MERATHIA\n                              --------\n          For the Petitioner  : Miss Niyati Sah, Advocates\n          For the Respondents : Mr. Ayush Aditya, Advocate\n                              --------\n\n3\/24\/2\/2010<\/pre>\n<p>             Miss Niyati Sah, appearing for the petitioner, submitted<br \/>\n          that on 22.6.2009, the prayer for amendment made by the petitioner<br \/>\n          was allowed but for non payment of the cost and for non<br \/>\n          incooperation of the amendment, petitioner was debarred from<br \/>\n          incorporating the amendment and his evidence was closed on<br \/>\n          7.7.2009. Thereafter the cost was deposited and prayer was made<br \/>\n          for recall of the order dated 7.7.2009, which has also been rejected. It<br \/>\n          is further submitted that petitioner undertakes that he shall not<br \/>\n          adduce more than two witnesses including himself within four weeks.\n<\/p>\n<p>                      Mr. Ayush Aditya, appearing for the respondents, supported<br \/>\n          the impugned orders to the extent they have been challenged by the<br \/>\n          petitioner in this writ petition.\n<\/p>\n<p>                        I am satisfied that in the interest of justice, petitioner can<br \/>\n          be given one chance.\n<\/p>\n<p>                        Accordingly, the order dated 7.7.2009       and part of the<br \/>\n          order dated 30.10.2009 are set aside. Petitioner is permitted to<br \/>\n          incorporate the amendment by the next date fixed or within two<br \/>\n          weeks, whichever is earlier. This order is subject to payment of cost<br \/>\n          of Rs.1000\/- ( one thousand only) to be deposited in the court below<br \/>\n          within two weeks.\n<\/p>\n<p>                        Petitioner must conclude his evidence within four weeks<br \/>\n          from today. The parties will cooperate in early disposal of the suit,<br \/>\n          which should be disposed of as early as possible and preferably<br \/>\n          within three months from the date of receipt\/production of a copy of<br \/>\n          this order.\n<\/p>\n<p>                        With these observations and directions, this writ petition<br \/>\n          is disposed of.\n<\/p>\n<p>                                                       ( R.K.
