HEMA, J.\n        - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n                        B.A. No. 7916 of 2008\n        - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n            Dated this the 1st day of January,2009\n\n                                 O R D E R\n<\/pre>\n<p>       Petition for anticipatory bail.\n<\/p>\n<p>       2. The alleged offences are under sections 452 and 332<\/p>\n<p>IPC. According to prosecution, petitioner trespassed into the<\/p>\n<p>Electricity Office and assaulted an Overseer, asking him what<\/p>\n<p>he had done etc., and deterred him from discharging his official<\/p>\n<p>duty. On the complaint of the Overseer, the Asst. Executive<\/p>\n<p>Officer lodged an First Information Statement, based on which,<\/p>\n<p>F.I.R. was registered against petitioner.<\/p>\n<p>       3.   Learned       counsel      for    petitioner      submitted   that<\/p>\n<p>petitioner is an illiterate person. He has six cents of property<\/p>\n<p>and his neighbour wanted to draw an electric line over<\/p>\n<p>petitioner&#8217;s property, which was objected to by petitioner, since<\/p>\n<p>he will not be able to construct a proper house in future, if<\/p>\n<p>drawing is allowed. Several times, the neighbour attempted to<\/p>\n<p>get petitioner&#8217;s consent and official in the K.S.E.B. were also<\/p>\n<p>influenced by him to get consent from petitioner. Petitioner was<\/p>\n<p>called to the K.S.E.B. office by the Overseer. He went there and<\/p>\n<p>petitioner&#8217;s signature was obtained fraudulently by the Overseer<\/p>\n<p>and later, the line was drawn over the petitioner&#8217;s property<\/p>\n<p>while petitioner was not available in the house.<\/p>\n<p>BA 7916 \/08                       -2-\n<\/p>\n<p>       4. Petitioner&#8217;s wife objected to this, when it was made<\/p>\n<p>known to her that a consent was obtained from petitioner. When<\/p>\n<p>petitioner knew that consent was fraudulently obtained by him,<\/p>\n<p>he went to the office and he found Overseer standing on the<\/p>\n<p>road. There was an altercation between petitioner and overseer<\/p>\n<p>regarding obtaining of signature from petitioner and nothing<\/p>\n<p>more had happened. The complaint is lodged falsely against<\/p>\n<p>petitioner and hence, he may be granted anticipatory bail, it is<\/p>\n<p>submitted.\n<\/p>\n<p>       5.  Learned    Public  Prosecutor   submitted   that   the<\/p>\n<p>allegations are serious in nature, but nothing is stated in the<\/p>\n<p>complaint as to why petitioner had acted in the manner against<\/p>\n<p>the Overseer.\n<\/p>\n<p>       6. On hearing both sides, I am satisfied that anticipatory<\/p>\n<p>bail can be granted to petitioner and hence, the following order<\/p>\n<p>is passed:-\n<\/p>\n<blockquote><p>      (1) Petitioner shall surrender before the Magistrate<\/p>\n<p>            court concerned within seven days from today<\/p>\n<p>            and he     shall be released on bail, on his<\/p>\n<p>            executing a bond for Rs. 25,000\/- with two<\/p>\n<p>            solvent sureties each, for the like amount, to<\/p>\n<p>BA 7916 \/08                       -3-\n<\/p><\/blockquote>\n<blockquote><p>            the satisfaction of the learned Magistrate, on<\/p>\n<p>            the following conditions:-<\/p>\n<\/blockquote>\n<blockquote><p>           i)    Petitioner shall    co-operate with the<\/p>\n<p>                 investigation and report before the the<\/p>\n<p>                 Investigating Officer as and when<\/p>\n<p>                 directed.\n<\/p><\/blockquote>\n<blockquote><p>           ii)   Petitioner shall not commit any offence<\/p>\n<p>                 while on bail.\n<\/p><\/blockquote>\n<blockquote><p>      This petition is allowed.<\/p>\n<\/blockquote>\n<blockquote><p>                                           K.HEMA, JUDGE.\n<\/p><\/blockquote>\n<blockquote><p>mn.<\/p>\n<\/blockquote>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Nazar vs State Of Kerala on 1 January, 2009 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 7916 of 2008() 1.
