             Petitioners in the writ petition are the appellants in<\/p>\n
this writ appeal. The writ petitioners approached this Court<\/p>\n
with the following prayers:\n<\/p>\n
                   “a) Call for the records leading to issuance of<\/p>\n
      ExhibitsP1 to P9 and quash Exhibit.P5 order of the Tribunal for<\/p>\n
      Local Self Government Institutions by issuing a writ of<\/p>\n
      certiorari;\n<\/p><\/blockquote>\n
                   b) Issue a writ of mandamus or any other writ,<\/p>\n
      order or direction commanding the respondents 5 &6 to take<\/p>\n
      immediate steps to ascertain the exact health hazards of the<\/p>\n
      public by constituting an expert body with competent<\/p>\n
      personalities to ascertain the exact extent of health hazards to<\/p>\n
      the public due to the mobile radiation;\n<\/p><\/blockquote>\n
                   c) Direct the respondents 2,3 & 5 not to proceed<\/p>\n
      with the construction of mobile transmission tower under the<\/p>\n
      strength of Exhibit.P5 order, until a report submitted by the<\/p>\n
      respondents 5 & 6 to the effect that mobile radiation will not<\/p>\n
      cause harm and adverse health impacts to the general public<\/p>\n
      as well as to the environment;”\n<\/p><\/blockquote>\n
             2. The sequence of events as narrated in the writ<\/p>\n
petition as well as in the memorandum of appeal is as follows.<\/p>\n<\/blockquote>\n

In connection with the setting up of a Mobile Base Transceiver<\/p>\n
Station(Mobile Tower), the third respondent sought for a<\/p>\n
building permit which was issued by the local authority(1st<\/p>\n
respondent)    as borne by Ext.P1.    Based on Ext.P1, further<\/p>\n
steps were being taken for the construction of the Tower. At<\/p>\n
that point of time the petitioners filed a complaint\/objection,<\/p>\n
pursuant to which Ext.P3 ‘stop memo’ was issued by the<\/p>\n
Panchayat stalling the construction.   Aggrieved by this, the<\/p>\n
concerned respondents(2nd     and 3rd respondents in the writ<\/p>\n
petition), approached the Tribunal for Local Self Government<\/p>\n
Institutions, wherein the Tribunal passed Ext.P4 interim order,<\/p>\n
staying the operation of the ‘stop memo’ issued by the<\/p>\n
Panchayat.    The petitioners got impleaded themselves in the<\/p>\n
proceedings before the Tribunal.    Despite service of notice,<\/p>\n
respondents 1 and 4 herein, who were respondents 1 and 2 in<\/p>\n
the appeal,     did not turn up before the Tribunal.     After<\/p>\n
considering the available materials on record, the Tribunal<\/p>\n
allowed the appeal and the ‘stop memo’ was set aside, which<\/p>\n

formed the subject matter of challenge in the writ petition filed<\/p>\n
by the appellants.\n<\/p>\n
           3. The learned Single Judge considered the matter<\/p>\n
both on legal as well as factual aspects and arrived at a finding<\/p>\n
that the course pursued by the Panchayat by issuing ‘stop<\/p>\n
memo’ after the granting of necessary permit is erroneous and<\/p>\n
that the Tribunal was justified in allowing the appeal filed by the<\/p>\n
aggrieved parties.   The contentions raised by the petitioners<\/p>\n
were repelled by the learned Single Judge and the writ petition<\/p>\n
was dismissed ‘in limine’, which is under challenge in this<\/p>\n
appeal.\n<\/p>\n
           4.   The learned counsel for the appellant submits<\/p>\n
that the vital aspects projected in the writ petition have not<\/p>\n
been properly considered by the learned Single Judge.<\/p>\n
Referring to ‘Rule 11’ of the Kerala Municipality Building Rules,<\/p>\n
1999, on the basis of which Ext.P1 permit is stated as issued,<\/p>\n
the learned counsel submits that the matter ought to have been<\/p>\n
considered with reference to ‘Rule 130’ and other rules under<\/p>\n

Chapter XIX of the aforesaid rules which specifically deal with<\/p>\n
the construction of ‘mobile towers’.\n<\/p>\n
            5. In fact, the said aspect was also considered by<\/p>\n
the learned Single Judge and a finding was rendered in this<\/p>\n
regard in paragraph 5 of the judgment, observing that the<\/p>\n
failure to refer to Rule 130 of the rules while issuing the permit<\/p>\n
will not vitiate the permit.\n<\/p>\n
            6.   With regard to the rights and liberties of the<\/p>\n
parties, particularly with reference to the contention as to the<\/p>\n
alleged health hazard, reference has been made to the decision<\/p>\n
rendered by a Division Bench of this Court reported in Reliance<\/p>\n
Infocom v. Chemancherry Grama Panchayat<\/a> (2006 (4)KLT<\/p>\n
695). The Division Bench has arrived at a finding that, as on<\/p>\n
date, no scientific data or reliable material is available to show<\/p>\n
that installation of a mobile tower will cause any health hazard.<\/p>\n
This was approved by a Full Bench of this Court in Messers<\/p>\n
Essar Telecom Infrastructure (P) Limited v. C.I.of Police,<\/p>\n
Angamali Police Station<\/a> [2010 (2) KHC 445 (FB)].              Both<\/p>\n

these verdicts were considered by the learned Single Judge<\/p>\n
while declining interference in the Writ Petition.<\/p>\n
           7. Another important aspect to be noted is that the<\/p>\n
challenge raised by the petitioners in the writ petition is to set<\/p>\n
aside ‘Ext.P5’ order passed by the Tribunal; while no specific<\/p>\n
prayer is there to set aside ‘Ext.P1’ permit in the writ petition.<\/p>\n
The main relief sought for stands confined to quashing          of<\/p>\n
Ext.P5 alone, which is the order passed by the Tribunal,<\/p>\n
intercepting Ext.P3 stop memo issued by the Panchayat, for<\/p>\n
the reasons stated therein.      Ext.P1 was never subjected to<\/p>\n
challenge at the instance of anybody before the Tribunal or such<\/p>\n
other appropriate Forum.\n<\/p>\n
           8.  In the above facts and circumstances, we find<\/p>\n
that the verdict passed by the learned Single Judge is beyond<\/p>\n
challenge.    The appeal is devoid of merit and none of the<\/p>\n
grounds raised in support of the same does serve the purpose.<\/p>\n
No interference is warranted and the writ appeal is dismissed<\/p>\n
accordingly.\n<\/p>\n

           However, we make it clear that we have not<\/p>\n
expressed anything with regard to the merits of the case,<\/p>\n
pertaining to the legality or sustainability of Ext.P1 permit. It is<\/p>\n
open for the parties concerned, to challenge the same in<\/p>\n
accordance with law, before appropriate forum, if at all<\/p>\n
aggrieved in any manner.\n<\/p>\n<\/p>\n
