\n ORAL JUDGEMENT<\/p>\n
     1.Shri Parsuram Govind Mule, original petitioner,
\n     filed main writ petition i.e. Special Civil Application
\n     No.1079 of 1987     and prayed that impugned order at
\n     Annexure : F dated 14.7.1986 passed by the respondent
\n     No.2 be quashed and set aside and he may be granted
\n     relief of pension, gratuity and other benefits as per the
\n     Government Resolution at Annexures : G, H & I.\n<\/p>\n
     2.Initially on 8.10.1987 the learned Single Judge
\n     of this Court issued notice making it returnable on
\n     12.11.1987 and on 26.12.1991 another learned Single Judge
\n     of this Court simply admitted the matter by issuing
\n     “Rule”.   In response to the notice issued earlier on the
\n     main petition reply Affidavit      was   filed   by   the
\n     respondents opposing the petition and grant of interim
\n     relief. It is contended in the reply by the respondent
\n     that the petitioner retired on 21.8.1971 as work-charge
\n     employee therefore    he   was   neither   in   temporary
\n     establishment nor permanent establishment. Therefore, he
\n     was not entitled to get pension or gratuity.\n<\/p>\n
     3.During the pendency and final disposal of this
\n     petition the sole petitioner died on 24.7.1993. On this
\n     ground the above Civil Application lNo.12109 of 2001 came
\n     to be filed by the applicant Shri Parshuram Govind Mule,
\n     Sole legal heir of original petitioner Pramod Parshuram
\n     Mule. The said Civil came to be filed in 2001 along with
\n     the application for condonation of delay i.e. Civil
\n     Application No.___ of 2001. Thus, the delay of about 7
\n     years in filing Application for bringing legal heirs on
\n     record was filed and the gross delay of 7 years sought to
\n     be condoned on the ground …”The delay has occasioned
\n     because the original heir had approached the advocate of
\n     the petitioner and an application for bringing heir on
\n     record was also prepared and affidavit has also been
\n     sworn in the same. However, it seems either by oversight
\n     the same was not filed or when it was filed it has been
\n     misplaced in the office of the High Court and as a result
\n     when the applicant contacted his advocate again and again
\n     the papers were searched in the office of the High Court
\n     and were not traceable in the High Court and hence this
\n     application is filed. It is in this set of circumstances
\n     the delay has occasioned in bringing heir on record.”\n<\/p>\n
     4.With the death of sole petitioner Shri Parshuram
\n     Govind Mule in 1993 the petition stood abated and for
\n     setting aside the abatement the legal heirs were required
\n     to be brought on record at the earliest.       The short
\n question involved in this case is as to whether after a
\nperiod of 7 years legal heir of the deceased original
\npetitioner can be allowed to be brought on record by
\ncondoning the delay. Learned Counsel Shri Marshal for
\nthe legal heir of the original petitioner deceased
\nParshuram Mule submitted that though the application for
\nbringing heir on record was prepared and Affidavit was
\nalso sworn, but through oversight the same could not be
\nfiled as it was misplaced in the office of the High
\nCourt. He submitted that the applicant contacted his
\nAdvocate again then the papers were searched in the
\noffice and when it was traceable in the office of the
\nHigh Court therefore the present application came to be
\nfiled in 2001 for bringing legal heir on record.      He,
\ntherefore, submitted that the delay has been sufficiently
\nexplained and therefore the same should be condoned and
\nthe Civil Application for bringing legal heir of deceased
\noriginal petitioner be granted and the main petition be
\nheard on merit and decided.\n<\/p>\n
5.There is no period of limitation for bringing
\nlegal heir on record in writ petition but that does not
\nmean that the party can file petition after long long
\nperiod.   7 years delay is most unreasonable and such a
\ngross delay ordinarily cannot be condoned that too on the
\nground stated in the Application. Except vague averments
\nno details have been given in the Application for
\ncondonation of delay.     It is very easy to say that
\nthrough oversight the application was not filed.     That
\nwas not the only ground on which the delay is sought to
\nbe condoned. As stated above in Para :         1 of the
\napplication for condonation of delay it is stated that
\neither through oversight the application could not be
\nfiled or it was filed then it was misplaced in the office
\nof the High Court. Thus, it is clear that the applicant
\nhimself is not sure as to whether the application was
\nfiled or not and if it was filed then it was misplaced in
\nthe office of the High Court.       When it was misplaced
\nnothing has been stated. This type of lame excuse cannot
\nbe accepted for condoning the delay.      These are the
\ndiscretionary powers and therefore in such type of cases
\nsuch discretionary powers cannot be exercised in favour
\nof those persons who are sleeping over their rights for
\nyears together.\n<\/p>\n
6.In view of above discussion I am not inclined to
\ngrant Civil Application for condonation of delay in
\nfiling Civil Application No.12109 of 2001 for bringing
\nlegal heir of the sole original deceased petitioner on
\nrecord. Accordingly the same is rejected. Once the said
\nCivil Application for condonation of delay is rejected
\n then Civil Application No.12109 of 2001 for bringing
\nlegal heir on record has to be rejected and accordingly
\nit is rejected.\n<\/p>\n
7.When this Court has not granted application for
\nbringing legal heir of deceased petitioner on record then
\nthe main writ petition No.1079 of 1987 has to be
\ndismissed as abated on the death of the sole petitioner.
\nAccordingly all these matters are dismissed with no order
\nas to costs. Rule discharged.\n<\/p>\n
