Theifacts in _nu\u00abt&#039;SIhell._are:ias follows--\n\nOne Sri. iShekha1*__Basan*aik Naikar, who was travelling in\n\n:_Murnbai,}f\u00a3olhapur Say&#039;ad_hri&#039; Express Train on his way back to his\n\nnative.pla.ce~.on ann&#039;u_al leave after year of service spent in Military\n\n sepey-,~&#039; rnet-iiyviithiia fateful accident on 07\/03\/2002 viz., on\n\n account of they train door opening by technical lapse. The Tribunal\n\n &#039;iconsiciered the claim of the mother by its judgment dtd.\n\nC21&#039;,\/()iil allowed the claim petition and awarded a\n\nQ\/.\n\n\n\ncompensation of Rs.4,00,000\/~ with interest thereon at 9% p.a.\n\nfrom the date of order till the date of actual payment:\n\n3. The appellant is questioning thishaward&#039; i&#039;rr1plied.:l&#039;y&quot;=\n\noverruled the claim of claimant for grant of:_&#039;intere&#039;sti from \n\nof petition till date of award.\n\n4. I have heard  -,Naganiiri,&#039; learned counsel\nappearing for appellant andAA.S.ri_.&#039;l&quot;learned counsel\n\nappear-ingfor   \n\n5. Sri.  contend that, under similar\ncircumstancespthis \u00abcase of Smt.S. Devamma @ Devi\n\nBai and_AnotPi\u00e9rV_:Vvs.Unioii&#039;. of India Rep. by the General\n\n:,rg;ia.wgeir$&#039;sau.thern R\u00e9iiwdy reported in me 2009 KAR 472 had\n\naw&#039;a1jdVed_  99\/0 from the date of institution of application\n\n&#039; 5._.x.till datcjlof actuialeiipayment and submits that similar benefit he\n\n--._iei&#039;_j~,.e;&lt;&#039;te,nC1ed to the claimant also. Per contra, Sri.R.M. Kulkarni,\n\nwoi;.ilci.pco&quot;ntend that in the case of Smt. Leelavathamma vs. The\n\ni.  of India,\u00bb reported in 200412] KL} 5545, this Court has\n\n l\n\n\n\nnegatived the claim of the claimant for grant of interest from the\n\ndate of petition till date of award.\n\n6. Having heard the learned Advocates appearing for\nthe only question that arises for consideration is;\n\n&quot; Whether the Tribunal was .justzjied  \nthe claim. of the appellant in not g4ran&#039;tin._(j the&#039; inlter\u00e9sii-st.___ \n\nfrom the date of petition till date\u00e9of award?&quot;\n\n7. Appellant \ufb01led clai.i&#039;n_petitioiiiiinllthe year&quot;20*\u20aci3 against\nUnion of India represented   South Central\n\nRailway, Railway Nilayam,  for \ufb01ling such\n\na claim petition inliar.ray&#039;ngGaoi1th--Centrai Railway as respondent\nwas on the  of the l9lR,.registered by the jurisdictional police\nagainst the &#039;Soguthltientral Railway, Railway Nilayam Secundrabad.\n\n:&#039;C)n iaccotinyt  realignment in the administration of Railways the\n\nsaid&quot;  accident took place claim under the\n\niiiiillijurisdiction of &#039;Central Railway&#039;s Bombay Maharastra State. This\n\n&quot; ii:-lealignment totolc place during the pendency of the adjudication of\n\n the-R  petition. Having noticed this realignment in the\n\nadini_nistration, the appellant promptly moved an application for\n\nR, .\n\n\n\nimpleading Central Railways Mumbai as respondent on\n27\/11\/2007 which application came to be allowed.&quot;&#039;--,yand\n\nthereafterwards the proceedings continued. The\n\nhaving started in the year 2003 continued till 2009     \n\nWhisper by respondent or in the order :ofi&quot;th&#039;eTribu;nal&quot; \n\ndelay has occasioned in adjudication of  claim proceeding_s&#039;.*--._In~_\n\nthe absence of the same, the delay,.Ic&#039;annot to the&#039;\n\nclaimant. Be that as it may, ;--the reai1ignrn--en&#039;ti.in theadministration\nof Railways had necessitated the_i.claim.:iant  impleading of 2nd\nrespondent as party, 4wiho_coI;iteisted the\u00ab.h1atter&#039;i:before the Tribunal.\n\nHence, the cont;-zrition5:of&#039;;&#039;-_the.:_leai:ned counsel for respondents in\n\nthis appeal   from the date of\npetition doesixAnot&#039;hold  i&#039;i?iyen.i*&#039;otherwise, the Hon&#039;ble Supreme\nCourt hac1_ .Qccasion_:Vto .conis&#039;idie&quot;ri this issue in <a href=\"\/doc\/1873226\/\">Rathi vs. Union of<\/a>\n repioirted in   1333 ie, as to payment of interest\n\n  claim petition and accordingly awarded the\n\n0 7....interest'.In ease relied upon by the learned counsel for\n\n.._iyi'_'\u00ab.re4spondent~~ vi.ie., Leelavathamma's case supra, the interest in\n\n'i._i_i\"resp\u00e9ct of the enhanced compensation was denied on the ground\n\n0' if-th'at the compensation payable under the relevant rules at the time\n\n\n\nof accident was Rs.2,00,000\/~, but by virtue of a statutory\n\namendment it came to be enhanced to Rs.4,00,000\/-- and'h_i\u00e9'nce._in\n\nrespect of the enhanced compensation this--*:._   \n\nLeelavatharI1rna's case held that claimant would not '_'e,n'ti.tled for\"\n\ninterest from the date of petition till datei\u00e9ofVthe\"p11es'ent\n\ncase such a situation does not arise, In'-fact tthe: lclainjiant hash\n\nmade a claim for payment of interestlfrornuthe 'date: of petition till\ndate of payment and also seen no fault of the\nclaimant that the claim has    manner and\nthat too after 6   award. Hence to\ndeprive her  awarded from the date of\npetition   _theVicvanons of law, but it would\nbe against the substantial justice.
