Justice P.N.RAVINDRAN\n\n Dated :11\/03\/2009\n\n O R D E R\n                      P.N.RAVINDRAN, J.\n                   ---------------------------------------\n                   W.P.(C) No.7527 OF 2009\n                   ---------------------------------------\n            Dated this the 11th day of March, 2009\n\n\n                            JUDGMENT\n<\/pre>\n<p>      Heard Sri.D.Kishore, the learned counsel appearing for<\/p>\n<p>the petitioner and Sri.A.J.Varghese, the learned Government<\/p>\n<p>Pleader appearing for the respondents.\n<\/p>\n<p>      2. The petitioner is a Specialist Teacher presently<\/p>\n<p>working    in   Government            High        School,   Kachani in<\/p>\n<p>Thiruvananthapuram District. She belongs to Chempazhanthi<\/p>\n<p>in Thiruvananthapuram District. After the petitioner entered<\/p>\n<p>service, she met with an accident resulting in injuries to her<\/p>\n<p>spinal cord. In view of the injuries sustained by her, the<\/p>\n<p>petitioner was given a transfer to Sreekariyam shortly after<\/p>\n<p>the accident and she continued at Sreekariyam till October,<\/p>\n<p>2006 when she was transferred back to Government High<\/p>\n<p>School, Kachani. Government High School, Kachani is 35 kms.<\/p>\n<p>away from Chempazhanthi.\n<\/p>\n<p>      3. The petitioner states that on account of the injuries<\/p>\n<p>sustained by her, it is difficult for her to travel to Kachani and<\/p>\n<p>back to Chempazhanthi everyday and that she had therefore<\/p>\n<p>W.P.(C) No.7527 of 2009<br \/>\n<span class=\"hidden_text\">                                2<\/span><\/p>\n<p>submitted Ext.P4 application requesting that during the<\/p>\n<p>general transfer for the year 2008-09, she may be transferred<\/p>\n<p>either to Government Vocational Higher Secondary School for<\/p>\n<p>Girls, Pettah or Government Higher Secondary School for<\/p>\n<p>Boys, Pettah or Government U.P.School, Kattayikonam. The<\/p>\n<p>said request was however not considered, it is submitted. The<\/p>\n<p>petitioner states that she has now submitted Ext.P5<\/p>\n<p>representation dated 16.02.2009 to the Deputy Director of<\/p>\n<p>Education, Thiruvananthapuram requesting that she may be<\/p>\n<p>transferred       to    Manackal  L.P.S.,   Chempazhanthy      or<\/p>\n<p>Kattayikonam UPS or Medical College H.S.S.\/UPS or<\/p>\n<p>Government Girls H.S.S. Pettah, where vacancies exist. In this<\/p>\n<p>writ petition, the petitioner inter alia prays for a direction to<\/p>\n<p>the Deputy Director of Education, Thiruvananthapuram to<\/p>\n<p>consider the request made by her in Ext.P5 sympathetically<\/p>\n<p>and to give her a suitable posting in any one of the schools<\/p>\n<p>named therein.\n<\/p>\n<p>       4. The pleadings disclose that taking note of the injuries<\/p>\n<p>sustained by the petitioner, she was initially given a transfer to<\/p>\n<p>Sreekariyam in the year 1991. However, she was again<\/p>\n<p>W.P.(C) No.7527 of 2009<br \/>\n<span class=\"hidden_text\">                                 3<\/span><\/p>\n<p>transferred back to Kachani in October, 2006. In view of the<\/p>\n<p>fact that the petitioner is suffering from the after effects of the<\/p>\n<p>injury to her spinal cord, I am of the opinion that the request<\/p>\n<p>made by the petitioner in Ext.P5 merits sympathetic<\/p>\n<p>consideration at the hands of the Deputy Director of<\/p>\n<p>Education, Thiruvananthapuram. I accordingly direct the<\/p>\n<p>Deputy      Director    of Education,   Thiruvananthapuram       to<\/p>\n<p>consider the request made by the petitioner in Ext.P5 on<\/p>\n<p>sympathetic grounds and take a decision thereon while<\/p>\n<p>effecting general transfers for the year 2009-2010.<\/p>\n<p>       The writ petition is disposed of as above.<\/p>\n<p>                                         P.N.RAVINDRAN<br \/>\n                                               JUDGE<\/p>\n<p>pac<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court V.
