Justice V.GIRI\n\n Dated :31\/07\/2009\n\n O R D E R\n                              V.GIRI,J.\n                        -------------------------\n                  W.P ( C) No.21666 of 2009\n                       --------------------------\n                Dated this the 31st July,2009\n\n                         J U D G M E N T\n<\/pre>\n<p>      Aggrieved by Ext.P1 order passed by the original<\/p>\n<p>authority under Section 7A of the Employees Provident<\/p>\n<p>Funds and Miscellaneous Provisions Act, petitioner has<\/p>\n<p>preferred Ext.P3 appeal before the Appellate Tribunal.<\/p>\n<p>Ext.P4 will show that the appeal was posted for hearing<\/p>\n<p>before the Tribunal at Delhi on 19.5.2009.          Petitioner<\/p>\n<p>sought for a posting in Kochi. It is up to the petitioner to<\/p>\n<p>move the Tribunal for admission and interim order.<\/p>\n<p>      2.   Heard Learned counsel for the petitioner<\/p>\n<p>Sri.B.Suresh Kumar and learned standing counsel for the<\/p>\n<p>EPF commissioner Sri. Pirappancode V.S Sudhir.<\/p>\n<p>      3. In the meanwhile, proceedings have been taken,<\/p>\n<p>allegedly for freezing the bank account of the petitioner.<\/p>\n<p>Enforcement of Ext.P1 shall be kept in abeyance          for a<\/p>\n<p>period of three months from today on condition that the<\/p>\n<p>petitioner remits 1\/3rd of the amount assessed under Ext.P1,<\/p>\n<p>within four weeks from today.
