S.J. MUKHOPADHAYA)<\/p>\n<p>\t\tThe<br \/>\npetitioner Trust is running a Nursing School known as Sahajanand<br \/>\nSchool of Nursing imparting education of Nursing, Midwives and Health<br \/>\nvisitors under The Gujarat Nurses, Mid-wives and Health Visitors&#8217;<br \/>\nAct, 1968. The Institution is recognised by Gujarat Nursing Council<br \/>\nand was admitting students for imparting education. Gujarat Nursing<br \/>\nCouncil, while giving reference letter dated 24th November, 2009<br \/>\nissued by Indian Nursing Council, New Delhi informed the petitioner<br \/>\nTrust that students should not be admitted without approval of the<br \/>\nIndian Nursing Council.\n<\/p>\n<p>2.\t\tThe<br \/>\npetition was preferred on the ground that when there is approval from<br \/>\nGujarat Nursing Council, further approval of Indian Nursing Council<br \/>\nis not required.\n<\/p>\n<p>3.\t\tThe<br \/>\nrespondents, on appearance, while they referred to The Indian Nursing<br \/>\nCouncil Act, 1947 submitted that approval of Indian Nursing Council<br \/>\nis not required if the Institution is approved by the State Nursing<br \/>\nCouncil. Learned counsel for the State and Indian Nursing Council<br \/>\nboth referred to Sections 13 and 14 of the Indian Nursing Council<br \/>\nAct, 1947. Under Section 13 of the Act, the Executive Committee of<br \/>\nthe Indian Nursing Council may appoint Inspectors from amongst<br \/>\nmembers of the Council to inspect any institution recognised as a<br \/>\ntraining institution and to attend examinations held for the purpose<br \/>\nof granting any recognised qualification or recognised higher<br \/>\nqualification. Said Inspector is supposed to report to the Executive<br \/>\nCommittee of the Indian National Council. Upon such report, if Indian<br \/>\nNursing Council finds that the  institution recognised by a State<br \/>\nCouncil for the training of nurses, midwives, auxiliary<br \/>\nnurse-midwives) or health visitors, does not satisfy the requirements<br \/>\nof the Council, the Council may send to the Government or the State<br \/>\nin which the authority or institution is situated, a statement to<br \/>\nsuch effect and the State Government shall forward  it, alongwith<br \/>\nsuch remarks to the State Council with an intimation of the period<br \/>\nwithin which the authority or institution may submit its reply and<br \/>\nafter such procedure, recognition of the Institution can be withdrawn<br \/>\nunder Section 14 of the Act.\n<\/p>\n<p>4.\t\tLearned<br \/>\ncounsel for the Gujarat Nursing Council produced a copy of the letter<br \/>\ndated 24.11.2008 issued by Indian Nursing Council, New Delhi. From<br \/>\nthe said letter, it appears that the Inspectors Mrs. Chaya P Lad and<br \/>\nMr. J Amirson Jacob were appointed by Indian Nursing Council for<br \/>\ninspection of the petitioner school. When they arrived at the<br \/>\npetitioner&#8217;s school, on the date after intimation, they were refused<br \/>\nby the Management to inspect the school  and thus leading  to a<br \/>\nsituation where no inspection as planned  could be conducted. For the<br \/>\nsaid reason, the matter was referred to the State and the impugned<br \/>\norder dated 8.3.2010 was issued by Gujarat Nursing Council.\n<\/p>\n<p>5.\t\tFrom<br \/>\nthe aforesaid facts, it will be evident that the Institution<br \/>\npractically attracted the provisions of Section 14 of the Act for the<br \/>\npurpose of its de-recognition. However, as no final action has been<br \/>\ntaken to de-recognise the petitioner&#8217;s Institution under Section 14<br \/>\nof the Act after notice to the petitioner. We are not deliberating<br \/>\nsuch issue whether it should be de-recognised or not. The<br \/>\npetitioner&#8217;s Institution is given liberty to approach the Indian<br \/>\nNursing Council for inspection. If such representation is filed, the<br \/>\nIndian Nursing Council, New Delhi will send its Inspectors as may be<br \/>\nappointed under the Act, who, after intimation to the petitioner&#8217;s<br \/>\nInstitution, will send its inspection team within a month from the<br \/>\ndate of such request,  inspect the school and report the matter to<br \/>\nthe Indian Nursing Council. On such report, it will be open to the<br \/>\nIndian National Council, New Delhi to pass appropriate order. On<br \/>\ncompletion of such inspection and final decision that may be taken by<br \/>\nthe Indian Nursing Council and finally by the Gujarat Nursing<br \/>\nCouncil, the Institution will act accordingly. No admission be taken<br \/>\nin the meantime.
