KIRPAL\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>[ With I.A.Nos.4 &amp; 5\/97 in C.A.No. 8637\/97 arising out of<br \/>\nSLP (C) No. 11238\/97 ]<br \/>\n\t\t      J U D G M E N T<br \/>\nVerma, CJI<br \/>\n     Leave granted  limited to the question indicated in our<br \/>\norder dated 7.7.9<br \/>\n     The grievance of the appellants is that our order dated<br \/>\n7.5.97 in  Sanjay Jain\tVs. Anil  Sabharwal &amp; Ors. [ (SLP(C)<br \/>\n&#8230;\/97 ( CC.4325\/97 ] has been misconstrued to mean that the<br \/>\nlegality of  allotment of plots made under the discretionary<br \/>\nquota even prior to 31.10.89 has been directed by that order<br \/>\nto be  reopened and  examined. It  is submitted\t that such a<br \/>\nmisinterpretation results  from a misconstruction of certain<br \/>\nwords in that order, namely:\n<\/p>\n<blockquote><p>     &#8220;We are constrained to observe that<br \/>\n     the    accountability     of    the<br \/>\n     authorities who are responsible for<br \/>\n     making these  arbitrary  allotments<br \/>\n     which have\t been rightly  cancelled<br \/>\n     by\t the  High  Court  needs  to  be<br \/>\n     examined after  their  identity  is<br \/>\n     fixed in an appropriate proceeding.<br \/>\n     In addition,  it is  also expedient<br \/>\n     that any  remaining  allotments  of<br \/>\n     the kind  which have been cancelled<br \/>\n     by the  High Court\t should also  be<br \/>\n     treated also be treated alike. This<br \/>\n     exercise has  not bee  performed by<br \/>\n     the High  Court in the preset case.<br \/>\n     It is, therefore, expedient that as<br \/>\n     a follow  up action, the High Court<br \/>\n     should  proceed   to  complete  the<br \/>\n     exercise.&#8221;<\/p><\/blockquote>\n<p>     It is  sufficient for  us to  clarify that by the above<br \/>\norder dated  7.5.97 this  Court upheld\tcancellation of\t the<br \/>\nallotments  out\t  of  the  discretionary  quota\t made  after<br \/>\n31.10.89  and\tit  was\t further  said\tthat  any  remaining<br \/>\nallotments of  the same\t kind should  be  treated  alike  to<br \/>\ncomplete the  exercise. In  other  words,  our\torder  dated<br \/>\n7.5.97 contained  the direction\t to treat all allotments out<br \/>\nof the\tdiscretionary quota  made after 31.10.89 without any<br \/>\nexception, in  order to\t examine the  accountability of\t the<br \/>\nconcerned authorities  as also\tto avoid  any discrimination<br \/>\nbetween allotters  subsequent to  31.10.89. That  order was,<br \/>\ntherefore, concerned  entirely with the allotment made after<br \/>\n31.10.89   and did  not refer to any allotment prior to that<br \/>\ndate. We  consider it  necessary to  say  so  to  avoid\t any<br \/>\npossible  misinterpretation  by\t this  Court&#8217;s\torder  dated<br \/>\n7.5.97.\n<\/p>\n<p>     We\t may,  however,\t add  that  the\t only  question\t for<br \/>\nexamination  by\t  this\tCourt\tin  Sanjay   Jain  vs.\tAnil<br \/>\nSabharwal&#8217;s case being all the allotments made subsequent to<br \/>\n31.10.89,  our\t order\tis  also  not  to  be  construed  as<br \/>\ninhibiting any\tseparate\/independent action  in\t respect  of<br \/>\nallotments for\tany other  period including  period prior to<br \/>\n31.10.89.
