SAHAI, J.)<\/p>\n<p>(G.B.SHAH,<br \/>\nJ.)<\/p>\n<p> ORAL<br \/>\nORDER IN CIVIL APPLICATION NO.17188 of 2010<\/p>\n<p>3.\t\tHaving<br \/>\nheard the learned Counsel for the applicant,<br \/>\nwe, prima<br \/>\nfacie, find<br \/>\nforce<br \/>\nin the submissions of the learned Counsel for the applicant that,<br \/>\nwhile granting relief of reinstatement, back-wages ought not to have<br \/>\nbeen awarded, in the light of the recent judgment of the Hon&#8217;ble Apex<br \/>\nCourt. The applicant is, therefore, entitled for stay.\n<\/p>\n<p>4.\t\tRULE,<br \/>\nreturnable on 4TH APRIL,<br \/>\n2011. Mr. Mishra, learned Counsel, waives service of notice<br \/>\nof rule on behalf of the respondent.\n<\/p>\n<p>5.\t\tUnder<br \/>\nthe order of this Court, operation and execution of the order passed<br \/>\nby the learned Single Judge, dated 08.03.2010, in<br \/>\nSpecial Civil Application No.15500 of<br \/>\n2008 and the award of the Labour Court, dated 13.03.2008,<br \/>\nin Reference L.C.A.
