RESPONDENTS.\n                                  -----------\n<\/pre>\n<p>05\/   28.04.2011            Heard counsel for the petitioner and the<\/p>\n<p>                    counsel appearing for the State.\n<\/p>\n<p>                            Petitioner&#8217;s prayer in this writ application is<\/p>\n<p>                    for directing the respondents to consider his case for<\/p>\n<p>                    promotion to the post of Assistant Jailor with all<\/p>\n<p>                    consequential benefits with effect from the date his<\/p>\n<p>                    juniors have been given promotion.\n<\/p>\n<p>                            The specific case of the petitioner is that his<\/p>\n<p>                    case for promotion was not considered on account of<\/p>\n<p>                    pendency of the criminal case. So far criminal case is<\/p>\n<p>                    concerned, that has ended in acquittal of the<\/p>\n<p>                    petitioner, but the respondents are not considering his<\/p>\n<p>                    case for promotion despite his acquittal in the<\/p>\n<p>                    criminal case. The reason which was shown in the<\/p>\n<p>                    counter affidavit for non-consideration of the<\/p>\n<p>                    petitioner&#8217;s case for promotion was considered by this<br \/>\n<span class=\"hidden_text\">                  2<\/span><\/p>\n<p>Court and by order dated 15.3.2011 it was held that<\/p>\n<p>the reason, which has been shown in the counter<\/p>\n<p>affidavit for non-consideration of promotion to the<\/p>\n<p>petitioner, in fact, has got no relevance. The petitioner<\/p>\n<p>is entitled for promotion on account of his acquittal.<\/p>\n<p>         The Director General of Prison was asked to<\/p>\n<p>appear in person and also asked as to when he will<\/p>\n<p>convene a meeting of the D.P.C. for giving promotion<\/p>\n<p>to the petitioner. From the statement in the counter<\/p>\n<p>affidavit as well as the resolution of the Departmental<\/p>\n<p>Promotion    Committee      annexed    as   Annexure-F<\/p>\n<p>indicates that in the light of order dated 15.3.2011 a<\/p>\n<p>meeting of D.P.C. was held on 4.4.2011. Petitioner&#8217;s<\/p>\n<p>case for promotion was considered and he has been<\/p>\n<p>recommended for promotion to the post of Assistant<\/p>\n<p>Jailor with effect from the date juniors to the<\/p>\n<p>petitioner   were    allowed   i.e.   24.12.1998.   The<\/p>\n<p>petitioner has already superannuated, as such the<\/p>\n<p>promotion will be given to him with retrospective<\/p>\n<p>effect with all consequential benefits. The Finance<\/p>\n<p>Department will have to take decision as per the<\/p>\n<p>recommendation of the D.P.C. and a notification in<br \/>\n<span class=\"hidden_text\">                         3<\/span><\/p>\n<p>       this regard is to be issued, whereby the petitioner will<\/p>\n<p>       be promoted to the post of Assistant Jailor with effect<\/p>\n<p>       from 24.12.1998 with all consequential benefits. On<\/p>\n<p>       account of such promotion the respondents will have<\/p>\n<p>       to re-fix petitioner&#8217;s pension and he will also be<\/p>\n<p>       entitled for arrears of pension on account of its<\/p>\n<p>       revision.
