Justice R.BASANT\n\n Dated :29\/04\/2008\n\n O R D E R\n                           R.BASANT, J.\n                        ----------------------\n                      Crl.M.C.No.1704 of 2008\n                    ----------------------------------------\n                Dated this the 29th day of April 2008\n\n                               O R D E R\n<\/pre>\n<p>      The petitioner faces allegations in a crime registered under<\/p>\n<p>the provisions of the Emigration Act. He was granted bail. In<\/p>\n<p>connection with the investigation, the passport of the petitioner<\/p>\n<p>was seized by the police and the same was produced before court.<\/p>\n<p>The petitioner wants to go abroad. There is no condition of bail<\/p>\n<p>that he should not go abroad.               But because the passport is<\/p>\n<p>produced before the learned Magistrate, the petitioner is not able<\/p>\n<p>to go abroad. He very badly wants to go abroad in connection with<\/p>\n<p>his work. The petitioner applied to the learned Magistrate for<\/p>\n<p>release of the passport. The same has not been released to him.<\/p>\n<p>By the impugned order, the said prayer was turned down. The<\/p>\n<p>petitioner has come to this court with this petition under Section<\/p>\n<p>482 Cr.P.C for a direction subject to appropriate safeguards to<\/p>\n<p>release the passport to him to enable him to go abroad.<\/p>\n<p>      2.   Notice has been given to the learned Public Prosecutor.<\/p>\n<p>The learned Public Prosecutor has been heard.                  The learned<\/p>\n<p>counsel for the petitioner makes it clear that he is not applying for<\/p>\n<p>release of the other articles seized; but the only prayer is that the<\/p>\n<p>passport may be released to him.\n<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.1704\/08                2<\/span><\/p>\n<p>      3.    Having considered all the relevant circumstances, I<\/p>\n<p>am satisfied that a direction can be issued to the learned<\/p>\n<p>Magistrate to release the passport to the petitioner subject to<\/p>\n<p>appropriate conditions.\n<\/p>\n<p>      4.    In the result, this petition is allowed. The passport of<\/p>\n<p>the petitioner which is seized by the police and produced before<\/p>\n<p>the learned Magistrate shall be released to the petitioner on the<\/p>\n<p>following terms and conditions:\n<\/p>\n<p>      i)    An attested photostat copy of the passport shall be<\/p>\n<p>produced in substitution.\n<\/p>\n<p>      ii)   The petitioner shall execute a bond for Rs.1,00,000\/-<\/p>\n<p>(Rupees one lakh only) undertaking to produce the passport<\/p>\n<p>before the learned Magistrate as and when directed by the<\/p>\n<p>learned Magistrate.\n<\/p>\n<p>      iii)  The petitioner shall specify the name of his counsel or<\/p>\n<p>such other persons to whom notice should be issued by the court<\/p>\n<p>to direct him to produce the passport before the court.<\/p>\n<p>      iv)   The petitioner shall reproduce the original passport<\/p>\n<p>before the learned Magistrate within a period of sixty days from<\/p>\n<p>the date on which such a direction is issued by the learned<\/p>\n<p>Magistrate to the petitioner\/persons specified by the petitioner.<\/p>\n<p>                                               (R.BASANT, JUDGE)<br \/>\njsr<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.1704\/08    3<\/span><\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.1704\/08    4<\/span><\/p>\n<p>       R.BASANT, J.\n<\/p>\n<p>         CRL.M.CNo.\n<\/p>\n<p>            ORDER<\/p>\n<p>21ST DAY OF MAY2007<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court K.K.
