Posting order was given to the<br \/>\n\tpetitioner and in the said order dated 18th February,<br \/>\n\t1981, a change was made namely instead of posting as Forest Guard<br \/>\n\this posting was made as Chokidar.  The petitioner has raised his<br \/>\n\tgrievance in respect the same by several communications. However, no<br \/>\n\treply has been received by him. He had made several representations<br \/>\n\tto the ministry too but in vain and till date his case is not<br \/>\n\tconsidered for promotion. Hence present petition.\n<\/p>\n<p>\t\tHeard learned advocates for<br \/>\n\tthe respective parties and perused the documents on record.\n<\/p>\n<p>\t\tThe respondents had filed<br \/>\n\ttheir reply, wherein it is  stated as under :\n<\/p>\n<p>\t4.<br \/>\n\t\tWith reference to the averments made in para:2 of the petition, I<br \/>\n\tsay  and submit that the Recruitment to the post of Beat Guard is<br \/>\n\tGoverned by statutory Recruitment Rules for the post of Beat Guards<br \/>\n\twhich are produced herewith as Annexure-R.1 to this affidavit. I<br \/>\n\tfurther say  and submit that as per provisions of Recruitment Rules<br \/>\n\tfor beat Guards, following minimum physical standards for<br \/>\n\teligibility are prescribed.\n<\/p>\n<p>\tHeight:\n<\/p>\n<p>\t163 CMS,<\/p>\n<p>\tChest:\n<\/p>\n<p>\tNormal 79 CMS. Expanded: 84 CMS<\/p>\n<p>\tMinimum<br \/>\n\tChest expansion: 5 CMS<\/p>\n<p>\tI<br \/>\n\tfurther say that pursuant to the letter of employment office Bhuj,<br \/>\n\tpetitioner was examined and interviewed on dated 5.2.1981 by the<br \/>\n\trespondent no.3. At the time of interview, petitioner was found to<br \/>\n\tbe lacking in minimum physical standards prescribed by Recruitment<br \/>\n\tRules for Beat Guards. His height was found to be 162.5 Cms, as<br \/>\n\tagainst 163 Cms. prescribed under the rules. He was working as<br \/>\n\tLaborer in Nursery of Forest Department and he was considered<br \/>\n\tsympathetically instead of rejecting him outright. Inspite of he is<br \/>\n\tbeing physically unfit he was appointed as  Chokidar. He expressed<br \/>\n\this willingness to work even as Peon before appointing authority. I<br \/>\n\tfurther say and submit that the entries proving petitioner&#8217;s<br \/>\n\tphysical unfitness and his willingness to work even as Peon is duly<br \/>\n\trecorded by interviewing  and appointing Officer in his handwriting<br \/>\n\tin the relevant register at the time of interview of dated 5.2.1981.<br \/>\n\tThe original Register will be produced before the Hon&#8217;ble Court at<br \/>\n\tthe time of hearing, if necessary.\n<\/p>\n<p>\t\tFrom the record it appears<br \/>\n\tthat  the petitioner, along with eight other Chokidars were examined<br \/>\n\tand interviewed again on 5.8.1981 for selection and appointment to<br \/>\n\tthe post of Beat Guard. The petitioner has failed in physical<br \/>\n\tfitness test while some chokidars were selected  \tfrom the same<br \/>\n\tselection list and were appointed as Beat Guards. Therefore I am of<br \/>\n\tthe opinion that the petitioner cannot make claim for similar<br \/>\n\tbenefit as those who were selected for the post of Beat Guards. In<br \/>\n\tthat view of the matter, petition is devoid of any merits. Hence<br \/>\n\tpetition is dismissed.
