Subsequently, Section 411 of the Indian Penal Code<\/p>\n<p>                  was added.\n<\/p>\n<p>                            Considering that apart from confessional statement<\/p>\n<p>                  of the co-accused there is no material against the petitioner<\/p>\n<p>                  and he does not have any criminal antecedent, let the<\/p>\n<p>                  petitioner above named, be released on bail on furnishing bail<\/p>\n<p>                  bond of Rs. 5,000\/- (Five thousand) with two sureties of the<\/p>\n<p>                  like amount each or any other surety to be fixed by the court<\/p>\n<p>                  concerned to the satisfaction of Sub Divisional Judicial<\/p>\n<p>                  Magistrate, Masaurhi, Distt. Patna, in connection with Punpun<\/p>\n<p>                  P.S. Case No. 39 of 2011, subject to the following conditions:<\/p>\n<p>                  (i) That one of the bailors will be a close relative of the<\/p>\n<p>                  petitioner who will give an affidavit giving genealogy as to how<\/p>\n<p>                  he is related with the petitioner. The bailor will also undertake<\/p>\n<p>                  to inform the Court if there is any change in the address of the<\/p>\n<p>                  petitioner. (ii) That the affidavit shall clearly state that the<\/p>\n<p>                  petitioner is not an accused in any other case and if he is he<\/p>\n<p>                  shall not be released on bail. (iii) That the bailor shall also<\/p>\n<p>                  state on affidavit that he will inform the court concerned if the<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>        petitioner is implicated in any other case of similar nature after<\/p>\n<p>        his release in the present case and thereafter the court below<\/p>\n<p>        will be at liberty to initiate the proceeding for cancellation of<\/p>\n<p>        bail on the ground of misuse. (iv) That the petitioner will give<\/p>\n<p>        an undertaking that he will receive the police papers on the<\/p>\n<p>        given date and be present on date fixed for charge and if he<\/p>\n<p>        fails to do so on two given dates and delays the trial in any<\/p>\n<p>        manner, his bail will be liable to be cancelled for reasons of<\/p>\n<p>        misuse.
