Sinha, CJ  <\/p>\n<p> 1. This writ petition was taken up<br \/>\nas a Public Interest Litigation on the basis<br \/>\nof a letter dated 16-9-2000 written by a<br \/>\npractising advocate in Vijayawada<br \/>\nCity addressed to the Honourable<br \/>\nChief Justice of this Court regarding<br \/>\nthe noise pollution created in the City<br \/>\nof Vijayawada by reason of the use of<br \/>\nAir Horns at their pitch by A.P. State<br \/>\nRoad Transport Corporation buses,<br \/>\nlorries etc. <\/p>\n<p> 2. The fact that there exists<br \/>\nnoise pollution in the City of Vijayawada is<br \/>\nnot in dispute. An affidavit, affirmed by<br \/>\nSri. B. Sreenivas, Sub-Inspector of Police<br \/>\non behalf<\/p>\n<p>of respondents 1, 4 and 10 was filed<br \/>\ncontending that organised special camps were<br \/>\nheld to curb noise pollution with the<br \/>\nassistance of A.P. Pollution Control Board<br \/>\nand in the month of January, 2001, 1241<br \/>\ncases have been booked. All kinds of<br \/>\nGas Horns\/pneumatic horns and multi-tone<br \/>\nhorns fitted to motor vehicles were banned<br \/>\nby the Commissioner of Police on 8-1-<br \/>\n2001. It was further stated directions<br \/>\nhave also been issued to remove the gas<br \/>\nhorns fitted to all school buses and 3427<br \/>\nnoise pollution cases have been booked<br \/>\nwithin a period of six months against<br \/>\nthe drivers of vehicles who violated the<br \/>\ntraffic rules.\n<\/p>\n<p> 3. However, the A.P. Pollution<br \/>\nControl Board in their status report dated<br \/>\n26-2-2001 admits of heavy noise<br \/>\npollution in Vijayawada city caused on<br \/>\naccount of using of air horns by APSRTC<br \/>\nBuses, private tourist buses, lorries. It was<br \/>\npointed out that at junction points,<br \/>\nturning of roads, the drivers blow horns<br \/>\nat highest pitch as a result whereof, the<br \/>\ntraffic rules are violated, which result in<br \/>\ncausing accidents and noise problems. It<br \/>\nwas stated that noise values observed in<br \/>\nVijayawada city at all the three places viz.,<br \/>\nIndustrial, Commercial and residential<br \/>\nareas have exceeded the normal values of<br \/>\nnoise levels fixed by the Central Pollution<br \/>\nControl Board. The values of noise levels<br \/>\nrecorded at the above three places from<br \/>\n29-1-2001 to 10th February, 2001 are<br \/>\nstated to be as under:\n<\/p>\n<p>  Place<\/p>\n<p>  Noise<\/p>\n<p>  Noise Levels <\/p>\n<p>  \u00a0<\/p>\n<p>  \u00a0<\/p>\n<p>  Lmax<\/p>\n<p>  Lmin<\/p>\n<p>  LAvg<\/p>\n<p>  Autonagar (Industrial area)<\/p>\n<p>  11 to 11.30 a.m.<\/p>\n<p>  98 to 104<\/p>\n<p>  61 to 67<\/p>\n<p>  86 to 89<\/p>\n<p>  Benz Circle Road<br \/>\n  Junction point (Commercial area)<\/p>\n<p>  10 to 10.30 a.m.<\/p>\n<p>  102 to 112<\/p>\n<p>  75 to 80<\/p>\n<p>  84 to 97<\/p>\n<p>  Surya Rao pet (Residential Area)<\/p>\n<p>  9 to 9.30 a.m.<\/p>\n<p>  71 to 78<\/p>\n<p>  50.8 to 52.0<\/p>\n<p>  61.1 to 64.0<\/p>\n<p> 4. A detailed report has also<br \/>\nbeen annexed to the status report filed<br \/>\nby the Pollution Control Board.\n<\/p>\n<p> 5. It is not in dispute that the<br \/>\nCentral Government in exercise of its<br \/>\npowers conferred by clause (ii) of sub-<br \/>\nsection (2) of Section 3, sub-section (1)<br \/>\nand clause (b) of sub-section (2) of<br \/>\nSection 6 and Section 25 of the<br \/>\nEnvironment (Protection) Act, 1986 (29<br \/>\nof 1986) read with Rule 5 of the<br \/>\nEnvironment (Protection) Rules, 1986<br \/>\nmade rules for regulation and control of<br \/>\nnoise producing and generating sources<br \/>\nknown as the noise Pollution (Regulation<br \/>\nand Control) Rules, 2000 (for short &#8216;the<br \/>\nsaid Rules&#8217;). Rule 3 provides for<br \/>\nambient air quality standards in respect<br \/>\nof noise for different areas\/zones which<br \/>\nreads thus:\n<\/p>\n<p> (1) The ambient<br \/>\nair quality standards in respect<br \/>\nof noise for different areas\/zones<br \/>\nshall be such as specified in the<br \/>\nSchedule annexed to these<br \/>\nrules.\n<\/p>\n<p> (2) The State Government may<br \/>\ncategorise the areas into industrial,<br \/>\ncommercial, residential or silence<br \/>\nareas\/zones for the purpose of<br \/>\nimplementation of noise standards<br \/>\nfor different areas.\n<\/p>\n<p> (3) The State Government shall<br \/>\ntake measures for abatement of<br \/>\nnoise including noise emanating<br \/>\nfrom vehicular movements and<br \/>\nensure that the existing noise levels<br \/>\ndo not exceed the ambient air<br \/>\nquality standards specified under<br \/>\nthese rules.\n<\/p>\n<p> (4) All Development authorities,<br \/>\nlocal bodies and other concerned<br \/>\nauthorities while planning<br \/>\ndevelopmental activity or carrying<br \/>\nout functions relating to town and<br \/>\ncountry planning shall take into<br \/>\nconsideration all aspects of noise<br \/>\npollution as a parameter of quality<br \/>\nof life to avoid noise menace and to<br \/>\nachieve the objective of<\/p>\n<p>maintaining the ambient air quality<br \/>\nstandards in respect of noise.\n<\/p>\n<p> (5) An area comprising not less<br \/>\nthan 100 metres around hospitals,<br \/>\neducational institutions and<br \/>\nCourts may be declared as silence<br \/>\narea\/zone for the purpose of these<br \/>\nrules.\n<\/p>\n<p> 6. Rule 4 provides for the<br \/>\nresponsibility as to enforcement of<br \/>\nnoise pollution control measures which<br \/>\nis in the following terms:\n<\/p>\n<p> (1) The noise levels is<br \/>\nany area\/zone shall not exceed the<br \/>\nambient air quality standards in<br \/>\nrespect of noise as specified in the<br \/>\nSchedule.\n<\/p>\n<p> (2) The authority shall be<br \/>\nresponsible for the enforcement of<br \/>\nnoise pollution control measures<br \/>\nand the due compliance of the<br \/>\nambient air quality standards in<br \/>\nrespect of noise.\n<\/p>\n<p> 7. Rule 6 lays down as regards<br \/>\nthe consequences of violation in silence<br \/>\nzone\/ area which reads as follows:\n<\/p>\n<p> Whoever, in any place covered<br \/>\nunder the silence zone\/area commits<br \/>\nany of the following offence, he shall<br \/>\nbe liable for penalty under the provisions<br \/>\nof the Act:\n<\/p>\n<p> (i) whoever, plays<br \/>\nany music or uses any sound<br \/>\namplifiers;\n<\/p>\n<p> (ii) whoever, beats a drum or<br \/>\ntom-tom blows a horn either<br \/>\nmusical or pressure or trumpet or<br \/>\nbeats or sounds any instrument; or <\/p>\n<p> (iii) whoever, exhibits any<br \/>\nmimetic, musical or other<br \/>\nperformances of a<br \/>\nnature to attract<br \/>\ncrowds.\n<\/p>\n<p> 8. Rule 7 provides for filing of<br \/>\ncomplaints to the authority. Rule 8<br \/>\nempowers the authority to prohibit<br \/>\ncontinuance of music sound or noise. Day<br \/>\ntime shall mean from 6.00 a.m. to<br \/>\n10.00 p.m. <\/p>\n<p> 2.   Night time shall mean from<br \/>\n10.00 p.m. to 6.00 a.m. <\/p>\n<p> 3. Silence zone is defined as an<br \/>\narea comprising not less than 100<br \/>\nmetres around hospitals,<br \/>\neducational institutions and<br \/>\nCourts. The silence zones are<br \/>\nzones which are declared as such<br \/>\nby the competent authority.\n<\/p>\n<p> 4.   Mixed categories of areas<br \/>\nmay be declared as one of the<br \/>\nfour above mentioned categories<br \/>\nby the competent<br \/>\nauthority.\n<\/p>\n<p> dB(A) Leq, denotes the time<br \/>\nweighted average of the level of sound<br \/>\nin decibel on scale A which is<br \/>\nrelatable to human hearing.\n<\/p>\n<p> A &#8220;decibel&#8221; is a unit in which<br \/>\nnoise is measured.\n<\/p>\n<p> &#8220;A&#8221;, in dB(A) Leq, denotes the<br \/>\nfrequency weighting in the<br \/>\nmeasurement of noise and<br \/>\ncorresponds to frequency response<br \/>\ncharacteristics of the human ear.\n<\/p>\n<p> Leq: It is an energy mean of the<br \/>\nnoise level over a specified period.\n<\/p>\n<p> 9. The Governor of Andhra<br \/>\nPradesh in exercise of the powers<br \/>\nconferred by Sections 28, 38, 95, 96,<br \/>\n107, 111, 138 and 176 of the Motor<br \/>\nVehicles Act, 1988 (Central Act 59 of<br \/>\n1988) made Rules known as Andhra<br \/>\nPradesh Motor Vehicles Rules, 1989. Rule<br \/>\n427 of the said Rules which deals with<br \/>\nsound signals and restrictions on the<br \/>\nwhereof reads thus:\n<\/p>\n<p>  Sound signals &#8211;\n<\/p>\n<p>Restrictions on use of:&#8211;No driver of a<br \/>\nmotor vehicle shall sound the horn or<br \/>\nother device for giving audible<br \/>\nwarning, with which the motor<br \/>\nvehicle is equipped, or shall cause<br \/>\nor allow any other person to do so, to<br \/>\nan extent beyond that which is<br \/>\nreasonable necessary to ensure<br \/>\nsafety.\n<\/p>\n<p> 10. Rule 428 of A.P. Motor<br \/>\nVehicles Rules, 1989 empowers the<br \/>\nauthority to issue notification to prohibit<br \/>\nsound signals in the following terms:\n<\/p>\n<p> The Commissioner of<br \/>\nPolice in the Cities of Hyderabad and<br \/>\nSecunderabad and elsewhere the<br \/>\nCollector may, by notification in the<br \/>\nOfficial Gazette and by the erection<br \/>\nin suitable places of appropriate<br \/>\ntraffic signs prescribed under the<br \/>\nAct, prohibit the use of any horn,<br \/>\ngong or other device on a motor<br \/>\nvehicle for giving suitable warning<br \/>\nwithin such locality and during such<br \/>\nhours as may be specified in the<br \/>\nnotification :\n<\/p>\n<p> Provided that when the<br \/>\nCommissioner of Police or the<br \/>\nCollector as the case may be, prohibits<br \/>\nthe use of any horn, gong or other<br \/>\ndevice for giving audible warning during<br \/>\ncertain specified hours, he shall cause<br \/>\na suitable notice in English and in the<br \/>\nscript of the city or district, setting<br \/>\nforth the hours within which such use<br \/>\nis so prohibited to be affixed below<br \/>\nthe traffic sign.\n<\/p>\n<p> 11. Rule 119 of the V Central<br \/>\nMotor Vehicles Rules, 1989 reads<br \/>\nthus:\n<\/p>\n<p> Horns: (A) Every<br \/>\nmotor vehicle shall befitted with an<br \/>\nelectric horn or other device<br \/>\n(conforming to the specifications of the<br \/>\nBureau of Indian Standards) for use<br \/>\nby the driver of the vehicle and<br \/>\ncapable of giving audience and sufficient<br \/>\nwanting of the approach or position of<br \/>\nthe vehicle.\n<\/p>\n<p> (B) No motor vehicle shall<br \/>\nbefitted with any multi-toned horn<br \/>\ngiving a succession of different notes<br \/>\nor with any other sound producing<br \/>\ndevice giving an unduly harsh, shrill,<br \/>\nloud or alarming noise.\n<\/p>\n<p> (C) Nothing contained in sub-<br \/>\nrule (2) shall prevent the use in<br \/>\nvehicles used as ambulance or for fire<br \/>\nfighting of salvage purposes or a<br \/>\nvehicle used by police officers or<br \/>\nofficers of Motor Vehicles<br \/>\nDepartment in the course of their duties,<br \/>\nof such sound signals as may be approved<br \/>\nby the registering authority in whose<br \/>\njurisdiction such vehicles are<br \/>\nkept.\n<\/p>\n<p> 12. There exists difference<br \/>\nbetween sound as part of nature and sound<br \/>\ngenerated by electrical and electronic<br \/>\ndevices being the contribution of<br \/>\nmodern science. Although from the<br \/>\ninception of the civilisaiton sound is<br \/>\npart of the nature, but unwanted noise<br \/>\ncreated from the sources like<br \/>\nloudspeakers, air horns fitted to motor<br \/>\nvehicles, playing of music records etc.,<br \/>\nis not desirable.\n<\/p>\n<p> 13. The effect of noise pollution<br \/>\nis a matter of great concern to the<br \/>\nmankind. Noise not only causes annoyance<br \/>\nto mankind outside his home but also<br \/>\ninvades his home. Noise pollution has been<br \/>\nbrought within the purview of Air<br \/>\n(Prevention and Control of Pollution)<br \/>\nAct, 1981 as amended by Act No.47 of<br \/>\n1987 which came into force with effect<br \/>\nfrom 1-4-1988. It is now established that<br \/>\nnoise is a form of environmental<br \/>\ndegradation and it has serious implication<br \/>\non health which can change man&#8217;s<\/p>\n<p>psychological state by speeding up pulse<br \/>\nand respiratory rates. It also impair hearing<br \/>\neither permanently or temporarily. Millions<br \/>\nof industrial workers are threatened with<br \/>\nhearing damage. Medical evidence shows<br \/>\nthat it can cause heart attacks in individual<br \/>\nwith existing cardiac injury and that<br \/>\ncontinued exposure to loud noise is likely<br \/>\nto cause chronic effects such as hyper-<br \/>\ntension or ulcer. Noise also causes both<br \/>\ninjury and nuisance and alarming noise<br \/>\ncauses disturbance and distraction to the<br \/>\nstudents who are not able to concentrate<br \/>\nfully due to irritation caused by such devices.<br \/>\nIt is also causing adverse effect on infants,<br \/>\nsick and elderly persons.\n<\/p>\n<p> 14. W.S. Gilbert in &#8216;The Grand<br \/>\nDuke&#8217; stated:\n<\/p>\n<p> When you have<br \/>\ngot a beehive in your head, <\/p>\n<p> And a sewing machine in each<br \/>\near, <\/p>\n<p> And you feel like you have eaten<br \/>\nyour bed, <\/p>\n<p> And you have got a bad headache<br \/>\ndown here.\n<\/p>\n<p> 15. Noise is also created by<br \/>\ntraffic and it also causes disturbed sleep.<br \/>\nThe citizens have right to sleep peacefully<br \/>\nand also a right to a decent environment<br \/>\nas highlighted by the Supreme Court in<br \/>\nvarious decisions which are all well<br \/>\nknown in the field of pollution. In view of<br \/>\nthe enormous increase in number of motor<br \/>\nvehicles of all types every year, the<br \/>\nmenace of noise pollution is posing<br \/>\nproblems, to the mankind. The effect of bad<br \/>\nright sleep as highlighted by an eminent<br \/>\nscientist in the field Fiona Goolee in his<br \/>\narticle in British medical journal, in<br \/>\nwhich it was stated that noise can have<br \/>\npositive effects on health. The effect of<br \/>\nbad night sleep includes mood change,<br \/>\nreduce cardiovascular performance and<br \/>\npoor performance at intellectual and<br \/>\nmechanical tasks and it was further<\/p>\n<p>observed in a recent review of research<br \/>\ninto noise and sleep recommends that<br \/>\nsound at night in sleeping quarters should<br \/>\nnot exceed 45 DB (A). It was held that<br \/>\nnoise also adversely affects behaviour,<br \/>\nincreasing anxiety and reducing the<br \/>\nincidence of helpful behaviour. Levels of<br \/>\naggression are increased by loud noise,<br \/>\nan effect which may persist outside the<br \/>\nnoisy environment. Steel workers have<br \/>\nmore domestic disputes if they work in<br \/>\nnoisy areas. Noise is unacceptable not<br \/>\nonly to human beings but also to animals.<br \/>\nThere cannot be any doubt that<br \/>\ntremendous sound beyond permissible<br \/>\nlimits is anti-thesis of civilised order. The<br \/>\neffect of noise even on the domesticated<br \/>\nanimals like pet dogs in a common<br \/>\nman&#8217;s knowledge.\n<\/p>\n<p> 16. So far as noise pollution<br \/>\ncaused by the use of air horns is<br \/>\nconcerned, as indicated hereinbefore,<br \/>\nthe same is fully covered by the A.P.<br \/>\nMotor Vehicles Rules, 1989 and the<br \/>\nCentral Motor Vehicles Rules.\n<\/p>\n<p> 17. In Rabin Mukerjee v. State of<br \/>\nWest Bengal, , a<br \/>\nlearned Judge of the Calcutta High<br \/>\nCourt while considering Rule 114(d) of<br \/>\nBengal Motor Vehicles Rules, 1940<br \/>\nwhich is in pari materia with Rule 119<br \/>\nof Central Motor Vehicles Rules, it was<br \/>\nheld that apart from the fact that use of<br \/>\nelectric or air horn is not permissible in<br \/>\npublic vehicle, the air and electric horn<br \/>\nproduces or causes unduly rash, shrills,<br \/>\nloud and alarming noise. It was also<br \/>\nfound that research conducted jointly<br \/>\nby Basu Bignan Mandir and Presidency<br \/>\nCollege, Calcutta showed that the<br \/>\natmosphere and the environment in the<br \/>\ncity of Calcutta and its suburbans was<br \/>\nvery much polluted from discriminating<br \/>\nnoise emitted from different quarters. It<br \/>\nwas held:\n<\/p>\n<p>  It is also desirable in<br \/>\nthe larger public interest that the<br \/>\nrespondents and the State<br \/>\nGovernment and the authorities<\/p>\n<p>should take suitable measures to<br \/>\nimplement the provision of Rule<br \/>\n114(d) of the Motor Vehicles Rules,<br \/>\n1940 and no certificate of fitness<br \/>\nshould be granted under Section 38<br \/>\nof the said Act, in case of non-<br \/>\ncompliance of the provisions of Rule<br \/>\n114(d) of the said Rules so that this<br \/>\ntype of noise pollution is eradicated at<br \/>\nany early date from the State of West<br \/>\nBengal.\n<\/p>\n<p> 18. Yet again in Nayan Bchari<br \/>\nDass v. State of Orissa (Original<br \/>\nJurisdiction Case No. 3481 of 1992),<br \/>\na Division Bench of the Orissa High<br \/>\nCourt dealing with Section 119 of the<br \/>\nCentral Motor Vehicles Rules held:<br \/>\n   It cannot be denied that<br \/>\nconstant use of such devices<br \/>\nproducing unduly harsh, shrill, loud or<br \/>\nalarming noise is bound to cause<br \/>\ndisturbance and distraction to the<br \/>\nstudents who are notable to concentrate<br \/>\nfully due to irritation caused by such<br \/>\ndevices. It is also causing adverse effect<br \/>\non infants, sick and elderly persons.<br \/>\nAudio generally causing inconvenience<br \/>\nas persons like the petitioner are not able<br \/>\nto concentrate on their work because of<br \/>\nconstant sound pollution. Thus it is an<br \/>\naddition to the already exiting should<br \/>\npollution and appropriate steps are<br \/>\nrequired to be taken for controlling the<br \/>\nsame. But, as the use of such type of<br \/>\nhorns is not permitted by the rules the<br \/>\nquestion of issuing any direction<br \/>\nprohibiting such use does not arise.<br \/>\nHowever, we consider it to be a fit case<br \/>\nin which some directions are to be issued.<br \/>\nAccordingly, we fell that it would be<br \/>\nappropriate, if at regular intervals<br \/>\nannouncement is made through the<br \/>\nmedium of All India Radio and<br \/>\nDoordarshan and the Press that the use<br \/>\nof multi-toned horns or such other devices<br \/>\ncreating unduly harsh, shrill, loud or<br \/>\nalarming noise is prohibited. It will be<br \/>\nadvisable if notices are exhibited at the<\/p>\n<p>bus stops and at the RTO Offices<br \/>\nregarding the prohibition on the use<br \/>\nof multi-toned horns and similar<br \/>\ndevices. The authorities may also<br \/>\nconsider printing of a warning of<br \/>\naffixing of a rubber stamp on all<br \/>\napplication forms required for fitness<br \/>\ncertificates, permits and in the<br \/>\nregistration books, that the use of multi-<br \/>\ntoned horns and other similar devices<br \/>\ncreating unduly harsh, shrill, loud or<br \/>\nalarming sounds is prohibited under the<br \/>\nCentral Motor Vehicles Rules, 1989.<br \/>\nBut all this would not be sufficient<br \/>\nunless follow up is taken by the<br \/>\nappropriate authorities against those<br \/>\ncommitting the breach.\n<\/p>\n<p> 19. The averments made in the<br \/>\ncounter-\n<\/p>\n<p>affidavit filed by the respondents and the<br \/>\nstatus report filed by the A.P. Pollution<br \/>\nControl Board clearly depict that there<br \/>\nexits<br \/>\nsound pollution in the City of Vijayawada<br \/>\ncaused due to noise generated from motor<br \/>\nvehicles and air horns etc., fitted to them. It<br \/>\nalso stands admitted that despite taken action<br \/>\nin this regard, the ambient Air Quality<br \/>\nStandards in respect of noise fixed by the<br \/>\nCentral Pollution Control Board in terms of<br \/>\nthe Noise Pollution (Regulation and Control)<br \/>\nRules, 2000 as also the directives issued<br \/>\nby<br \/>\nthe Commissioner of Police had not produced<br \/>\nthe desired results.\n<\/p>\n<p> 20. The Commissioner of<br \/>\nPolice, Vijayawada city, therefore,<br \/>\nmust take appropriate action not only for<br \/>\nthe purpose of enforcement of the said<br \/>\nrules but also for implementation of the<br \/>\nguidelines issued by the A.P. Pollution<br \/>\nControl Board and furthermore shall take<br \/>\nappropriate action in accordance with<br \/>\nRules 427 and 428 of A.P. Motor Vehicles<br \/>\nRules, 1989, to prohibit the use of air<br \/>\nhorns and see that the directives issued in<br \/>\nthis regard from time to time are complied<br \/>\nwith scrupulously. Announcements should<br \/>\nbe made at regular intervals through the<br \/>\nelectronic media, press as regards the<br \/>\nprohibition of the use of multi-toned<br \/>\nhorns<\/p>\n<p>or such other devices creating unduly harsh,<br \/>\nshrill, loud or alarming noise. The authority<br \/>\nshould also issue appropriate directions<br \/>\nregarding printing of a warning or affixing<br \/>\nof a rubber stamp on all application forms<br \/>\nrequired for fitness certificates, permits and<br \/>\nin the registration books to the effect that<br \/>\nthe use of such horns and other similar<br \/>\ndevices creating unduly harsh, shrill, loud<br \/>\nor alarming sounds is prohibited under the<br \/>\nrules.\n<\/p>\n<p> 21. Let a copy of this order be<br \/>\ncommunicated to the Chief Secretary,<br \/>\nGovernment of Andhra Pradesh, Secretary,<br \/>\nTransport Department, Commissioner<br \/>\nof Transport, Director-General and<br \/>\nInspector General of Police, for taking<br \/>\nappropriate follow up action in the light<br \/>\nof the above order.\n<\/p>\n<p> 22. For the reasons afore-<br \/>\nmentioned, the writ petition is disposed<br \/>\nof with the above directions.
