Justice R.BASANT\n\n Dated :22\/08\/2007\n\n O R D E R\n                                 R.BASANT, J\n                          ------------------------------------\n                           B.A.No.5109 of 2007\n                         -------------------------------------\n                Dated this the 22nd day of August, 2007\n\n                                      ORDER\n<\/pre>\n<p>      Application for anticipatory bail.                    The petitioner     faces<\/p>\n<p>allegations, inter alia, under Section 3 of the Prevention of Damages to<\/p>\n<p>Public Property Act 1984 as also under Section 353 I.P.C. The crux of<\/p>\n<p>the allegations against the petitioner              is that he allegedly deterred<\/p>\n<p>sales tax official in the Vellachal Check post from performing his duty.<\/p>\n<p>He allegedly hit the barricade causing damage to the same and<\/p>\n<p>ignoring the request of the official to stop his vehicle he sped away<\/p>\n<p>after causing damage to the barricade.\n<\/p>\n<p>      2.    The learned counsel for the petitioner                 submits that the<\/p>\n<p>petitioner is absolutely innocent. The petitioner was not present in<\/p>\n<p>any vehicle which allegedly was involved in the incident.                       The<\/p>\n<p>petitioner &#8216;s vehicle was also not involved in the incident. In these<\/p>\n<p>circumstances, anticipatory bail may be granted to the petitioner, it is<\/p>\n<p>urged.\n<\/p>\n<p>      3.    The     application      is   opposed          by  the  learned   Public<\/p>\n<p>Prosecutor. The learned Public Prosecutor                  submits that there are no<\/p>\n<p>circumstances whatsoever to doubt or suspect the version of the<\/p>\n<p>defacto complainant. It is certainly for the petitioner to appear before<\/p>\n<p><span class=\"hidden_text\">B.A.No.5109 of 2007                  2<\/span><\/p>\n<p>the Investigating Officer     or the learned Magistrate and offer the<\/p>\n<p>necessary explanations.     At any rate, at the moment and with the<\/p>\n<p>available inputs, there is no reason to doubt or suspect the version of<\/p>\n<p>the complainant and there are no circumstances whatsoever to justify<\/p>\n<p>the invocation of the extraordinary equitable discretion under Section<\/p>\n<p>438 Cr.P.C. This petition may, in these circumstances, be dismissed,<\/p>\n<p>submits the learned Public Prosecutor .\n<\/p>\n<p>      4.    I have considered all the relevant inputs. I find merit in the<\/p>\n<p>opposition by the learned Public Prosecutor . I am not persuaded to<\/p>\n<p>agree that there are any features in this case which would justify the<\/p>\n<p>invocation of the extraordinary equitable discretion under Section 438<\/p>\n<p>Cr.P.C.\n<\/p>\n<p>      5.
