No.42899 of 2010\n            ROHITASHAW KUMAR SINGH son of Late Sitaram Singh\n                                  Versus\n                            STATE OF BIHAR\n                                 -----------\n<\/pre>\n<p>3\/   14.03.2011               Heard learned counsel for the petitioner and the State.<\/p>\n<p>                              The petitioner seeks bail in a case instituted for the<\/p>\n<p>                  offence under section 409 of the Indian Penal Code.<\/p>\n<p>                              It has been submitted that the petitioner is in custody<\/p>\n<p>                  since 17.08.2010 and the entire case is based on documentary<\/p>\n<p>                  evidence as also that now charge sheet has been submitted in the<\/p>\n<p>                  matter.\n<\/p>\n<p>                              In view of such, let the petitioner, above named, be<\/p>\n<p>                  released on bail on furnishing bail bond of Rs.5,000\/- (five<\/p>\n<p>                  thousand) with two sureties of the like amount each or any other<\/p>\n<p>                  surety to be fixed by the court below to the satisfaction of the Chief<\/p>\n<p>                  Judicial Magistrate, Vaishali at Hajipur, in connection with Goraul<\/p>\n<p>                  P.S. Case No.49 of 2008, subject to the conditions (i) That one of<\/p>\n<p>                  the bailors will be a close relative of the petitioner, who will give an<\/p>\n<p>                  affidavit giving genealogy as to how he is related with the petitioner.<\/p>\n<p>                  The bailors will undertake to furnish information to the court about<\/p>\n<p>                  any change in the address of the petitioner, (ii) That the bailors shall<\/p>\n<p>                  also state on affidavit that they will inform the court concerned if the<\/p>\n<p>                  petitioner is implicated in any other case of similar nature after his<\/p>\n<p>                  release in the present case and thereafter the court below will be at<\/p>\n<p>                  liberty to initiate the proceeding for cancellation of bail on the<\/p>\n<p>                  ground of misuse, (iii) That the petitioner will give an undertaking<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>       that he will receive the police papers on the given date and be<\/p>\n<p>       present on date fixed for charge and if he fails to do so on two given<\/p>\n<p>       dates and delays the trial in any manner, his bail will be liable to be<\/p>\n<p>       cancelled for reasons of misuse, and (iv) That the petitioner will be<\/p>\n<p>       well represented on each date and if he fails to do so on two<\/p>\n<p>       consecutive dates, his bail will be liable to be cancelled.<\/p>\n<pre>JA\/-                                           (Anjana Prakash,J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Rohitashaw Kumar Singh vs State Of Bihar on 14 March, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.
