\n<\/p>\n<p>\tRecords<br \/>\nand Proceedings be sent back to the Claims Tribunal concerned, if<br \/>\nany, immediately.\n<\/p>\n<p>\tRegistry<br \/>\nis directed to transmit Rs.25,000\/- which has been deposited by the<br \/>\nappellant before the registry of this Court, if any, immediately to<br \/>\nthe concerned Claims Tribunal.\n<\/p>\n<p>[H.K.\n<\/p>\n<p>RATHOD, J.]<\/p>\n<p>#Dave<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Gsrtc vs Pandore on 12 September, 2008 Author: H.K.Rathod,&amp;Nbsp;
