Vyas, for the appellant.\n    Mr. Suresh Shrimali ]\n    Mr. Mahesh Joshi      ], for the respondent.\n                                    .....\n\n    BY THE COURT:<\/pre>\n<p>          This civil second appeal under Section 100 of the Code<\/p>\n<p>    of Civil Procedure has been preferred against the judgment<\/p>\n<p>    and decree dated 19.01.1995 passed by the Civil Judge<\/p>\n<p>    (Senior Division), Mount Abu camp Abu Road affirming the<\/p>\n<p>    judgment and decree dated 11.12.1989 as passed by the Civil<\/p>\n<p>    Judge (Junior Division), Abu Road in Civil Suit No. 99\/1976.<\/p>\n<p>          By the judgment and decree dated 11.12.1989, the<\/p>\n<p>    learned Trial Court decreed the suit for eviction and recovery<\/p>\n<p>    of arrears of rent in favour of the plaintiff-respondent on the<\/p>\n<p>    ground of default in payment of rent by the defendants-tenants<\/p>\n<p>    and on the ground of reasonable and bona fide requirement of<\/p>\n<p>    the plaintiff. The appeal preferred by the defendants against<\/p>\n<p>    the judgment and decree so passed by the learned Trial Court<\/p>\n<p>    came to be dismissed by the learned Appellate Court by its<\/p>\n<p>    judgment and decree dated 19.01.1995.\n<\/p>\n<p><span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>      This second appeal was admitted for consideration on<\/p>\n<p>07.04.1995 by this Court while formulating the following<\/p>\n<p>substantial questions of law for determination in the case :-<\/p>\n<blockquote><p>      &#8220;1.  Whether the owner of a building can<br \/>\n      became a landlord when his predecessor-in-title<br \/>\n      was never a landlord ?\n<\/p><\/blockquote>\n<blockquote><p>      2.    Whether the plaintiff who filed a suit for<br \/>\n      residential and commercial accommodation can<br \/>\n      maintain this ground of bonafide necessity when<br \/>\n      he has acquired the possession of the shop and<br \/>\n      house and parted the same?&#8221;<\/p><\/blockquote>\n<p>      It has been submitted in this appeal on behalf of the<\/p>\n<p>defendants-appellants that when the plaintiff claimed having<\/p>\n<p>derived title from Mohini Devi and there has not been any<\/p>\n<p>proof on record that Mohini Devi ever became the landlord,<\/p>\n<p>the learned subordinate Courts have erred in assuming that<\/p>\n<p>there existed relationship of landlord and tenant between the<\/p>\n<p>plaintiff and the defendants. In has further been submitted<\/p>\n<p>that the finding on reasonable and bona fide requirement<\/p>\n<p>remains perverse and the fact of the plaintiff having other<\/p>\n<p>accommodation has not been appreciated.\n<\/p>\n<p>      The learned counsel for the respondent has raised the<\/p>\n<p>objection that no substantial question of law is involved in this<\/p>\n<p>case. The learned counsel submits that as a matter of fact,<\/p>\n<p>the impugned decree       had already been executed before<\/p>\n<p>passing of the    interim order in this appeal; and the suit<\/p>\n<p>premises were delivered in the possession of the plaintiff who<\/p>\n<p>continues to occupy the same. The learned counsel contends<br \/>\n<span class=\"hidden_text\">                                 3<\/span><\/p>\n<p>that the question relating to the relationship of landlord and<\/p>\n<p>tenant does not even arise in this matter where the defendants<\/p>\n<p>themselves alleged having tendered        rent to the plaintiff-<\/p>\n<p>respondent.     The learned counsel further submits that the<\/p>\n<p>defendants having failed to comply with the requirements of<\/p>\n<p>the order making provisional determination of rent, their<\/p>\n<p>defence against eviction was struck off and the learned<\/p>\n<p>subordinate Courts have specifically found the defendants to<\/p>\n<p>be the defaulters in payment of rent. Hence, according to the<\/p>\n<p>learned counsel, the decree for eviction          deserves to be<\/p>\n<p>maintained on this count itself.     The learned counsel yet<\/p>\n<p>further submits that nothing of parting with any part of the<\/p>\n<p>premises has been proved on record.\n<\/p>\n<p>      Having examined the record of the case with reference<\/p>\n<p>to the law applicable, this Court finds force in the submissions<\/p>\n<p>made on behalf of the respondent.\n<\/p>\n<p>         The defence against eviction was struck off in this<\/p>\n<p>matter    and   thereafter,   the   subordinate    Courts   have<\/p>\n<p>concurrently found the defendants to be the defaulters in<\/p>\n<p>payment of rent. The finding remains essentially a finding of<\/p>\n<p>fact and does not appear suffering from any perversity. Once<\/p>\n<p>this finding becomes final and for the defendants being not<\/p>\n<p>entitled to the protection of Section 13 (6) of the Act, the<\/p>\n<p>decree for eviction follows as a necessary consequence. No<\/p>\n<p>substantial question has been formulated on questions relating<\/p>\n<p>to default and striking out of defence nor appears arising<br \/>\n<span class=\"hidden_text\">                                             4<\/span><\/p>\n<p>            either.   In this views of the matter, the submission on the<\/p>\n<p>            question of reasonable and bona fide requirement appear<\/p>\n<p>            rather redundant. Even in relation to reasonable and bona fide<\/p>\n<p>            requirement, the learned subordinate Courts have examined<\/p>\n<p>            the record and have recorded the findings in accordance with<\/p>\n<p>            law which do not call for interference being essentially the<\/p>\n<p>            findings on facts.\n<\/p>\n<p>                  So far the feeble attempt as made on behalf of the<\/p>\n<p>            defendants in questioning the status of the plaintiff as landlord<\/p>\n<p>            is concerned, suffice is to point out that according to the<\/p>\n<p>            defendants themselves, they did tender rent to the plaintiff.<\/p>\n<p>            This is coupled with the fact that the plaintiff is said to have<\/p>\n<p>            derived title from one Mohini Devi who in turn derived title<\/p>\n<p>            from Bhoormal-Ram Prasad who was admittedly the owner of<\/p>\n<p>            the property and who inducted the defendants as tenants.<\/p>\n<p>                  In a comprehensive view of the matter, this Court has no<\/p>\n<p>            hesitation in coming to the conclusion that there existed the<\/p>\n<p>            relationship of landlord and tenant between the parties to the<\/p>\n<p>            suit. In view of the above, there appears no reason or basis to<\/p>\n<p>            consider any interference in the findings of the subordinate<\/p>\n<p>            Courts.\n<\/p>\n<p>                  Accordingly,    the   appeal    fails   and   is,   therefore,<\/p>\n<p>            dismissed.
