SHAH\n\t\t\n\t\n\n \n\nDate\n: 16\/03\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\t\tBy<br \/>\nway of this petition under Articles 226 and 227 of the Constitution<br \/>\nof India,  the petitioner has challenged the impugned order dated<br \/>\n13\/12\/2010 passed by Revisional Authority in Revision Application<br \/>\nNo.11\/2010, by which, Revisional Authority has rejected the stay<br \/>\napplication submitted by the petitioner.\n<\/p>\n<p>2.\t\tIn<br \/>\nview of the fact that main Revision Application is pending before<br \/>\nlearned Revisional Authority, which is yet to be decided and disposed<br \/>\nby the Revisional Authority and any observation by this Court in the<br \/>\npresent proceedings may affect the case of either parties in the main<br \/>\nRevision Application, Mr.Majmudar, learned advocate appearing on<br \/>\nbehalf of the petitioner does not press the present petition.<br \/>\nHowever, he has requested to issue suitable direction, directing the<br \/>\nRevisional Authority to decide and dispose of the main Revision<br \/>\nApplication at the earliest.\n<\/p>\n<p>3.\t\tIn<br \/>\nview of the above, the present petition is dismissed as not pressed.<br \/>\nHowever, it will be open for the petitioner to prefer appropriate<br \/>\napplication before Revisional Authority for expeditious hearing of<br \/>\nthe main Revision Application, which may be considered by the<br \/>\nRevisional Authority looking to urgency shown by the petitioner and<br \/>\nif Revisional Authority satisfied with respect to urgency shown by<br \/>\nthe petitioner and looking to its own board and looking to the old<br \/>\npending matters. It goes without saying that Revisional Authority &#8211;<br \/>\nSecretary (Appeals), Revenue Department, State of Gujarat shall<br \/>\nfinally decide and dispose of the main Revision Application<br \/>\nNo.11\/2010 in accordance with law and on merits,  <\/p>\n<p>without<br \/>\nin any way being influenced by the impugned order and\/or earlier<br \/>\norder refusing to grant interim relief and any observations made by<br \/>\nthe Revisional Authority be treated as tentative while deciding the<br \/>\nstay application only.\n<\/p>\n<p>\t\tWith<br \/>\nthis, the present petition is dismissed.
