SAGHIR AHAMD\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t  W I T H<br \/>\n\t      CIVIL APPEAL NOS. 167-68 OF 1985<br \/>\n\t\t\t O R D E R<br \/>\n     These appeals  by special leave arise from the judgment<br \/>\nof the Division Bench of the Kerala High Court, made on July<br \/>\n5, 1984\t in OP\tNo.3003\/80. In\tthe State  of  Kerala,\tHead<br \/>\nClerks\/Head  Accountants,   U.D.Cs.  and   L.D.Cs.   &#8211;\t the<br \/>\nministerial staff  consists of\tthree groups  of  employees,<br \/>\nnamely, those  allotted from  erstwhile composite  Province,\n<\/p>\n<p>(b) those  similarly allotted  from former Travancore-Cochin<br \/>\nState and  (c) those  recruited to  the State  Service on or<br \/>\nafter November\t1, 1956\t (Kerala recruits).  The  appellants<br \/>\nbelong to  the last category, vis., Kerala and recruits. For<br \/>\npromotion from one ladder to the higher echelons, i.e., from<br \/>\nLDCs to\t UDSs and  so on, the Government in G.O. (P) No.851,<br \/>\ndated June  16, 1980  issued in\t exercise of the power under<br \/>\nproviso to  Article 309\t of the Constitution, made the rules<br \/>\ncalled\tthe   Special  Rules  for  the\tcategories  of\tHead<br \/>\nClerk\/Head  Accountant,\t  Upper\t Division  Clerk  and  Lower<br \/>\nDivision  Clerk\t  of  the  Kerala  Land\t Revenue  Department<br \/>\nincluded in  the  Kerala  Ministerial  Subordinate  Service.<br \/>\nThese rules  came into force w.e.f. November 1, 1956. Rule 9<br \/>\nof the\tRules  prescribes  the\tspecial\t qualifications\t and<br \/>\nprovides  that\tfor  promotion\tto  the\t category  of  Upper<br \/>\nDivision Clerk,\t a Lower  Division Clerk  shall pass the (a)<br \/>\nRevenue Test  (Travancore, Cochin  or Madras)  provided that<br \/>\npassing this  test shall  be obligatory only from 14.1.1958;\n<\/p>\n<p>(b) Accounts  Test (Lower)  provided that  passing the\ttest<br \/>\nwill be\t obligatory only  from 1.1.64;\tand (c)\t Secretariat<br \/>\nManual Test  upto 20.2.1958 and District Officer Manual Test<br \/>\nthereafter. All\t the employees\tfrom all  three sources, who<br \/>\ndid not\t pass the test, challenged the validity of the above<br \/>\nrule. The  Division Bench  had struck  down the\t rule on the<br \/>\nground that since the rule issued on June 16, 1980 was given<br \/>\nretrospective effect  from November  1, 1956  and they\twere<br \/>\nasked to  pass the  test w.e.f.\t January 14, 1963, it was an<br \/>\nimpossible to  give effect to the prescription of Rules 4 to\n<\/p>\n<p>6. It  was also\t struck down  on the ground that fixation of<br \/>\nthe date,  i.e., January 14, 1963 is arbitrary being without<br \/>\nany nexus.  It is  not in  dispute that\t after the  rule was<br \/>\nstruck down,  new rules came to be made in compliance of the<br \/>\ndirection issued  by the Division Bench on June 12, 1985. On<br \/>\nits basis,  seniority list  was prepared and promotions were<br \/>\ngiven to  those found  in the order of seniority. The latter<br \/>\nrules are  not subject\tmatter of  any attack nor has anyone<br \/>\nquestioned the correctness thereof. The promotions have also<br \/>\nbecome\tfinal.\t Under\tthese  circumstances,  the  question<br \/>\narises: whether\t it is expedient at this distance of time to<br \/>\ngo into\t the correctness  of the judgment of the High Court?<br \/>\nAll the\t Madras Allottees  and\tTravancore-Cochin  allottees<br \/>\nhave now retired from service. Only Kerala recruits, perhaps<br \/>\nsome of them, recruited on or after November 1, 1956, may be<br \/>\nin service.\n<\/p>\n<p>     Shri E.M.S.  Anam, learned\t counsel for the appellants,<br \/>\ncontends that  the view\t expressed by  the High Court is not<br \/>\ncorrect in  law for  the reason\t that  in  Travancore-Cochin<br \/>\nState,\tthere\twas  a\trule  in  operation  obligating\t the<br \/>\nallottees of that State to pass the required test prescribed<br \/>\nthereunder. Equally,  the Madras  allottees were required to<br \/>\npass the  test under  the Madras  Rules for promotion to the<br \/>\nhigher cadre\/category  of posts.  Therefore, mere making the<br \/>\nrule on\t June 16,  1980 with effect from November 1, 1956 is<br \/>\nconsequential. It  is not  an impossibility  of\t performance<br \/>\nprovided the  Madras or Travancore-Cochin a Alllottees had a<br \/>\nwill to appear for and pass the examinations. The appellants<br \/>\nhaving passed the examinations are entitled to be considered<br \/>\nand promoted  to the  higher posts  in accordance  with\t the<br \/>\nrules as against those who either had appeared but failed or<br \/>\nthose who  did not  appear at  all. Both  of those  unequals<br \/>\ncannot be  treated on  par with\t equals for  the purpose  of<br \/>\nseniority and  promotion. Though the argument is attractive,<br \/>\nin substance,  we cannot  give any  relief to the appellants<br \/>\nfor two\t reasons, namely,  the subsequent  rules, as  stated<br \/>\nearlier, are  not the  subject matter of assailment of their<br \/>\nvalidity and  the seniority was prepared on the basis of the<br \/>\nnew rules  and promotions  were also given accordingly. They<br \/>\nbecame final and all of the Madras Allottees and Travancore-<br \/>\nCochin allottees  have since  retired  from  service;  hence<br \/>\nthere is  no need  to go  into the  question in that behalf.<br \/>\nQuestions relating  to promotion  of those from among Kerala<br \/>\nrecruitees who\thad attempted but failed or those who passed<br \/>\nthe test  may be the relevant to be gone into. But since the<br \/>\nnew rules  have already\t been made  and they  are not  being<br \/>\nchallenged, the\t special rules\thave lost  their  relevance.<br \/>\nUnder these  circumstances,  we\t decline  to  go  into\tthat<br \/>\nquestion.\n<\/p>\n<p>     The appeals are accordingly dismissed.
