Justice V.K.MOHANAN\n\n Dated :21\/04\/2009\n\n O R D E R\n                        V.K.MOHANAN, J.\n                   ---------------------------------------\n                     B.A. No.2120 OF 2009\n                   ---------------------------------------\n             Dated this the 21st day of April, 2009\n\n\n                              O R D E R\n<\/pre>\n<p>     The petitioner who is the ninth accused in Crime<\/p>\n<p>No.402\/2008 of Elathur Police Station, which is registered for<\/p>\n<p>the offences punishable under Sections 366(A), 376(g), 372<\/p>\n<p>and 373 of I.P.C., seeks anticipatory bail.<\/p>\n<p>     2.    The prosecution allegation is that the fourth<\/p>\n<p>accused in this case used a minor girl for prostitution by<\/p>\n<p>keeping her in the house of the fourth accused and also to<\/p>\n<p>some other persons for the last one year. The further<\/p>\n<p>allegation is that during such period, the fourth accused<\/p>\n<p>presented the said minor girl for sexual intercourse with<\/p>\n<p>accused Nos. 1 to 3. The allegation against the petitioner<\/p>\n<p>herein is that he approached the fourth accused and asked her<\/p>\n<p>to took the victim to the hospital, where the petitioner is<\/p>\n<p>working and accordingly, the fourth accused took the girl to<\/p>\n<p>the hospital and thereupon, the petitioner committed rape on<\/p>\n<p>the girl.\n<\/p>\n<p>     3.    I have heard the learned counsel for the petitioner<\/p>\n<p>B.A.No.2120 of 2009<br \/>\n<span class=\"hidden_text\">                                2<\/span><\/p>\n<p>as well as the learned Public Prosecutor.<\/p>\n<p>       4. The learned counsel for the petitioner submitted that<\/p>\n<p>the petitioner being a medical practitioner, used to treat many<\/p>\n<p>people in the hospital and probably the girl might have seen<\/p>\n<p>the petitioner and due to mistaken identity, the name of the<\/p>\n<p>petitioner is shown as an accused. It is also submitted that the<\/p>\n<p>investigation is practically over and the custodial interrogation<\/p>\n<p>of the petitioner is not necessary. The learned Public<\/p>\n<p>Prosecutor stoutly opposed the prayer in the petition for<\/p>\n<p>pre-arrest bail.\n<\/p>\n<p>       5. I have carefully considered the contentions advanced<\/p>\n<p>by the counsel for the petitioner as well as the learned Public<\/p>\n<p>Prosecutor. Though the petitioner is a medical practitioner, he<\/p>\n<p>is involved in a heinous crime and the specific allegation<\/p>\n<p>against the petitioner is that he had committed rape on a<\/p>\n<p>minor girl provided by the fourth accused. I myself restrained<\/p>\n<p>from discussing and entering into the merits of the contentions<\/p>\n<p>advanced as it is likely to adversely affect either the<\/p>\n<p>prosecution or the defence.
