P5 &amp;<\/p>\n<p>P6 orders of assessment under the Kerala Building Tax Act<\/p>\n<p>(for short the Act) and the steps taken for recovery of<\/p>\n<p>the amounts due invoking the provisions of the Revenue<\/p>\n<p>Recovery Act.\n<\/p>\n<p>     2.   Petitioners in these cases are apartment owners<\/p>\n<p>of residential complexes.  By Ext. P2 in these cases, the<\/p>\n<p>2nd respondent assessing officer has imposed Building Tax<\/p>\n<p>taking each of the whole apartment complex as one unit and<\/p>\n<p>on that basis tax has been demanded on the petitioners.<\/p>\n<p>     3.   According to the petitioners, the owners of the<\/p>\n<p>individual apartments whose details are furnished in the<\/p>\n<p>writ petition had entered into individual agreements with<\/p>\n<p>the landlords purchasing undivided interest in the land<\/p>\n<p>where the building has been constructed for themselves. It<\/p>\n<p>is further stated that these individual owners, entered<\/p>\n<p>into  agreements  with  the  builder  concerned  and  made<\/p>\n<p>contributions on the basis of which the building has been<\/p>\n<p>WP(C)No.32651 &amp; 32652\/07\n<\/p>\n<p>                          &#8211; 2 &#8211;\n<\/p>\n<p>constructed.  According to the petitioner, the agreements<\/p>\n<p>also provide that the owners had agreed to pay the tax in<\/p>\n<p>terms of the provisions contained in the Act.     On this<\/p>\n<p>basis, petitioners contend that it is the individual<\/p>\n<p>owners of the apartments who are liable to be assessed for<\/p>\n<p>Building Tax and that too, taking each flat separately.<\/p>\n<p>    4. In identical cases, this Court had interfered with<\/p>\n<p>similar orders of assessment and directed denovo enquiry<\/p>\n<p>by the assessing officer with liberty to the builder or<\/p>\n<p>the Apartment Owners&#8217; Association to produce evidence in<\/p>\n<p>support of their case.   One such judgment is reported in<\/p>\n<p><a href=\"\/doc\/1162257\/\">Bava Sons Construction Private Limited v. State of Kerala<\/p>\n<p>&amp; Others<\/a> {2007 (2) KHC 409}.     Since the facts of these<\/p>\n<p>cases are identical with the facts of that case, I am<\/p>\n<p>satisfied that the petitioners in these cases are also<\/p>\n<p>entitled to similar reliefs.\n<\/p>\n<p>    5.   Accordingly,   Exts. P5,  P5(a),  P5(b)  and   P6<\/p>\n<p>orders of assessment and revenue recovery notices in these<\/p>\n<p>cases will stand quashed.    The 2nd respondent in these<\/p>\n<p>cases will issue notice to the petitioners and also to the<\/p>\n<p>individual apartment owners, whose names and other details<\/p>\n<p>have been furnished in these writ petitions.    Thereupon,<\/p>\n<p>WP(C)No.32651 &amp; 32652\/07\n<\/p>\n<p>                           &#8211; 3 &#8211;\n<\/p>\n<p>an enquiry will be conducted and it will be open to the<\/p>\n<p>petitioner or the individual owners of the apartments to<\/p>\n<p>adduce evidence to prove that they own undivided interest<\/p>\n<p>in  the  land  and  on the   basis of   their  agreements,<\/p>\n<p>utilising their contribution the respective apartment was<\/p>\n<p>constructed.    For  this  purpose,  petitioners and  the<\/p>\n<p>apartment owners will be permitted to make available<\/p>\n<p>whatever document they want and to adduce such evidence as<\/p>\n<p>they think necessary to prove their cases.   On the basis<\/p>\n<p>of the evidence so adduced the 2nd respondent will re-<\/p>\n<p>consider the whole matter and pass fresh orders.<\/p>\n<p>     6.
