It is submitted that the said<br \/>\naffidavit was filed to oppose the civil application for condonation<br \/>\nof delay filed by the State Government and it was the case of the<br \/>\nappellant that during the intervening period of six years, the<br \/>\nappellant had sold away the lands to other parties by registered sale<br \/>\ndeeds and those parties had also in turn sold the lands to other<br \/>\nparties and that residential units were also constructed on the lands<br \/>\nin question. It is submitted that all those facts in paragraph 10 to<br \/>\n17 have not been considered by the learned Single Judge. It is<br \/>\nsubmitted that the averments made in the aforesaid paragraphs of the<br \/>\naffidavit-in-reply were sufficient to contend that in view of the<br \/>\nrights and equities of third party having been created during the<br \/>\nperiod of six years, such gross delay  did not deserve to be<br \/>\ncondoned.\n<\/p>\n<p>2.\t\tIn<br \/>\nview of the above submissions, notice returnable on 28th<br \/>\nMarch 2006.\n<\/p>\n<p>\t\tTill<br \/>\nthe returnable date, all the parties shall maintain status-quo as on<br \/>\ntoday regarding the lands in question.\n<\/p>\n<p>\t\tIn<br \/>\nthe meantime, respondent Nos.1 and 2 shall submit a report pointing<br \/>\nout the situation at the site of all the lands in question being<br \/>\nlands in Survey Nos.345, 347\/1 and 267 with their corresponding final<br \/>\nplot numbers, if any.
