02        28.03.2011             Heard learned counsel for the petitioner as well as<\/p>\n
                       learned Additional Public Prosecutor for the State.<\/p>\n
                                      It appears from perusal of the record that on the basis<\/p>\n
                       of allegation of one Balaknath Sahani, an enquiry was conducted and<\/p>\n
                       after the aforesaid enquiry, a report was submitted. Allegedly, the<\/p>\n
                       petitioner took some amount from beneficiaries of Indira Awas<\/p>\n
                       Scheme and furthermore, he did not distribute the scholarship of S.C.<\/p>\n
                       & S.T. students in the year 2009-2010.\n<\/p>\n
                                      Learned counsel appearing for the petitioner requested<\/p>\n
                       me to go through the enquiry report which is at Page 15 of this<\/p>\n
                       application. It appears from perusal of the aforesaid enquiry report<\/p>\n
                       that some beneficiaries made statements against the petitioner under<\/p>\n
                       the influence of above stated Balaknath Sahani, who is none else but<\/p>\n
                       defeated candidate in the election. Furthermore, I find that the<\/p>\n
                       amount of scholarship of the year 2009-2010 is still deposited in<\/p>\n
                       bank.\n<\/p>\n
                                      Taking into consideration the above stated facts and<\/p>\n
                       circumstances as well as submissions of the parties, let the petitioner<\/p>\n
                       be released on bail on furnishing bail bonds of Rs. 10,000\/- (Ten<\/p>\n
                       Thousand) with two sureties of the like amount each to the<\/p>\n
                       satisfaction   of   Sub   Divisional   Judicial   Magistrate,   (West)<\/p>\n
                       Muzaffarpur in connection with Saraiya P.S. Case No. 17 of 2011.<\/p>\n
