Having\u00a0heard\u00a0counsel\u00a0for\u00a0both\u00a0the\u00a0sides\u00a0and\u00a0looking\u00a0to\u00a0the\u00a0evidences\u00a0<br \/>\n      on \u00a0 record, \u00a0 it \u00a0 appears \u00a0 that \u00a0 there \u00a0 is \u00a0 prima \u00a0 facie \u00a0 case \u00a0 against \u00a0 the \u00a0 present\u00a0<br \/>\n      appellant.\u00a0There\u00a0are\u00a0enough\u00a0evidences\u00a0against\u00a0the\u00a0present\u00a0appellant.\u00a0As\u00a0the\u00a0<br \/>\n      criminal \u00a0 appeal \u00a0 is \u00a0 already \u00a0 pending, \u00a0 we \u00a0 are \u00a0 not \u00a0 much \u00a0 analyzing \u00a0 the\u00a0<br \/>\n      evidences\u00a0on\u00a0records,\u00a0but,\u00a0suffice\u00a0it\u00a0to\u00a0say\u00a0that\u00a0the\u00a0previously\u00a0I.A.\u00a0No.\u00a02178\u00a0<br \/>\n      of\u00a02009\u00a0was\u00a0preferred\u00a0for\u00a0suspension\u00a0of\u00a0sentence,\u00a0which\u00a0was\u00a0dismissed\u00a0on\u00a0<br \/>\n      merits\u00a0by\u00a0a\u00a0detailed\u00a0speaking\u00a0order\u00a0dated\u00a016 th\u00a0November,\u00a02009.\u00a0Paragraph\u00a0<br \/>\n      nos.\u00a03,\u00a04\u00a0and\u00a05\u00a0whereof\u00a0read\u00a0as\u00a0under:\u00ad<br \/>\n                      &#8220;3.      Perused\u00a0the\u00a0record\u00a0and\u00a0proceedings\u00a0of\u00a0the\u00a0trial\u00a0court.\u00a0Having \u00a0<br \/>\n              heard \u00a0 learned \u00a0 counsel \u00a0 for \u00a0 both \u00a0 the \u00a0 sides \u00a0 and \u00a0 looking \u00a0 to \u00a0 the \u00a0 evidences \u00a0 on \u00a0<br \/>\n              record, \u00a0 there \u00a0 is, \u00a0 prima \u00a0 facie, \u00a0 case \u00a0 against \u00a0 the \u00a0 appellant \u00a0 accused. \u00a0 As \u00a0 the \u00a0<br \/>\n              criminal \u00a0 appeal \u00a0 is \u00a0 pending, \u00a0 we \u00a0 are \u00a0 not \u00a0 much \u00a0 analyzing \u00a0 the \u00a0 evidence \u00a0 on \u00a0<br \/>\n              record. \u00a0 Suffice \u00a0 it \u00a0 to\u00a0 say \u00a0 that\u00a0 one \u00a0 businessman \u00a0 namely,\u00a0 Kamal\u00a0 Kedia, \u00a0 was \u00a0<br \/>\n              abducted\u00a0and\u00a0sizeable\u00a0amount\u00a0of\u00a0ransom\u00a0money\u00a0was\u00a0demanded\u00a0by\u00a0hatching \u00a0<br \/>\n              conspiracy\u00a0by\u00a0the\u00a0accused\u00a0persons\u00a0which\u00a0were\u00a0tried\u00a0in\u00a0Sessions\u00a0Trial\u00a0No.\u00a0123 \u00a0<br \/>\n              of\u00a02005\u00a0as\u00a0well\u00a0as\u00a0there\u00a0are\u00a0two\u00a0more\u00a0accused\u00a0who\u00a0are\u00a0still\u00a0absconding\u00a0as\u00a0on \u00a0<br \/>\n              today.\u00a0\n<\/p>\n<p>                     &#8220;4.      Looking\u00a0to\u00a0the\u00a0evidences\u00a0on\u00a0record\u00a0that\u00a0one\u00a0witness\u00a0i.e.\u00a0P.W.12, \u00a0<br \/>\n              who \u00a0 has \u00a0 gone \u00a0 with \u00a0 money \u00a0 as \u00a0 ransom \u00a0 money \u00a0 has \u00a0 identified \u00a0 this \u00a0 present \u00a0<br \/>\n              appellant\u00adaccused. \u00a0 Looking \u00a0 to \u00a0 the \u00a0 evidences \u00a0 on \u00a0 record, \u00a0 there \u00a0 is \u00a0 enough \u00a0<br \/>\n              material\u00a0against\u00a0the\u00a0present\u00a0applicant\u00adaccused.\u00a0Even,\u00a0the\u00a0ransom\u00a0amount\u00a0has \u00a0<br \/>\n              been\u00a0recovered\u00a0which\u00a0is\u00a0totally\u00a0at\u00a0Rs.\u00a04,20,000\/\u00ad\u00a0(out\u00a0of\u00a0this,\u00a0sizable\u00a0amount \u00a0<br \/>\n              was\u00a0recovered\u00a0from\u00a0present\u00a0accused\u00a0viz.\u00a0Ganesh\u00a0Singh),\u00a0when\u00a0the\u00a0appellant\u00ad<br \/>\n<span class=\"hidden_text\">                                                    2.<\/span><br \/>\n          accused\u00a0was\u00a0in\u00a0the\u00a0house\u00a0of\u00a0another\u00a0co\u00adaccused\u00a0namely\u00a0Tulsi\u00a0Yadav,\u00a0the\u00a0house \u00a0<br \/>\n          was\u00a0 raided \u00a0and\u00a0there \u00a0was\u00a0 firing\u00a0 by\u00a0accused \u00a0side,\u00a0 upon\u00a0 the\u00a0 police \u00a0also.\u00a0As \u00a0<br \/>\n          separate\u00a0case\u00a0has\u00a0been\u00a0registered\u00a0for\u00a0recovery\u00a0of\u00a0ransom\u00a0money\u00a0and\u00a0firing \u00a0<br \/>\n          upon\u00a0the\u00a0police.\u00a0Money\u00a0has\u00a0also\u00a0been\u00a0identified\u00a0by\u00a0P.W.12.\u00a0Likewise,\u00a0looking \u00a0<br \/>\n          to\u00a0the\u00a0deposition\u00a0of\u00a0P.W.1,\u00a0who\u00a0is\u00a0informant\u00a0and\u00a0other\u00a0prosecution\u00adwitnesses, \u00a0<br \/>\n          there \u00a0 is \u00a0a,\u00a0 prima \u00a0facie, \u00a0case \u00a0against\u00a0 the \u00a0appellant\u00adaccused.\u00a0Looking \u00a0 to\u00a0the \u00a0<br \/>\n          gravity\u00a0of\u00a0offence,\u00a0the\u00a0quantum\u00a0of\u00a0punishment\u00a0and\u00a0the\u00a0manner\u00a0in\u00a0which\u00a0the \u00a0<br \/>\n          whole \u00a0 incident \u00a0 has \u00a0 taken \u00a0 place \u00a0 and \u00a0 looking \u00a0 to \u00a0 the \u00a0 role \u00a0 played \u00a0 by \u00a0 the \u00a0<br \/>\n          appellant\u00adaccused\u00a0and\u00a0also\u00a0looking\u00a0to\u00a0the\u00a0charge\u00a0of\u00a0conspiracy\u00a0under\u00a0Section \u00a0<br \/>\n          120\u00adB\u00a0of\u00a0the\u00a0Indian\u00a0Penal\u00a0Code,\u00a0we\u00a0are\u00a0not\u00a0inclined\u00a0to\u00a0suspend\u00a0the\u00a0sentence \u00a0<br \/>\n          awarded\u00a0by\u00a0the\u00a0trial\u00a0court,\u00a0to\u00a0the\u00a0appellant\u00adaccused.\u00a0\n<\/p>\n<p>                   5.       Learned\u00a0counsel\u00a0for\u00a0the\u00a0appellant\u00a0has\u00a0argued\u00a0out\u00a0much\u00a0in\u00a0detail \u00a0<br \/>\n         and\u00a0insisted\u00a0for\u00a0further\u00a0detail\u00a0to\u00a0be\u00a0mentioned\u00a0in\u00a0the\u00a0order,\u00a0but,\u00a0we\u00a0are\u00a0not \u00a0<br \/>\n         inclined\u00a0to\u00a0accept\u00a0his\u00a0request.\u00a0Suffice\u00a0it\u00a0to\u00a0say\u00a0that\u00a0ransom\u00a0has\u00a0been\u00a0recovered, \u00a0<br \/>\n         there\u00a0was\u00a0firing\u00a0upon\u00a0the\u00a0Police\u00a0from\u00a0the\u00a0accused.\u00a0In\u00a0the\u00a0Test\u00a0Identification \u00a0<br \/>\n         Parade,\u00a0money\u00a0has\u00a0been\u00a0identified,\u00a0present\u00a0appellant\u00adaccused\u00a0has\u00a0also\u00a0been \u00a0<br \/>\n         identified \u00a0in \u00a0Court\u00a0by\u00a0P.W.4.\u00a0Two\u00a0accused \u00a0are\u00a0still\u00a0absconding\u00a0and\u00a0there\u00a0is \u00a0<br \/>\n         enough\u00a0other\u00a0evidences\u00a0by\u00a0prosecution\u00adwitnesses.&#8221;\n<\/p>\n<p>3.       Thereafter,\u00a0one\u00a0more\u00a0interlocutory\u00a0application\u00a0was\u00a0preferred\u00a0by\u00a0the\u00a0<br \/>\nvery\u00a0same \u00a0appellant\u00a0bearing \u00a0I.A.\u00a0No.\u00a0773\u00a0of\u00a02010\u00a0for\u00a0the \u00a0suspension \u00a0of\u00a0<br \/>\nsentence. \u00a0 This \u00a0 application \u00a0 was \u00a0 also \u00a0 dismissed \u00a0 on \u00a0 merits \u00a0 by \u00a0 a \u00a0 detailed\u00a0<br \/>\nspeaking\u00a0order\u00a0dated\u00a023rd\u00a0August,\u00a02010\u00a0and\u00a0paragraph\u00a0no.\u00a04\u00a0whereof\u00a0reads\u00a0<br \/>\nas\u00a0under:\u00ad<br \/>\n                &#8220;4.      Looking \u00a0 to \u00a0 the \u00a0 evidence \u00a0 of \u00a0 prosecution \u00a0 witnesses, \u00a0 specially \u00a0<br \/>\n         P.W.12\u00a0to\u00a0be\u00a0read\u00a0with\u00a0deposition\u00a0given\u00a0by\u00a0P.W.1\u00a0and\u00a0P.W.10,\u00a0there\u00a0is\u00a0enough \u00a0<br \/>\n         evidence\u00a0against\u00a0the\u00a0applicant\u00adaccused.\u00a0Sizable\u00a0amount\u00a0of\u00a0ransom\u00a0money\u00a0was \u00a0<br \/>\n         recovered,\u00a0totaling\u00a0Rs.\u00a04,20,000\/\u00ad\u00a0(out\u00a0of\u00a0this,\u00a0sizeable\u00a0amount\u00a0was\u00a0recovered \u00a0<br \/>\n         from\u00a0present\u00a0accused\u00a0viz.\u00a0Ganesh\u00a0Singh).\u00a0This\u00a0applicant\u00a0is\u00a0also\u00a0identified\u00a0by \u00a0<br \/>\n         P.W.1\u00a0in\u00a0test\u00a0identification\u00a0parade.&#8221;\n<\/p>\n<p>4.       In \u00a0 view \u00a0 of \u00a0 the \u00a0 aforesaid \u00a0 evidences \u00a0 on \u00a0 record \u00a0and \u00a0 looking \u00a0 to \u00a0 the\u00a0<br \/>\ngravity \u00a0 of \u00a0 the \u00a0 offence, \u00a0 the \u00a0 quantum \u00a0 of \u00a0 punishment \u00a0 and \u00a0 the \u00a0 manner \u00a0 in\u00a0<br \/>\nwhich\u00a0the\u00a0present\u00a0appellant\u00a0is\u00a0involved\u00a0in\u00a0the\u00a0offence,\u00a0as\u00a0alleged\u00a0by\u00a0the\u00a0<br \/>\nprosecution,\u00a0we\u00a0are\u00a0not\u00a0inclined\u00a0to\u00a0suspend\u00a0the\u00a0sentence,\u00a0awarded\u00a0to\u00a0the\u00a0<br \/>\npresent\u00a0appellant,\u00a0by\u00a0the\u00a0trial\u00a0court.\u00a0\u00a0\n<\/p>\n<p>5.
