BASANT, J.\n            -------------------------------------------------\n                    B.A.NO. 5631 OF 2007\n            -------------------------------------------------\n        Dated this the 19th day of September, 2007\n\n                               ORDER\n<\/pre>\n<p>      Application for anticipatory bail.          The petitioners are<\/p>\n<p>accused 16, 30, 28 and 29 respectively in a Sessions Case<\/p>\n<p>where they face indictment for offences punishable, inter alia,<\/p>\n<p>under Sec.333 of the IPC and Sec.3 of P.D.P.P. Act.<\/p>\n<p>      2.  Investigation is complete.        Final report has already<\/p>\n<p>been filed.    The case has been committed to the Court of<\/p>\n<p>Session.   The case was registered as S.C.No.1081\/04 before<\/p>\n<p>the learned Additional Assistant Sessions Judge, Kollam.         The<\/p>\n<p>petitioners have not appeared before the learned Sessions<\/p>\n<p>Judge.   Consequently, warrants of arrest have been issued<\/p>\n<p>against the petitioners.     The petitioners find such warrants of<\/p>\n<p>arrest chasing them.\n<\/p>\n<p>      2. According to the learned counsel for the petitioners,<\/p>\n<p><span class=\"hidden_text\">B.A.NO. 5631 OF 2007            -: 2 :-<\/span><\/p>\n<p>the petitioners are absolutely innocent. Their omission\/failure to<\/p>\n<p>appear before the learned Sessions Judge was not wilful or<\/p>\n<p>deliberate; but was due to reasons beyond their control. They<\/p>\n<p>are prepared to surrender before the learned Sessions Judge and<\/p>\n<p>seek regular bail. But they apprehend that their applications for<\/p>\n<p>regular bail may not be considered by the learned Sessions<\/p>\n<p>Judge on merits, in accordance with law and expeditiously.<\/p>\n<p>     3.    I have considered all the relevant inputs.   After the<\/p>\n<p>decision in Bharat Chaudhary and another v. State of Bihar<\/p>\n<p>(AIR 2003 SC 4662),       it is by now trite that powers under<\/p>\n<p>Sec.438 of the Cr.P.C. can be invoked in favour of a person who<\/p>\n<p>apprehends arrest in execution of a non-bailable warrant issued<\/p>\n<p>by a court in a pending proceedings.          But even for that,<\/p>\n<p>sufficient and satisfactory reasons must be shown to exist. I am<\/p>\n<p>not persuaded, in the facts and circumstances of this case, that<\/p>\n<p>any such reasons exist.\n<\/p>\n<p>     4.   It is for the petitioners to appear before the learned<\/p>\n<p>Sessions Judge and explain to the learned Sessions Judge the<\/p>\n<p>circumstances under which they could not earlier appear before<\/p>\n<p>the learned Sessions Judge. I have no reason to assume that the<\/p>\n<p>learned Sessions Judge      would not consider the petitioners&#8217;<\/p>\n<p>applications for regular bail on merits, in accordance with law<\/p>\n<p><span class=\"hidden_text\">B.A.NO. 5631 OF 2007            -: 3 :-<\/span><\/p>\n<p>and expeditiously.      No special or specific directions appear to<\/p>\n<p>be necessary. Every court must do the same. Sufficient general<\/p>\n<p>directions on this aspect have already been issued in the decision<\/p>\n<p>reported in <a href=\"\/doc\/147290035\/\">Alice George v. Deputy Superintendent of Police<\/a><\/p>\n<p>(2003 (1) KLT 339).\n<\/p>\n<p>     5. In the result, this bail application is dismissed; but with<\/p>\n<p>the observation that if the petitioners surrender before the<\/p>\n<p>learned Sessions Judge       and seek bail, after giving sufficient<\/p>\n<p>prior notice to the Prosecutor in charge of the case, the learned<\/p>\n<p>Sessions Judge must proceed to pass appropriate orders on<\/p>\n<p>merits and expeditiously &#8211; on the date of surrender itself.<\/p>\n<p>                                                     Sd\/-\n<\/p>\n<p>                                              (R.
