Venkataswami, J.\n<\/p>\n<p>     The respondent as a landlord of the suit premises filed<br \/>\nCase No.  70\/2 of  1987 before\tthe Rent  Controller,  Solan<br \/>\n(H.P.) for  eviction of\t the appellant.\t   The\tgrounds\t for<br \/>\neviction were (a) the appellant defaulted in payment of rent<br \/>\nfrom 1.1.87  up to  the\t date  of  filing  of  the  eviction<br \/>\npetition and  (b) that\tthe  suit  premises  was  bona\tfide<br \/>\nrequired by  him for  the purpose  of  building\/re-building,<br \/>\nwhich cannot  be carried  out  without\tthe  premises  being<br \/>\nvacated.  We may at once state that the ground of default in<br \/>\npayment of  rent was  found against the landlord by the Rent<br \/>\nController and\tthe same  was not  pursued by  the  landlord<br \/>\nbefore the  Appellant Authority and the High Court.  We are,<br \/>\ntherefore, concerned  only with\t the  ground  of  bona\tfide<br \/>\nrequirement of\tthe premises for building\/re-building by the<br \/>\nlandlord.  This ground is covered by Section 14(3)(c) of the<br \/>\nHimachal Pradesh  Urban Rent  Control Act, 1987 (hereinafter<br \/>\ncalled the &#8216;Act&#8217;).\n<\/p>\n<p>     The Rent  Controller on  the basis of evidence oral and<br \/>\ndocumentary and placing reliance on a judgment of this Court<br \/>\nin Metalware  And Co.  Ltd. etc.  Vs. Bansilal Sarma And Co.<br \/>\netc. &#8211;\t(1979) 3  SCC 398,  found that there was no evidence<br \/>\nregarding the  condition of the building and consequent bona<br \/>\nfide  requirement   of\t the   same   for   demolition\t and<br \/>\nreconstruction and  that factor\t being a  vital one  for the<br \/>\npurpose of  granting an\t order for  eviction  dismissed\t the<br \/>\npetition.\n<\/p>\n<p>     The respondent-landlord  aggrieved by  the dismissal of<br \/>\nthe eviction  petition preferred  C.M.A. No.20-8\/4  of\t1990<br \/>\nbefore\tthe  Appellate\tAuthority,  Solan.    The  Appellate<br \/>\nAuthority on  an analysis of Section 14(3)(c) of the Act and<br \/>\nin view\t of the\t fact  that  the  appellant-tenant  had\t not<br \/>\ndisputed the availability of the resources with the landlord<br \/>\nand compliance\tof other  requirements except  regarding the<br \/>\ndilapidated condition  of the  building, found that the Rent<br \/>\nController  was\t  not  right   in  dismissing  the  eviction<br \/>\npetition.   According to the Appellate Authority, the ruling<br \/>\nof this\t Court in Metalware &amp; Co. case rendered interpreting<br \/>\nSection 14(1)(b)  of the Tamil Nadu Rent Control Act may not<br \/>\napply to the relevant provision in the Himachal Pradesh Act,<br \/>\nwhich did  not contemplate  the condition of the building as<br \/>\none of\tthe relevant  factors for  the purpose\tof  ordering<br \/>\neviction on  the facts of the case.  The appellate Authority<br \/>\nalso found  that what  was let\tout to\tthe tenant was not a<br \/>\n&#8216;building&#8217; as  defined in  Section 2(b)\t of the\t act, but an<br \/>\nopen plot  measuring 100  x 95\twith a\tshed thereon.\t The<br \/>\nAppellate Authority  found that\t Section 14(3)(c) of the Act<br \/>\napplies to  the tenanted  land as well and, therefore, it is<br \/>\nall the\t more reason  that the Rent Controller was not right<br \/>\nin applying  the decision  of this  Court in Metalware &amp; Co.<br \/>\ncase. On  the basis  of the above conclusions, the Appellate<br \/>\nAuthority by  reversing the  decision of the Rent Controller<br \/>\nallowed the application for eviction.\n<\/p>\n<p>     The appellant  aggrieved by  the order of the Appellate<br \/>\nAuthority preferred a Revision to the High Court of Himachal<br \/>\nPradesh at  Shimla.   The learned  Judge confirmed  the view<br \/>\ntaken by the Appellate Authority and dismissed the Revision.<br \/>\nHence, the present appeal by special leave.\n<\/p>\n<p>     Mr. Sree  Kumar,  learned\tcounsel\t appearing  for\t the<br \/>\nappellant-tenant, reitereated  that the ruling of this Court<br \/>\nin Metalware  &amp; Co.  case. which  has been  considered in  a<br \/>\nrecent Constitution  Bench judgment  of this  Court in Vijay<br \/>\nSingh &amp;\t Ors. Vs.  Vijayalakshmi Ammal\t&#8211; (1996)  6 SCC 475,<br \/>\nsquarely applies  to the  facts of this case and, therefore,<br \/>\nthe Appellate Authority and the High Court were not right in<br \/>\ncoming to  the conclusion  that the  ruling of this Court in<br \/>\nMetalware &amp;  Co. case  will not\t apply to  the facts of this<br \/>\ncase.\n<\/p>\n<p>     Mr. Salman\t Khursheed, learned  senior counsel  for the<br \/>\nrespondent, submitted that the Appellate Authority was right<br \/>\nin holding  that on  the basis\tof the\tlanguage employed in<br \/>\nSection\t 14(3)(c)  of  the  Act\t there\tis  no\twarrant\t for<br \/>\ncontending that\t the condition of the building was since qua<br \/>\nnon for ordering eviction of the tenant from the building.\n<\/p>\n<p>     It is  obvious from  the rival submissions that we have<br \/>\nto  set\t  out  Section\titself\tbefore\tproceeding  further.<br \/>\nSection 14(3)(c) of the Act reads as follows:\n<\/p>\n<blockquote><p>     &#8220;14(3) &#8211;  A landlord  may apply  to<br \/>\n     the   Controller\tfor   an   order<br \/>\n     directing the  tenant  to\tput  the<br \/>\n     landlord in possession:-<br \/>\n     &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;..<br \/>\n     &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;\n<\/p><\/blockquote>\n<blockquote><p>     (c) in  the case of any building or<br \/>\n     rented land,  if he  requires it to<br \/>\n     carry out\tany building work at the<br \/>\n     instance of the Government or local<br \/>\n     authority or  any Improvement Trust<br \/>\n     under    some     improvement    or<br \/>\n     development scheme\t or  if\t it  has<br \/>\n     become unsafe  or unfit  for  human<br \/>\n     habitation or  is required bonafide<br \/>\n     by him  for  carrying  out\t repairs<br \/>\n     which cannot be carried out without<br \/>\n     the building  or rented  land being<br \/>\n     vacated or\t that  the  building  or<br \/>\n     rented land is required bonafide by<br \/>\n     him for  the purpose of building or<br \/>\n     re-building or  making thereto  any<br \/>\n     substantial      additions\t      or<br \/>\n     alterations and  that such building<br \/>\n     or\t re-building   or  addition   or<br \/>\n     alteration cannot\tbe  carried  out<br \/>\n     without the building or rented land<br \/>\n     being vacated.<\/p><\/blockquote>\n<p>     A careful\treading of  the above Section will show that<br \/>\nthe    Section\t   contemplates\t   different\t independent<br \/>\nsituations\/circumstances enabling  the landlord to apply for<br \/>\neviction of  a tenant.\t  Those\t different  and\t independent<br \/>\nsituations\/circumstances can be set out as follows:-\n<\/p>\n<blockquote><p>     &#8220;(1) When the tenanted premises are<br \/>\n     required by  the landlord\tto carry<br \/>\n     out  any\tbuilding  work\t at  the<br \/>\n     instance of the Government or local<br \/>\n     authority or  any Improvement Trust<br \/>\n     under    some     improvement    or<br \/>\n     development scheme; or\n<\/p><\/blockquote>\n<blockquote><p>     (ii)  When\t the  tenanted\tpremises<br \/>\n     have become  unsafe  or  unfit  for<br \/>\n     human habitation; or\n<\/p><\/blockquote>\n<blockquote><p>     (iii) When\t the  tenanted\tpremises<br \/>\n     are  required   bona  fide\t by  the<br \/>\n     landlord\t       for  carrying out<br \/>\n     repairs which cannot be carried out<br \/>\n     without  such   tenanted\tpremises<br \/>\n     being vacated; or\n<\/p><\/blockquote>\n<blockquote><p>     (iv) When the tenanted premises are<br \/>\n     required bonafide\tby the\tlandlord<br \/>\n     for   purposes   of   building   or<br \/>\n     rebuilding or  making  thereto  any<br \/>\n     substantial      additions\t      or<br \/>\n     alterations and  that sch\tbuilding<br \/>\n     or\t rebuilding   or   addition   or<br \/>\n     alteration cannot\tbe  carried  out<br \/>\n     without the building or rented land<br \/>\n     being vacated.&#8221;<\/p><\/blockquote>\n<p>     From the  above analysis,\tit will\t be  seen  that\t the<br \/>\ncondition of  the building is required to be considered when<br \/>\nthe application\t falls under  the above\t mentioned  Category\n<\/p>\n<p>(ii).\tAdmittedly, the\t application  for  eviction  in\t the<br \/>\npresent case  falls under  Category (iv)  and  there  is  no<br \/>\nrequirement in\tsuch cases  to go  into the condition of the<br \/>\nbuilding. It  is true  that this  Court has  held  that\t the<br \/>\nrequirement of\tthe condition  of the  building is  a  vital<br \/>\nfactor whether\tsuch requirement  is specifically  stated in<br \/>\nthe Section or not   It must be remembered that the decision<br \/>\nof  this  Court\t was  rendered\twhile  interpreting  Section<br \/>\n14(1)(b) of  the Tamil Nadu Act which is not in pari materia<br \/>\nwith the Himachal Pradesh Act.\tIn other words, there are no<br \/>\ndifferent categories  as set out above in the Tamil Nadu Act<br \/>\nas in Himachal Pradesh Act.\n<\/p>\n<p>     In addition  to the  above, as  found by  the Appellate<br \/>\nAuthority, the lease was with reference to land with a shed.<br \/>\nAs a  matter of\t fact, the  appellant-tenant as\t RW-1 in his<br \/>\nchief examination has stated as follows:-\n<\/p>\n<blockquote><p>     &#8220;The land\tin dispute  was taken by<br \/>\n     me on rent in 1973.  This place was<br \/>\n     100&#8242; X  95&#8242;.   The rent  amount was<br \/>\n     Rs. 250\/-\tper month.   This  place<br \/>\n     was given to me for workshop.&#8221;<\/p><\/blockquote>\n<p>     As noted  above, Section  14(3)(C) applies\t to tenanted<br \/>\nland as\t well and the tenant has not questioned the capacity<br \/>\nof the\tlandlord to raise the construction or the bona fides<br \/>\nof the landlord to do so.\n<\/p>\n<p>     In the  result, we\t do not find any ground to interfere<br \/>\nwith the  confirming order  of the  High Court.\t  The appeal<br \/>\nfails and is dismissed with no order as to costs.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Prem Chand Alias Prem Nath vs Smt.
