Urban Buildings (Regulation of Letting, Rent\n     &amp; Eviction)  Rules, 1972,  s.  21(1)  (a)  4th\tProviso\/Rule\n     16(1)(f) - Landlord seeking ejectment of tenant on bona fide\n     need -Landlord\toffering reasonable,  suitable accommodation\n     to tenant-  Landlord's claim  to eviction  to be  considered\n     liberally.\n\nHELD:\n\n     The  Prescribed  Authority,  Varanasi  and\t the  Second\nAdditional District  Judge, in\trevision, after\t considering\nthe comparative\t hardship likely  to be caused to the tenant\nand the landlord, allowed the application of the appellant -\nlandlord under\ts. 21(1)(a)  of\t the  U.P.  Urban  Buildings\n(Regulation of\tLetting, Rent and Eviction) Act, 1972 on the\nground that the need of the appellant-landlord was bona fide\nand he\twas entitled to the release of the demised premises.\nThe Authorities\t also held  that  since\t the  appellant\t was\nliving in  the rented  premises, there\twas no reason why he\nshould be  deprived of\tthe beneficial\tenjoyment of his own\nproperty. However,  in the  appeal, the High Court set aside\nthe orders passed by the aforesaid two Authorities.\n     Allowing the appeal,\n^\n     HELD :  1. There  was no  infirmity in the order of the\nPrescribed Authority  or that  of the  learned II Additional\nDistrict Judge.\t The High  Court was  clearly  in  error  in\ninterfering  with   the\t order\t passed\t by  the  Prescribed\nAuthority, Varanasi  and that  of the II Additional District\nJudge, Varanasi.  The judgment\tand order  of the High Court\nare, therefore,\t set aside.  The  order\t of  the  Prescribed\nAuthority, Varanasi  and that  of the  II Additional  Judge,\nVaranasi directing  the release\t of the\t accommodation under\ns.21 (1)(a) of the Act are restored. [601 D; 601 H]\n599\n     2. One  of the  factors prescribed\t by r.\t16 (1)(f) is\nthat if\t the landlord applies for ejectment of the tenant on\nthe ground  that the  accommodation is bona fide required by\nhim for\t his use  and the  members of  his family and if the\nlandlord offers\t reasonably suitable  accommodation  to\t the\ntenant for the needs of his family, the landlord's claim for\neviction shall be considered liberally. [601 B]\n     In the  instant case, the refusal of the application of\nthe landlord  under s.21 (1)(a) of the Act would undoubtedly\ncause greater  hardship to  him as that would deprive of his\nbeneficial enjoyment of his own property. In such a case, it\ncould not  be said  that the  landlord had not fulfilled the\nrequirement of the 4th proviso to s.21(1)(a) of the Act.[601\nD]\n\n\n\nJUDGMENT:\n<\/pre>\n<p>     CIVIL APPELLATE  JURISDICTION : Civil Appeal No. 959 of<br \/>\n1986.\n<\/p>\n<p>     From the  Judgment and  Order  dated  1.5.1985  of\t the<br \/>\nAllahabad High Court in C.M.W.P. Mehrotra for the Appellant.\n<\/p>\n<p>     Sunil Ambwani and Mukul Mudgal for the Respondent.<br \/>\n     The Judgment of the Court was delivered by<br \/>\n     SEN, J.  After hearing learned counsel for the parties,<br \/>\nwe are\tsatisfied that\tthe High  Court, in  the  facts\t and<br \/>\ncircumstances  of   the\t case,\twas  clearrly  in  error  in<br \/>\ninterfering  with   the\t order\t passed\t by  the  Prescribed<br \/>\nAuthority, Varanasi  and that  of the II Additional District<br \/>\nJudge, Varanasi\t by which  they allowed the application made<br \/>\nby the\tappellant under\t s. 21(1)  (a)\tof  the\t U.P.  Urban<br \/>\nBuildings (Regulation  of Letting,  Rent and  Eviction) Act,<br \/>\n1972. Although\tthe Authorities\t on a  consideration of\t the<br \/>\nevidence came  to  the\tconclusion  that  the  need  of\t the<br \/>\nlandlord was bona fide and he was entitled to the release of<br \/>\nthe  demised  premises\tunder  s.  21(1)  (a)  of  the\tAct.<br \/>\nAdmittedly, the\t appellant and\tthe respondent are displaced<br \/>\npersons and  the authorities  held that\t since the appellant<br \/>\nwas living  in rented  premises there  was no  reason why he<br \/>\nshould be  deprived of\tthe beneficial\tenjoyment of his own<br \/>\nproperty.\n<\/p>\n<p><span class=\"hidden_text\">600<\/span><\/p>\n<p>     <a href=\"\/doc\/1619064\/\">In Bhaichand Ratanshi v. Laxmishanker Tribhovan,<\/a> [1981]<br \/>\n3  S.C.C.   502\t this\tCourt  interpreting   the  analogous<br \/>\nprovisions in  s. 13  (1) (g) of the Bombay Rents, Hotel and<br \/>\nLodging House Rates Control Act, 1947 observed :\n<\/p>\n<blockquote><p>\t  &#8220;The Legislature by enacting Section 13 (2) of the<br \/>\n\t  Act seeks  to strike\ta just\tbalance between\t the<br \/>\n\t  landlord and\tthe tenant  so\tthat  the  order  of<br \/>\n\t  eviction under  Section 13 (1) (g) of the Act does<br \/>\n\t  not  cause   any  hardship  to  either  side.\t The<br \/>\n\t  considerations  that\tweigh  in  striking  a\tjust<br \/>\n\t  balance between  the landlord\t and the tenant were<br \/>\n\t  indicated in a series of decisions of the Court of<br \/>\n\t  Appeal, interpreting an analogous provision of the<br \/>\n\t  Rent\t and\tMortgage    Interest\tRestrictions<br \/>\n\t  (Amendment)  Act,  1933  (c.32),  Section  3\t(1),<br \/>\n\t  Schedule I,  para (h)\t : Sims\t v. Wilson, [1946] 2<br \/>\n\t  All E.R. 261; Fowle v.Bell, [1946] 2 All E.R. 668;<br \/>\n\t  Smith v. Penny, [1946] 2 All E.R. 672; Chandler v.<br \/>\n\t  Strevett, [1947]  1 All  E.R. 164;  and Kelley  v.<br \/>\n\t  Goodwin, [1947]  1 All  E.R.810. One\tof the\tmost<br \/>\n\t  important factors  in considering  the question of<br \/>\n\t  greater  hardship   is  whether  other  reasonable<br \/>\n\t  accommodation is  available to the landlord or the<br \/>\n\t  tenant. The  court would  have to put in the scale<br \/>\n\t  other circumstances  which would  tilt the balance<br \/>\n\t  of hardship  on either  side, including  financial<br \/>\n\t  means available  to them  for securing alternative<br \/>\n\t  accommodation either by purchase or by hiring one,<br \/>\n\t  the nature  and extent  of the  business or  other<br \/>\n\t  requirement of  residential accommodation,  as the<br \/>\n\t  case may  be. It  must, however,  be observed that<br \/>\n\t  the existence of alternative accommodation on both<br \/>\n\t  sides is  an important  but not a decisive factor.<br \/>\n\t  On the  issue\t of  greater  hardship\tthe  English<br \/>\n\t  Courts have uniformly laid down that the burden of<br \/>\n\t  proof is  on the  tenant. We\tare inclined  to the<br \/>\n\t  view that  on the  terms of  Section 13 (2) of the<br \/>\n\t  Act, the  decision cannot  turn on  mere burden of<br \/>\n\t  proof, but  both the\tparties must  lead evidence.<br \/>\n\t  The question whether or not there would be greater<br \/>\n\t  hardship caused  to  the  tenant  by\tpassing\t the<br \/>\n\t  decree  must\t necessarily  depend  on  facts\t and<br \/>\n\t  circumstances of each case.&#8221;<\/p><\/blockquote>\n<p><span class=\"hidden_text\">601<\/span><\/p>\n<p>     A plain  reading of  s. 21\t (1)(a) of the Act read with<br \/>\nthe 4th\t proviso thereto  and r.  16 (1)(f)  shows that\t the<br \/>\nscheme under  the Act  is  the\tsame.  One  of\tthe  factors<br \/>\nprescribed by  r. 16  (1)(f) is that if the landlord applies<br \/>\nfor  ejectment\t of  the  tenant  on  the  ground  that\t the<br \/>\naccommodation is  bona fide  required by him for his use and<br \/>\nthe members  of\t his  family  and  if  the  landlord  offers<br \/>\nreasonably suitable  accommodation to  the  tenant  for\t the<br \/>\nneeds of his family, the landlord&#8217;s claim for eviction shall<br \/>\nbe considered liberally. In the present case, the Prescribed<br \/>\nAuthority and  the II  Additional District Judge both, after<br \/>\nconsidering the\t comparative hardship likely to be caused to<br \/>\nthe tenant  and the landlord, recorded a finding that on the<br \/>\nrefusal of  the application,  the landlord  would be  put to<br \/>\ngreater hardship.\n<\/p>\n<p>     There was\tno infirmity  in the order of the Prescribed<br \/>\nAuthority or  that of  the learned  II\tAdditional  District<br \/>\nJudge. The  refusal of the application of the landlord under<br \/>\ns. 21  (1) (a)\tof the\tAct would  undoubtedly cause greater<br \/>\nhardship to  him as  that would\t deprive of  his  beneficial<br \/>\nenjoyment of  his own property. In such a case, it could not<br \/>\nbe said\t that the landlord had not fulfilled the requirement<br \/>\nof the\t4th proviso  to s.  21(1) (a)  of the  Act. The High<br \/>\nCourt obviously\t committed an  error in interfering with the<br \/>\nfindings of  the Prescribed  Authority and  the\t learned  II<br \/>\nAdditional District  Judge on  the ground  that the landlord<br \/>\nhad failed  to fulfil the requirements of the 4th proviso to<br \/>\ns. 21 (1) (a) of the Act.\n<\/p>\n<p>     We\t wish  to  record  that\t Shri  R.B.Mehrotra  learned<br \/>\ncounsel for  the appellant  made an  offer that\t the  rented<br \/>\npremises in  occupation of the appellant may be given to the<br \/>\nrespondent who is his tenant in exchange. We think that this<br \/>\nwas a  very reasonable\toffer and  should be  accepted. Shri<br \/>\nSunil Ambwani,\tlearned counsel appearing for the respondent<br \/>\nstated\tthat   the  respondent\twas  not  agreeable  to\t his<br \/>\nproposal. We, therefore, heard the parties on merits.\n<\/p>\n<p>     In the  view that\twe take, the appeal must succeed and<br \/>\nis allowed.  We set aside the judgment and order of the High<br \/>\nCourt and restore that of the Prescribed Authority, Varanasi<br \/>\nand that  of the  II  Additional  District  Judge,  Varanasi<br \/>\ndirecting the  release of  the accommodation under s. 21 (1)\n<\/p>\n<p>(a) of\tthe Act.  We direct  that the  Prescribed Authority,<br \/>\nVaranasi shall<br \/>\n<span class=\"hidden_text\">602<\/span><br \/>\non an  application being  made by  the\tparties,  allot\t the<br \/>\nrented premises\t occupied by  the appellant in favour of the<br \/>\nrespondent with\t the consent  of the  landlord. If  no\tsuch<br \/>\nconsent is forthcoming, the Prescribed Authority shall allot<br \/>\na  reasonably  suitable\t alternative  accommodation  to\t the<br \/>\nrespondent for\this occupation\ton such terms as he may deem<br \/>\nfit.\n<\/p>\n<p>     We further\t direct that the order of eviction shall not<br \/>\nbe executed  for six  months in\t the  event  the  respondent<br \/>\nfurnishes usual\t undertaking within  four weeks\t from today.<br \/>\nBoth the  parties  shall,  in  the  meantime,  move  to\t the<br \/>\nPrescribed Authority,  Varanasi, for  permission to exchange<br \/>\ntheir respective premises on the terms set out above.<br \/>\n\t  No costs.\n<\/p>\n<pre>M.L.A.\t\t\t\t\t     Appeal allowed.\n<span class=\"hidden_text\">603<\/span>\n\n\n\n<\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Om Prakash vs Bhagwan Das on 10 March, 1986 Equivalent citations: 1986 AIR 1643, 1986 SCR (1) 598 Author: A Sen Bench: Sen, A.P.
