As per clause 3 of Gazette Notification dated 16th<br \/>\n       September, 2005 published in Part-Il, Section 3, Sub-<br \/>\n       section (I) of the Gazette of India, the Ministry of<br \/>\n       Personnel, Public Grievances and&#8217; pensions<br \/>\n       (Department of Personnel &amp; Training), Govt. of India,<br \/>\n       the Appellant requested for the following Information<\/p>\n<p>       (A) A copy of relevant gazette notification! Circular    1(A) Appellant has       not received any<br \/>\n       notification \/ order etc issued by MCD or any other      information provided except that the ADC<br \/>\n       authority empowered under the RTI Act, 2005, in          (HQ5) simply provided a copy of Section<br \/>\n       suppression of the GOI gazette notification dated        100 of MCD Ad wherein it has been<br \/>\n       16\/9\/200 which prescribes that the postal order should   provided that the Commissioner shall<br \/>\n       be payable to &#8220;MCD&#8221; or &#8220;Commissioner MCD&#8221; not to         receive the payment, credit of payment etc.<br \/>\n       &#8216;Account Officer MCD&#8221; because I had made the postal<br \/>\n       order payable to &#8220;Account Officer, MCD&#8221; as<br \/>\n       prescribed under the rules issued vide gazette<br \/>\n       notification mentioned above but my application was<br \/>\n       returned for the reasons stated above<\/p>\n<p><span class=\"hidden_text\">                                                                                             Page 1 of 4<\/span><br \/>\n      (B) The name, designation and address of the officials    I (B) The name of the official is Sh. RWA has not been<br \/>\n    consulted before finalizing&#8217; this scheme. Now the          No Information was provided by the PIO<br \/>\n    representatives of private agency are approaching &#8216;the<br \/>\n    RWAs to, take over the possession of functional and<br \/>\n    non functional Dhalaos (Bins) without producing any<br \/>\n    authorization. The copies of letters<br \/>\n    dated 20th July, 2009 were also sent to Dy.\n<\/p>\n<p>    Commissioner,&#8217; Najafgarh Zone as the area fell under<br \/>\n    his jurisdiction. These letters were not even<br \/>\n    acknowledged and no action was taken on any of the<br \/>\n    letters except changing sewer man- holes. (A<br \/>\n    photocopy each of the letters stated above is enclosed<br \/>\n    Annex. H, HI &amp; IV).\n<\/p>\n<p><span class=\"hidden_text\">                                                                                              Page 2 of 4<\/span><\/p>\n<p> 7.    Appellant requested for the daily progress report on<br \/>\n      these letters. Also inform the names, designations and<br \/>\n      addresses of the officers to whom these letters were<br \/>\n      forwarded. In this regard Appellant<br \/>\n      requested for a copy of order denotifying the area and<br \/>\n      information on &#8216;all the points in the application<br \/>\n      enclosed except Points 4 to 8.\n<\/p>\n<p>10    A Postal order no.84E129183 dated 11.09.2009 for Rs.       No Information sought<br \/>\n      10\/- payable to Commissioner, MCD as advised by<br \/>\n      some officials of MCD is enclosed herewith.<br \/>\n11    I hereby declare that I am a Indian citizen and entitled   No Information sought<br \/>\n      to seek information under RTI Act, 2005.\n<\/p>\n<p>Grounds for the First Appeal:\n<\/p>\n<p>Information provided by the PIO (MCD) is incomplete and dissatisfactory.<br \/>\nNo Information provided by the PIO (DDA)<\/p>\n<p>Order of the First Appellate Authority (FAA):<br \/>\nThe Appeal filed by the Appellant is time barred according to the provisions of the RTI Act and no further<br \/>\njustification of delay is given by the Appellant.<br \/>\nAnd the Appellant must file the appeals before the relevant FAA for each of the said replies of the PIO&#8217;s<\/p>\n<p>Grounds for the Second Appeal:\n<\/p>\n<p>Incomplete and incorrect reply form the PIO and the FAA without checking or calculating the time period<br \/>\nhas stated in the order that the appeal is time barred.\n<\/p>\n<p>Relevant Facts emerging during Hearing:\n<\/p>\n<p>The following were present:\n<\/p>\n<p>Appellant: Absent;\n<\/p>\n<p>Respondent: Mr. K. C. Mittal, UDC on behalf of Mr. Rajesh Prakash, PIO &amp; ADC(HQ);\n<\/p>\n<p>        The Commission directs that the following information must be provided to the Appellant by the<br \/>\nrespective PIOs:\n<\/p>\n<blockquote><p>    1-     Query-3: Copy of the &#8216;PPP System&#8217; agreement should be provided by the PIO, South Zone,<br \/>\n           Greent Park, New Delhi.\n<\/p><\/blockquote>\n<blockquote><p>    2-     Query-5: Information should be provided by PIO, South Zone, Green Park, New Delhi.\n<\/p><\/blockquote>\n<p>The Commission also directs the Municipal Commissioner to ensure that all PPP Agreements for<br \/>\ncollection of garbage must be displayed on the website of MCD before 20 December 2010. A compliance<br \/>\nreport should be sent to the Commission before 20 December 2010.\n<\/p>\n<p><span class=\"hidden_text\">                                                                                         Page 3 of 4<\/span><\/p>\n<p> Decision:\n<\/p>\n<p>The Appeal is allowed.\n<\/p>\n<p>      PIO South Zone (Green Park) is directed to give the information on two points<br \/>\nmentioned above to the appellant before 20 December 2010.\n<\/p>\n<p>The Municipal Commissioner is directed to email the report along with the url address<br \/>\nwhere the information has been uploaded to rtimonitoring@gmail.com. The Report must<br \/>\ninclude:\n<\/p>\n<p>1.    Measures taken to fulfill disclosure obligations under Section 4 including making<br \/>\n      information available on your official website.\n<\/p>\n<p>2.
