RAMACHANDRA MENON, J.\n             ..............................................................................\n                       W.P.(C) No. 9258 OF 2010\n              .........................................................................\n                        Dated this the 6th April , 2010\n\n\n\n                                   J U D G M E N T\n<\/pre>\n<p>        The petitiioner has approached this Court                                          seeking to<\/p>\n<p>quash Exts. P2 and P3 recovery proceedings stating that the<\/p>\n<p>steps are still to be finalised as directed vide Ext. P5 judgment.<\/p>\n<p>It is stated that           the grievance of the petitioner will stand<\/p>\n<p>redressed, once necessary clarifications are given by the<\/p>\n<p>Commissioner of Commercial taxes or suh other appropriate<\/p>\n<p>authorities, before whom the matter is pending.<\/p>\n<p>     2.   Heard the learned Government Pleader as well, who<\/p>\n<p>asserts   with reference to the statement filed, that the factual<\/p>\n<p>averments raised from the part of the petitioner are not correct<\/p>\n<p>or sustainable .\n<\/p>\n<p>     3. However, on going through the records, this Court finds<\/p>\n<p>that already a direction has been issued vide Ext.P5 judgment,<\/p>\n<p>directing  the      third         respondent                therein           (Commissioner        of<\/p>\n<p>W.P.(C) No. 9258 OF 2010<\/p>\n<p><span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>Commercial Taxes\/first respondent herein) to pass appropriate<\/p>\n<p>orders on Ext.P8 petition filed therein seeking for clarification,<\/p>\n<p>within a specified time and till such proceedings were finalised,<\/p>\n<p>the steps for recovery were ordered to be stayed for a period of<\/p>\n<p>two months.      There is no case for the respondents that the<\/p>\n<p>concerned respondent has complied with the direction given by<\/p>\n<p>this Court vide Ext. P5 judgment, giving necessay clarifications.<\/p>\n<p>      4.    The case now projected     from the part of the third<\/p>\n<p>respondent is that (as revealed from para 12 of the statement),<\/p>\n<p>filing a petition under Section 94 of the KVAT Act will not in any<\/p>\n<p>way help the petitioner. This Court does not propose to go into<\/p>\n<p>the merits or demerits, as to the factual position involved. Taking<\/p>\n<p>note of the mandate given by this Court vide Ext.P5, the first<\/p>\n<p>respondent shall cause the matter to be finalised giving effect<\/p>\n<p>to the verdict as expeditiously as possible, at any rate within<\/p>\n<p>&#8216;six&#8217; weeks from the date of receipt of a copy of the judgment,<\/p>\n<p>after giving an opportunity of hearing to the petitioner. The<\/p>\n<p>second respondent is directed to consider and finalise the<\/p>\n<p>appeal, the I.A. preferred for stay and also the I.A, to condone<\/p>\n<p>W.P.(C) No. 9258 OF 2010<\/p>\n<p><span class=\"hidden_text\">                                  3<\/span><\/p>\n<p>the delay, if any, in accordance with law and also with reference<\/p>\n<p>to the order to be passed by the Commissioner or such other<\/p>\n<p>authority before whom, the petition for clarification is pending.<\/p>\n<p>The proceedings as above shall be finalised within one month<\/p>\n<p>from the date of       finalisation of the proceedings    by the<\/p>\n<p>Commissioner giving necessary clarification. All coercive steps<\/p>\n<p>stated as being    pursued shall be kept    in abeyance    in the<\/p>\n<p>meanwhile.\n<\/p>\n<p>     The Writ Petition is disposed of as above.\n<\/p>\n<\/p>\n<p>                                  P.R.
