APP (DB) No.724 of 2011\n                                     Manoj Yadav\n                                        Versus\n                                   The State of Bihar\n                                       -----------\n<\/pre>\n<p>02         29.07.2011              This appeal will be heard.\n<\/p>\n<p>                                   Call for the lower Court records.\n<\/p>\n<p>                                   It is submitted that there being only one eye witness,<\/p>\n<p>                         that is, P.W.10, he has in his cross-examination admitted that he<\/p>\n<p>                         did not see any one firing. He assumed that appellant must have<\/p>\n<p>                         shot because he was pointing the gun towards his father.
