Justice T.R.RAMACHANDRAN NAIR\n\n Dated :09\/02\/2011\n\n O R D E R\n                  T.R.RAMACHANDRAN NAIR, J.\n          ---------------------------------------------------------\n                   W.P.(C) NO. 35261 OF 2010\n          --------------------------------------------------------\n           Dated this the 9th day of February, 2011.\n\n                               JUDGMENT\n<\/pre>\n<p>      The petitioner retired from service as Assistant Registrar of<\/p>\n<p>the Kannur University. The petitioner&#8217;s complaint is about the<\/p>\n<p>undue delay in disbursing the retirement benefits including<\/p>\n<p>monthly pension and gratuity. Subsequent to the filing of the writ<\/p>\n<p>petition   the    University     has    passed      an    order    as per<\/p>\n<p>No.Ad.A2\/859\/2008, whereby sanction has been granted by the<\/p>\n<p>Vice Chancellor for the payment of pensionary benefits as<\/p>\n<p>detailed in the order. An          amount of Rs.60,222\/- has been<\/p>\n<p>withheld from the DCRG being the amount estimated as excess<\/p>\n<p>drawal of pay and allowances on account of step up of pay<\/p>\n<p>granted which is objected by Local Fund Audit.<\/p>\n<p>      2. Heard the learned Standing Counsel of the University. It<\/p>\n<p>is submitted by the learned Standing Counsel of the University<\/p>\n<p>that the details of the objections raised by audit has been<\/p>\n<p>informed by letter dated 27.5.2010 to the petitioner and he has<\/p>\n<p>already filed a representation dated 20.10.2010.<\/p>\n<p>      3. Learned counsel for the petitioner submitted that the<\/p>\n<p>audit objection cannot be sustained and there is no reason for<\/p>\n<p>withholding the amount.\n<\/p>\n<p><span class=\"hidden_text\">W.P.(C) NO. 35261 OF 2010           2<\/span><\/p>\n<p>       4. Since the matter is     yet to be finalised, the objection<\/p>\n<p>raised by the petitioner in her representation will be processed<\/p>\n<p>and all particulars will be given to the petitioner and a personal<\/p>\n<p>hearing will also be afforded by the competent authority. In the<\/p>\n<p>meanwhile monthly pension as sanctioned along with arrears,<\/p>\n<p>other admissible benefits and the amount of DCRG             namely<\/p>\n<p>Rs.2,69,778\/- (DCRG admissible is Rs.3,30,000\/-) which is the<\/p>\n<p>undisputed        portion  will  be   released   to   the   petitioner<\/p>\n<p>expeditiously and without any delay.\n<\/p>\n<p>         Writ Petition is accordingly disposed of.
