Against the said order of the Deputy Collector dated<br \/>\n\t13.11.2001, appeal was preferred and the same has been rejected on<br \/>\n\tthe ground of delay vide order dated 20.01.2006 (Anexure-C).\n<\/p>\n<p>Mr.Dave,<br \/>\n\tlearned AGP under the instruction of GP states that the State<br \/>\n\tGovernment has taken decision to reconsider all cases, where the<br \/>\n\tDeputy Collector has exercised the power in mechanical manner,<br \/>\n\twithout considering the facts and circumstances pertaining to all<br \/>\n\tdocument presented prior to December 2006. However, learned Asst.<br \/>\n\tGovernment Pleader states that the matter may be remanded to the<br \/>\n\tDeputy Collector as if the appeal is allowed, and Deputy Collector<br \/>\n\tshall decide the matter afresh. He only submitted that the<br \/>\n\tpetitioners may appear before the Deputy Collector within two weeks<br \/>\n\tfrom today.\n<\/p>\n<p>As<br \/>\n\tthe document is presented prior to cutoff date, the present case<br \/>\n\twould be covered in the general policy and the declaration made on<br \/>\n\tbehalf of the State Government, which has been recorded in Special<br \/>\n\tCivil Application No.10177 of 2008, decided on 08.08.2008.\n<\/p>\n<p>In<br \/>\n\tview of the above declaration made on behalf of the State<br \/>\n\tGovernment, the impugned order passed by the Deputy Collector for<br \/>\n\tassessment of the stamp duty as well as the order of Appellate<br \/>\n\tAuthority rejecting the appeal and thereby confirming the order of<br \/>\n\tthe Deputy Collector is quashed and set aside with the direction<br \/>\n\tthat the matter shall stand restored to the Deputy Collector.\n<\/p>\n<p>The<br \/>\n\tpetitioners shall appear before the Deputy Collector within two<br \/>\n\tweeks from today. The Deputy Collector shall decide the matter in<br \/>\n\taccordance with law after giving opportunity of hearing to the<br \/>\n\tpetitioners and shall pass the order.\n<\/p>\n<p>It<br \/>\n\tis hardly required to be clarified that when the order is quashed,<br \/>\n\tthere shall not be any recovery until afresh order is passed by the<br \/>\n\tDeputy Collector. In the event, if the petitioner is aggrieved by<br \/>\n\tafresh order, which may be passed by the Deputy Collector, the<br \/>\n\tpetitioner may resort to remedy as may be permissible in law.\n<\/p>\n<p>The<br \/>\n\tpetition is allowed to the aforesaid extent. Rule made absolute<br \/>\n\taccordingly.
