The Oriental Insurance Company <\/p>\n
aggrieved by the award dated   C’ <\/p>\n
WCA\/B2\/FC\/CR– 132\/2002 passed  <\/p>\n
Workmen’s Compensation, _:S_nb–Division–Il,,v  .  v’Banga1cre’= -‘<\/p>\n
preferred this appeal.\n<\/p>\n
2. The brief facts of the  ifollows:\n<\/p>\n
The resp’ondents7-ggi’  legal representatives of
\ndeceased T:Thil_ai{   a claim petition before the<\/p>\n
Commissioner  for._’;.W’orVk1nen’s Compensation seeking<\/p>\n
\u00a7cVorn.p’engsaticn on accoiint of death of T .Thilak Kumar during<\/p>\n
 ‘ve”rnp’loyment. The claimants have contended<\/p>\n
}\u00b0””‘that the.1_Vdecca_s:e:dV.’l’.Thilak Kumar was working as a driver of<\/p>\n
 Qttalis bearing Registration No.KA–01\/MB–6633<\/p>\n
  to the 41″ respondent. He was getting a salary of<\/p>\n
,\u00e9~<\/p>\n
34,500\/~p.m. On 22-52002, while proceeding towards the
\nTemple in the said Vehicle near Kokkacla, on Bangalore\u00bb<\/p>\n
Buntwala Highway at about 9.00.a.m., a KSRTC <\/p>\n
Registration No.KA–O1\/F-710′? came in a rash  <\/p>\n
manner and dashed against the Toyotog Qualis:   <\/p>\n
accident, the driver of the said vehicle  ‘i'”;T_i’h’ilal.<"'VIV:{-ur'fiar<\/p>\n
died on the spot. The claimantshpavell'contend.e'dV.i._tvha_t -the isf'<\/p>\n
the sole bread earner of their fam_i1$fA'a_i1d.._gat  tiineliof death,<\/p>\n
he was aged about 24 years'-andlsotig;ht"fo_r'jcornpensation.<\/p>\n
Workmen's:';_Cempe\ufb01sation;'the 'owner of the vehicle i.e. 4"?
\nrespondent hereinvvlilcdathaobiections contending that he is
\nthe own.e}r o_f~ the oyoto Qualis, the deceased T.Thi1ak<\/p>\n
Kurnar'was.,woIkir;vg as a driver of the said vehicle and he was<\/p>\n
 vpayingglihhirnuvapalaiiz of ?.3,ooo\/~ and 3.150\/~ per day as<\/p>\n
batta.  also stated that the accident has taken place<\/p>\n
 Ithpe "course of employment. Since the Vehicle is<\/p>\n
 "_'j-vic_o'\u00a79'ere.;cl by the insurance, the Insurer has to compensate the<\/p>\n
A\u00ab<\/p>\n
claimants and sought for dismissal of the claim petition as<\/p>\n
against the owner of the vehicle.\n<\/p>\n
4. The Insurer \ufb01led objections denying_.~th.rs:_u <\/p>\n
made in the claim petition. However}: th:f:~2yh <\/p>\n
vehicle Toyoto Qualis bearing.7;\u00a7s1egistra,tionV <\/p>\n
6633 is covered by the insurance.:”E,t_ is for.”the:vc1ain1ants to
\nprove that they are the depeiudants’ of “‘tV1T:1:%;:”‘deceased and the
\ndeceased died due torthe  tor dismissal of<\/p>\n
the claim petitions. <4  * it<\/p>\n
5. On   of the parties, the
\nCommissiontery * for  Compensation framed<\/p>\n
necessary. issues? ..\n<\/p>\n
6.V’gV ‘Th\u00bbe_c1ai1nants.__in order to prove their case, the second<\/p>\n
herself as P.W.1 and got marked Ex.P.1 to<\/p>\n

7. The second claimant in her evidence has deposed that<\/p>\n
the deceased was Working as a driver under 4?” respondent
\nand he was paying salary to the deceased. She also stated<\/p>\n
that the deceased was the sole bread earner of the<\/p>\n
On 22-52002, While the deceased was proceed_i\u00a7rig”~to\u00a7.zs}a::ds\u00ab _<\/p>\n
Temple from Bangalore, near Kokkadah ‘Highway,-:to_ Lhe”= <\/p>\n
rash and negligent driving of the KSRTC   the<\/p>\n
said vehicle met with an accident”–.and–t’he driver\u00a7o’f..the3 saidt’<\/p>\n
Qualis died on the spot. S__he has___produced .Fi’l?..v._repbrt of the<\/p>\n
Motor Vehicle Inspector,  also Driving<\/p>\n
License of lthe-_decease_cd;i  produced the SSLC marks<\/p>\n
card of the d’eceased_   his date of birth. She was<\/p>\n
cross~exa:mirxed by ‘thev_Insurer. Nothing contrary was elicited<\/p>\n
in. _the lcr.oss– exarnination.\n<\/p>\n
 V8.    of the pleadings of the parties, the<\/p>\n
 (3;)mmissioner”xfor Workmen’s Compensation taking into<\/p>\n
consideration Ex.P.1–FIR and the report of Motor Vehicle<\/p>\n

Inspector and Spot mahazar, came to the conclusion that the<\/p>\n
deceased died due to the accident that occurred.._4l’l*on<\/p>\n
22–5-2002. At the time of accident, the <\/p>\n
working as a driver and he died ..during   uh’<\/p>\n
employment. On the basis of the  <\/p>\n
the Commissioner, the Commissioner held thatglt’he”:c1’ainiantsVt’<\/p>\n
are the dependants of the decealsed”p_:arid.._.also’based on the
\nSSLC marks Card, it was   was aged
\nabout 24 years  2 Taking into
\nconsideration   the-.g’deceased and applying
\nthe relevantllly ‘Commissioner has awarded
\ncompensativonxorf  12% interest from the date<\/p>\n
of claim petition.”  hon;-gh”the’ claimants have claimed that the<\/p>\n
 was” salary of 3.4.500\/–p.m., the<\/p>\n
“hasi_..~taken the salary of 34,000\/~p.m. and<\/p>\n
wdtaltingd t’3=O\u00b0\/o\ufb02of  salary and also applying the relevant factor<\/p>\n
~   awarded compensation.\n<\/p>\n

9. T he appellant being aggrieved by the award passed by
\nthe Commissioner for Workmen’s Compensation, filed\ufb01thips<\/p>\n
appeal.\n<\/p>\n
10. Sri.M.U.Poonacha, learned <\/p>\n
appellant contended that the  pas:-geld.’ ‘oy  ‘\u00a3.lV’1EV.”‘.’<\/p>\n
Commissioner is contrary to   arici-.  The
\nCompensation awarded by’   eiccessive and
\nthe rate of interest awarded.\u00abvi:\u00a7’a}so law laid by
\nthe I-lon’ble   was not a
\nworkman   On the other hand,
\non the datieiof.  deceased was on pilgrimage<\/p>\n
along with his\ufb01f_ialmpil3xr’  Hence, the deceased Cannot<\/p>\n
claim as’i3, workxnariviinder the 4″” respondent and there is no<\/p>\n
relatior1’s.hip_’of ‘r.nas_ter and servant between them. Hence, he<\/p>\n

\nII. On the other hand, D.Ramesh, learned counsel<\/p>\n
appearing for Respondents I to 3 contended that the
\ndeceased was working as a driver of the said Toyoto Qualis<\/p>\n
which belongs to 41″ respondent. While he was proceeding<\/p>\n
towards the Temple near Kokkada, on  <\/p>\n
road, the said Qualis met with an accident *dlece_-asedull<\/p>\n
died in the said accident. It is his cofirs\ufb01iioh  <\/p>\n
deceased was travelling with hi-svgllfaznily .mernber;:,””i’1e”‘ was”<\/p>\n
working as a driver of the .–said  Qu.alis,t’whicli belongs<\/p>\n
to 431 respondent. Hence, the’dee.eaSed–tiwas”‘a workman and<\/p>\n
there is    thehlaward passed by the<\/p>\n
Commissionerand  fofdjismissal of the appeal\n<\/p>\n
12. We have “car<\u00a5;f_ull.y\u00bb– 'gone through the arguments<\/p>\n
addressed!  the 'counsel for the parties and the oral<\/p>\n
and docunientary"eVidence of the parties.<\/p>\n
  13. H ‘ttlhrsl’notlin..di:spute that T.Thilak Kumar was working as<\/p>\n
 a ‘driver oft,’ Toyoto Qualis bearing Registration No.<\/p>\n
\/SM<\/p>\n
KA–01\/MB-6633 belonging to the 4″] respondent. He died in<\/p>\n
the accident that occurred on 22-5-2002 at Kokkadav<\/p>\n
the accident. The Police have also registered a 4′ .<\/p>\n
the driver of the KSRTC bus in Crime-N.o.’105’\/200;3llfor’_-the ”<\/p>\n
offences punishable under Sections   115.1.<\/p>\n
14. The main argument of the lalpnellantllis.   on the
\ndate of the accident, the with his
\nfamily members to the  claim himself
\nas a workman. _   entitled for the<\/p>\n

15. On  other  have contended that<\/p>\n
the deceased was _an.emi:’;l0Vy’ee under the 4th respondent and<\/p>\n
 “Varas”lv*2.&:or;kingg..as driver of the said Toyoto Qualis and the<\/p>\n
ovxmer a salary of \u20ac3,000\/-p.m. and 150\/-<\/p>\n
  It is also contended that on 22-5-2002<\/p>\n
 he  proceeding towards the temple along with his<\/p>\n
 *\u00bb–rnernbers, the said vehicle met with an accident.<\/p>\n

16. The contention of the appellant is that ._ the<\/p>\n
Compensation awarded by the Commissioner is excess’ive~\u00ab.an.d<\/p>\n
the interest awarded at the rate of 12% is contrary ~<\/p>\n
judgment of the Hon’ble Supreme Ce-‘urt._._ It’_:t0._ the<\/p>\n
mention here that the Commissioner letakingg ”<\/p>\n
consideration the salary drawn bg\ufb01the deceased, age” of C the ‘ C<\/p>\n
deceased and applying  .r.elevpa’rit*A _:”faC-tor has awarded
\ncompensation, which in   Workmen’s
