S.J.MUKHOPADHAYA)<\/p>\n<p>\tPanch<br \/>\nrojkam dated 27th July 2011 has been filed on behalf of<br \/>\nthe respondent, wherein it is shown that 290 fruit bearing trees have<br \/>\nbeen implanted by the appellant around the said land after putting<br \/>\ncement poles, fencing of barbed wire, apart from facility of water<br \/>\nfrom the field of neighbour.\n<\/p>\n<p>\tLearned<br \/>\nAGP appearing on behalf of the respondent submits that it has been<br \/>\nimplanted recently and, therefore, it is necessary to verify as to<br \/>\nwhether the appellant takes care of the same.\n<\/p>\n<p>\tIn<br \/>\nthe circumstances, we allow the appellant to nurture 290 fruit<br \/>\nbearing trees, and if possible, to implant more fruit bearing trees<br \/>\nas per the direction of the State Government, and to submit report by<br \/>\nthe next date. On failure, the Court may dismiss the Appeal and<br \/>\naffirm the order passed by the learned Single Judge.\n<\/p>\n<p>\tPost<br \/>\nthe matter on 3rd October 2011. No interim relief is<br \/>\ngranted for the present.
