Justice J.M.JAMES\n\n Dated :06\/02\/2007\n\n O R D E R\n                         J.M.JAMES, J.\n\n                           -------------------\n\n                    W.P.(C). 33534\/2006 (P)\n\n                          --------------------\n\n            Dated this  the 6th day of February, 2007\n\n\n                          JUDGMENT\n<\/pre>\n<p>             The writ petitioner had undergone the selection<\/p>\n<p>process   and     topped   the   select   list,   prepared   and<\/p>\n<p>published by the first respondent, Perumpilly Co-operative<\/p>\n<p>Society,   Njarakkal,   Eranakulam.     Notification   was   issued<\/p>\n<p>on   4.6.2003.     Though   the   rank   list   was   prepared   on<\/p>\n<p>14.11.2003,   the   writ   petitioner   had   not   so   far   been<\/p>\n<p>appointed.  The Joint Registrar (General), Ernakulam,  had<\/p>\n<p>directed the first respondent, Society,   to cancel the rank<\/p>\n<p>list, on   the  ground  of alleged  irregularities  in  conducting<\/p>\n<p>the selection.\n<\/p>\n<\/p>\n<p>      2.     Writ   Petition   No.24821\/2004   was   filed   before<\/p>\n<p>this   Court,   challenging   the   non-appointment   of   the   writ<\/p>\n<p>petitioner.  As an appeal would lie against the  order of the<\/p>\n<p>Joint Registrar,    this Court did not interfere  and directed<\/p>\n<p>the   writ   petitioner   to   approach   the   Government.<\/p>\n<p>Accordingly,     an   appeal   had   been   preferred   and   the<\/p>\n<p>W.P.(C).33534\/2006<\/p>\n<p><span class=\"hidden_text\">                                    2<\/span><\/p>\n<p>Government,     after   hearing   all   concerned,     passed   G.O.<\/p>\n<p>(Rt)No.166\/2006\/Co-op   dated   29.3.2006,   allowed   the<\/p>\n<p>appeal   and   set   aside   the   order   of   the   Joint   Registrar,<\/p>\n<p>cancelling  the  rank  list.    The  resolution,    passed  by   the<\/p>\n<p>first respondent,  cancelling the rank list, consequent on<\/p>\n<p>the order of the Joint Registrar,  was also set aside.   The<\/p>\n<p>first respondent,  Society, was also directed to make the<\/p>\n<p>appointments from the rank list published on 14.11.2003.<\/p>\n<p>Despite such an order,  the appointment of the petitioner<\/p>\n<p>had not been effected.  Hence, this writ petition.<\/p>\n<p>      3.     During   the   hearing,     the   learned   counsel   for<\/p>\n<p>the  first  respondent,   Society,  relying   on    <a href=\"\/doc\/1026092\/\">Chandran     v.<\/p>\n<p>State   of   Kerala<\/a>     (1994     (1)   KLT,     Short   Note.Case<\/p>\n<p>No.26,   Page   27)  submitted   that   &#8220;even   if   the   posts   are<\/p>\n<p>permanent,  it is not obligatory for the board of directors<\/p>\n<p>of a Society to fill up all the posts&#8221;.  The counsel  further<\/p>\n<p>submits that the financial position of the Society is  very<\/p>\n<p>unstable   and,   therefore,   no   further   appointments   are<\/p>\n<p>required   to   be   made.     The   counsel   further   relied   on<\/p>\n<p>Jatinder   Kumar   and   Others     v.     State   of     Punjab<\/p>\n<p>W.P.(C).33534\/2006<\/p>\n<p><span class=\"hidden_text\">                                     3<\/span><\/p>\n<p>(AIR   1984   Supreme Court   1850),   to emphasis the<\/p>\n<p>point that  the  process  of the  selection   and  selection   for<\/p>\n<p>the   purpose   of   recruitment   against   the   anticipated<\/p>\n<p>vacancies does not create a right to be appointed to the<\/p>\n<p>posts, for which the selection was held.<\/p>\n<p>      4.     The   learned   counsel   for   the   writ   petitioner,<\/p>\n<p>on   the   other   hand,     submits   that   the   Government   had<\/p>\n<p>already   ordered   to   appoint   the   petitioner   to   the   post   of<\/p>\n<p>attender and the   order of the Government is still  valid.<\/p>\n<p>The said order  had not so far been  challenged.  The writ<\/p>\n<p>petitioner is a  woman  aged  about  33.    The  stand  of  the<\/p>\n<p>first   respondent,   Society,   that   the   appointment   shall   be<\/p>\n<p>only  after the financial position of the Society increases,<\/p>\n<p>may not be accepted, the counsel submit.<\/p>\n<p>      5.     An   examination   of   the   facts   in  <a href=\"\/doc\/1026092\/\">Chandran   v.<\/p>\n<p>State of Kerala,<\/a> reveal that  the learned single Judge was<\/p>\n<p>dealing   with   the   appointment   of   the   persons   from   the<\/p>\n<p>feeder category to the promotion post.   It was laid down<\/p>\n<p>after   discussing   the   facts   that     &#8220;it   is   an   absolute<\/p>\n<p>prerogative  right of the  board of directors not to fill  up<\/p>\n<p>W.P.(C).33534\/2006<\/p>\n<p><span class=\"hidden_text\">                                    4<\/span><\/p>\n<p>any   particular   post   even   though   the   feeder   category<\/p>\n<p>rules had sanctioned the post of a Secretary and enable<\/p>\n<p>the board of directors to effect appointment to that post.&#8221;<\/p>\n<p>      6.     The facts  available in the case of  <a href=\"\/doc\/1026092\/\">Chandran v.<\/p>\n<p>State   of   Kerala<\/a>  cited   supra,   are   on     different   context.<\/p>\n<p>The  same cannot be  applied   to the  facts of the  case at<\/p>\n<p>hand.     In    Jatinder   Kumar     v.     State   of   Punjab,    cited<\/p>\n<p>supra, on the other hand, the Court observed that  &#8220;if the<\/p>\n<p>vacancy  is  to  be   filled   up,  the   Government  has  to make<\/p>\n<p>appointment   strictly   adhering   to   the   order   of   merit   as<\/p>\n<p>recommended   by   the   Public   Service   Commission.     It<\/p>\n<p>cannot   disturb   the   order   of   merit   according   to   its   own<\/p>\n<p>sweet   will   except   for   other   good   reasons     viz.,   bad<\/p>\n<p>conduct   or   character.     The   Government   also   cannot<\/p>\n<p>appoint a person whose name does not appear in the list.<\/p>\n<p>But   it   is   open   to   the   Government   to   decide   how   many<\/p>\n<p>appointments will  be made.&#8221;   It was in the facts of that<\/p>\n<p>case,     the   apex   Court   observed   that   the   &#8220;process   for<\/p>\n<p>selection   and   selection   for   the   purpose   of   recruitment<\/p>\n<p>against  anticipated vacancies  does not create a right to<\/p>\n<p>W.P.(C).33534\/2006<\/p>\n<p><span class=\"hidden_text\">                                      5<\/span><\/p>\n<p>be appointed to that post&#8221;.  In the present circumstances,<\/p>\n<p>the     facts   available   in   Jatinder   Kumar&#8217;s   case   is   entirely<\/p>\n<p>different.         Therefore,   the   authorities           cited   are<\/p>\n<p>inapplicable to  the facts that are under discussion.<\/p>\n<p>        7.      After   hearing   both   sides   and   considering   the<\/p>\n<p>law and facts that are placed before me,  I direct the first<\/p>\n<p>respondent, Society, to appoint the writ petitioner as   an<\/p>\n<p>attender,   in   the   Society,   in   accordance   with   the   G.O.<\/p>\n<p>dated 29.3.2006, referred above.
