PUBLIC PROSECUTOR for\nRespondent(s) : 1, \nNone for Respondent(s) : 2 -\n5. \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE A.L.DAVE\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE BANKIM.N.MEHTA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 18\/04\/2011  \n \nORAL ORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE A.L.DAVE)<\/p>\n<p>\tThe<br \/>\npetitioner has approached this Court with this petition under Article<br \/>\n226  of the Constitution of India seeking a writ of habeas corpus<br \/>\nagainst respondent Nos.3 and 4 alleging that respondent No.2- corpus<br \/>\nis unauthorizedly detained\/confined by respondent Nos.3 and 4.\n<\/p>\n<p>2.\tIn<br \/>\nthis context, it may be recorded that the petitioner had preferred<br \/>\nproceedings under Section 97 of Cr.PC where the corpus has given a<br \/>\nstatement before Judicial Magistrate, Visnagar on 29.1.2011 to the<br \/>\neffect that she has not been confined by her father. She denies the<br \/>\nfactum of marriage. She has gone to the extent of saying that she<br \/>\ndoes not know Chiragkumar Rajendrakumar, the petitioner herein. She<br \/>\nhas stated that she is staying with her parents peacefully and she<br \/>\nhas no difficulty over there. She wanted to go and stay with her<br \/>\nparents.\n<\/p>\n<p>2.1\tThis<br \/>\norder was challenged by the petitioner by preferring a revision<br \/>\napplication under Section 397 of Cr.PC before the Sessions Court at<br \/>\nMehsana. The said revision application came to be dismissed by<br \/>\njudgment and order dated 21.2.2011. That order was challenged before<br \/>\nthis Court by preferring Special Criminal Application No.492 of 2011,<br \/>\nwhich came to be withdrawn by the petitioner with  liberty to file a<br \/>\nhabeas corpus petition. While permitting the withdrawal it was<br \/>\nobserved that withdrawal will not come in the way of the petitioner<br \/>\nwhile deciding habeas corpus petition that may be filed by the<br \/>\npetitioner before competent Court. This order was passed on 6.4.2011<br \/>\n(Annexure-K).\n<\/p>\n<p>3.\tNow,<br \/>\ntoday the petitioner has approached with this petition on the ground<br \/>\nthat when the order was passed by the learned Magistrate after<br \/>\nrecording statement of the corpus, the petitioner was not present<br \/>\nand, therefore, principles of natural justice have been violated. The<br \/>\nright to challenge this was exercised by the petitioner by preferring<br \/>\nrevision application before a Sessions Court and then in Special<br \/>\nCriminal Application before this Court. He failed before the Sessions<br \/>\nCourt and withdrew the petition before the learned Single Judge. This<br \/>\nCourt, while examining a petition for writ of habeas corpus, would<br \/>\nnot examine the question that is raised by the petitioner,<br \/>\nparticularly when he has given up the dispute before the learned<br \/>\nSingle Judge in Special Criminal Application.\n<\/p>\n<p>4.\tApart<br \/>\nfrom the above aspect, this Court has no material to accept the<br \/>\nallegation made that the corpus is unlawfully detained\/confined by<br \/>\nher parents. Bald allegations falsified by statement of the corpus<br \/>\nbefore a competent judicial authority would be of no consequence and<br \/>\ncannot be accepted to be acted upon.\n<\/p>\n<p>5.\tThe<br \/>\npetition, therefore, must fail and stands dismissed.\n<\/p>\n<p>\t\t\t\t\t\t(A.L.\n<\/p>\n<p>DAVE, J.)<\/p>\n<p>\t\t\t\t\t\t(BANKIM<br \/>\nN.
