AMIN YADAV @ ABHINAV YADAV, SON OF RAJARAM YADAV\n                                              Versus\n                                   THE STATE OF BIHAR\n                                            -----------\n<\/pre>\n<p>02   14.02.2011                  Heard learned counsel for the petitioners as well<\/p>\n<p>                      as learned Public Prosecutor for the State.<\/p>\n<p>                                    Petitioners seek their bail in connection with<\/p>\n<p>                      Akorhigola P.S. Case No. 32 of 2010 registered under Section<\/p>\n<p>                      395 of the Indian Penal Code.\n<\/p>\n<p>                                    Petitioners   are   not    named      in     the   First<\/p>\n<p>                      Information Report and it appears from perusal of the<\/p>\n<p>                      impugned order that in course of investigation, the name of<\/p>\n<p>                      petitioners came in this case in the statements of witnesses<\/p>\n<p>                      Dhanjee Pasi and Baudh Pasi vide paragraphs no. 69 and 70<\/p>\n<p>                      respectively and subsequently, one co-accused Ashok Yadav<\/p>\n<p>                      also named the petitioners in his confessional statement.<\/p>\n<p>                                    Learned counsel for the petitioners points out<\/p>\n<p>                      that the aforesaid witnesses, namely, Dhanjee Pasi and Baudh<\/p>\n<p>                      Pasi are none else but sons of informant and so far as co-<\/p>\n<p>                      accused Ashok Yadav is concerned, he has already been<\/p>\n<p>                      granted privilege of bail by another Bench of this Court vide<\/p>\n<p>                      order dated 08.11.2010 passed in Cr. Misc. No. 37249 of 2010.<\/p>\n<p>                                    Considering       the     aforesaid        facts    and<\/p>\n<p>                      circumstances as well as submissions of the parties, above<\/p>\n<p>                      named petitioners are directed to be released on bail on<\/p>\n<p>                      furnishing bail bonds of Rs. 10,000\/- (Ten Thousand) with two<br \/>\n           sureties of the like amount each to the satisfaction of Chief<\/p>\n<p>          Judicial Magistrate, Rohtas at Sasaram in connection with<\/p>\n<p>          above Stated Akorhigola P.S.
