Secy.,Housing &amp; Urban Planning\n&amp; Others\nPetitioner Counsel :- Nandita Bharti\nRespondent Counsel :- C.S.C.,Mahesh Chandra\n\nHon'ble Pradeep Kant,J.\n<\/pre>\n<p>Hon&#8217;ble Ritu Raj Awasthi,J.\n<\/p>\n<p>      Notice on behalf of respondent no.1 has been accepted by the<br \/>\nlearned Chief Standing Counsel and on behalf of respondent nos. 2<br \/>\nand 3 notice has been accepted by Sri Mahesh Chandra.\n<\/p>\n<p>      Learned counsel for the petitioner Sri Prashant Chandra submits<br \/>\nthat despite the order passed by this Court for determination of<br \/>\nbetterment charges in accordance with the provisions of section 51 of<br \/>\nU.P. Awas Evam Vikas Parishad Adhiniyam, 1965, the impugned<br \/>\norder has been passed by the Housing Commissioner in pursuance of<br \/>\nthe resolution passed by the Board reiterating that the determination<br \/>\nhas been done in the year 2000 but again without the scheme being<br \/>\neven launched, what to say of being in advanced stage, as required in<br \/>\nsection 51 of the aforesaid Act, even the possession of the land has yet<br \/>\nbeen taken..\n<\/p>\n<p>      Under the impugned order, only interim betterment charges<br \/>\nhave been asked for, with the condition, that if any excess amount, on<br \/>\ndetermination being made, later on the same shall also be recovered,<br \/>\nsubmission is that in view of section 51 of the aforesaid Act, when it<br \/>\nappears to the Board that the scheme is sufficient advanced to enable<br \/>\nthe amount of the betterment fee to be determined, the Board shall, by<br \/>\nresolution passed in this behalf, declare that for the purpose of<br \/>\ndetermining such fee, the execution of the scheme shall be deemed to<br \/>\nhave been completed and shall thereupon give notice in writing to<br \/>\nevery person on whom a notice has been served under section 51 or to<br \/>\nthe successor-in-interest of such person, as the case may be, that the<br \/>\nBoard proposes to assess the amount of betterment fee payable in<br \/>\n respect of such land. Section 50, gives the manner in which such<br \/>\ncalculation is to be done.\n<\/p>\n<p>        The impugned order dated 24.06.2010 itself says that the<br \/>\ndevelopment work is yet to be undertaken and it does not say that any<br \/>\ndevelopment work has been done rather to the contrary the letter of<br \/>\nthe Commissioner of the Division dated 30.10.2009 makes specific<br \/>\nrecital that no development work has yet been started under &#8216;Jagrati<br \/>\nVihar Scheme&#8217; and that even possession has not been transferred till<br \/>\ndate.\n<\/p>\n<p>        In support of his submission, the learned counsel for the<br \/>\npetitioner also placed reliance upon the order dated 27.04.2010 passed<br \/>\nin Civil Misc. Writ Petition No. 35372 of 1998 In re:- Dr. Umesh<br \/>\nChandra Maheshwari vs Mathura\/Vrindavan Development Authority<br \/>\nand another, at Allahabad.\n<\/p>\n<p>        It also could not be explained by the respondents under which<br \/>\nprovision, any amount of betterment charges can be asked for as an<br \/>\ninterim measure nor there is any provision which permits<br \/>\ndetermination of interim betterment charges.\n<\/p>\n<p>        We, under the circumstances, are prima-facie of the view that<br \/>\nthe Housing Commissioner or the Board would have no authority to<br \/>\neither issue notice under section 51 of the aforesaid Act or to make<br \/>\nassessment of betterment charges unless the conditions specified<br \/>\ntherein do exist stand fulfilled.\n<\/p>\n<p>        The learned counsel for the respondents prays for and is granted<br \/>\nthree weeks time to file counter affidavit.\n<\/p>\n<p>        List this matter in the month of September, 2010.\n<\/p>\n<p>        Till then, the petitioner shall not be required to make payment<br \/>\nof the betterment charges, in pursuance of the impugned order dated<br \/>\n24.06.2010, contained in Annexure No.2 to the writ petition.\n<\/p>\n<p>Order Date :- 4.8.2010<br \/>\nvks\n  <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Madhur Colonisers Pvt. &#8230; vs State Of U.P.,Thru. &#8230; on 4 August, 2010 Court No. &#8211; 1 Case :- MISC.
