DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 21\/07\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\t\tThis<br \/>\napplication under Section 438 of the Code of Criminal Procedure (for<br \/>\nshort &#8220;the Code&#8221;) is preferred by the applicant-husband<br \/>\nagainst whom offences under Sections 304(B), 498(A), 504, 506(2) and<br \/>\n134 of Indian Penal Code have been registered with Veraval City<br \/>\nPolice Station on 14.1.2011.\n<\/p>\n<p>2.\t\tAs<br \/>\nper allegations levelled in the complaint, daughter of the first<br \/>\ninformant named Savita committed suicide as she was being harassed by<br \/>\nher husband and in-laws. In the complaint, in detail number of<br \/>\ninstances have been given about physical and mental cruelty inflicted<br \/>\nupon her by in-laws and as a result Savita had committed suicide.\n<\/p>\n<p>3.\t\tShri<br \/>\nTolia, learned counsel appearing for the applicant would submit that<br \/>\nallegations levelled in the FIR are false and baseless and have been<br \/>\nlevelled to see that the applicant, a government servant serving with<br \/>\nIncome Tax Department is punished for no fault of him, though he had<br \/>\ndischarged all his marital duties to the best of his abilities. It is<br \/>\nfurther submitted that so far as investigation carried by the<br \/>\nInvestigating Officer, no material surfaces on record which would<br \/>\neven reveal the involvement of the applicant prima facie in the crime<br \/>\nand so called telephonic conversation between the applicant and<br \/>\ncomplainant have no relevance at all. The applicant is Income Tax<br \/>\nInspector and is not likely to flee from courts of justice. By<br \/>\nimposing suitable conditions, he may be granted anticipatory bail,<br \/>\nparticularly, when other co-accused have been granted anticipatory<br \/>\nbail by the coordinate Bench of this Court by making certain prima<br \/>\nfacie observations.\n<\/p>\n<p>4.\t\tLearned<br \/>\nAPP as well as learned advocate for the complainant have vehemently<br \/>\nopposed grant of anticipatory bail to the applicant-accused on the<br \/>\nground that the complaint not only discloses the ingredients of the<br \/>\noffences but at the same time continuous and persistent physical and<br \/>\nmental torture inflicted upon the deceased wife which ultimately<br \/>\nresulted into registration of offences under Section 304(B), 498(A)<br \/>\nof Indian Penal Code and the applicant who is serving in Income Tax<br \/>\nDepartment is influential person and there are possibilities of his<br \/>\ntampering with the witnesses and evidence and, therefore, he may not<br \/>\nbe granted anticipatory bail.\n<\/p>\n<p>5.\t\tConsidering<br \/>\nthe over all facts and circumstances, nature of crime, punishment<br \/>\nprescribed and prima facie it cannot be said that the offences<br \/>\nregistered against the applicant are based on baseless or vague<br \/>\nallegations and on the contrary reading of  the complaint as a whole<br \/>\nwould reveal that the deceased was subjected to mental and physical<br \/>\ntorture from day one of her marriage with the applicant and from time<br \/>\nand again, such ill treatment to the victim continued and, therefore,<br \/>\nI am also of the opinion and in agreement with submissions of learned<br \/>\ncounsel for the complainant and learned APP that grant of<br \/>\nanticipatory bail would amount likelihood of tampering with<br \/>\ninvestigation and possibility may not be ruled out of influencing the<br \/>\nwitnesses or the record, since an attempt in the past is made of<br \/>\nmaking representation to  the authority to come out of the<br \/>\nallegations in the FIR and a kind of defence is already created.\n<\/p>\n<p>6.\t\tIn<br \/>\nview of the above, this application is rejected.\n<\/p>\n<p>\t\t\t\t\t\t\t(<br \/>\nAnant S Dave, J )<\/p>\n<p>srilatha<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Ashwanikumar vs State on 21 July, 2011 Author: Anant S.
