This is a suit filed by the plaintiff<br \/>\nseeking for a decree of permanent injunction<br \/>\nrestraining the defendants, their servants, agents,<br \/>\nstockings and all other persons acting on their<br \/>\nbehalf from using the offending trade mark NATRAJ<br \/>\nand device of NATRAJ, trade mark APSARA BEAUTY of<br \/>\nthe plaintiff or from using any other trade mark,<br \/>\nwhich is deceptively similar to the plaintiff&#8217;s<br \/>\naforesaid registered trade marks and also from<br \/>\nusing the firm name of M\/s. Hindustan Pencil<br \/>\nFactory and Natraj Pencil Industries. The<br \/>\nplaintiff has also sought for a decree of rendition<br \/>\nof accounts.\n<\/p>\n<p>2. Summons were issued to the defendants and<br \/>\nan ad interim injunction was granted in favor of<br \/>\nthe plaintiff and against the defendants<br \/>\nrestraining them, their agents and servants from<br \/>\nselling and marketing their goods under the name of<br \/>\nAPSARA BEAUTY and NATARAJ along with the device of<br \/>\nNATARAJ and cartons like Annexure-Y or any carton<br \/>\nor label which is deceptively similar to the<br \/>\nregistered carton and label of the plaintiff. The<br \/>\ndefendants were also restrained from copying the<br \/>\ntrading style and name of the plaintiff i.e. M\/s.<br \/>\nHindustan Pencil Factory and Nataraj Pencil<br \/>\nIndustries.\n<\/p>\n<p>3. Defendants 1 &amp; 2 entered appearance and<br \/>\nfiled their written statement whereas defendants 3<br \/>\n&amp; 4 entered appearance but did not file any written<br \/>\nstatement. However, subsequently, all the<br \/>\ndefendants defaulted in appearance in the court and<br \/>\naccordingly, vide order dt. 7.12.2000 it was ordered<br \/>\nthat the suit would proceed ex parte as against the<br \/>\ndefendants and the plaintiff was allowed to lead<br \/>\nevidence by filing an affidavit by way of evidence.\n<\/p>\n<p>4. Pursuant to the said order, an affidavit<br \/>\nby way of evidence is filed by Sh. P.N. Thanawala,<br \/>\nthe Constituted Attorney of the plaintiff. It is<br \/>\nstated in the aforesaid affidavit filed by way of<br \/>\nevidence that Sh. Thanawala is the Constituted<br \/>\nAttorney of the plaintiff company and that he is<br \/>\nauthorised to depose on behalf of the plaintiff.<br \/>\nIt is also stated in the said affidavit that the<br \/>\nplaint was signed by Sh. B.J. Sanghvi, Director of<br \/>\nthe plaintiff company, whose signature was<br \/>\nidentified by the deponent. A copy of the power of<br \/>\nattorney executed in favor of the deponent is<br \/>\nplaced on record. In paragraphs 2 &amp; 4 of the said<br \/>\naffidavit the plaintiff has set out the various<br \/>\ntrade marks of the plaintiff, in respect of which<br \/>\nit is a registered proprietor. It is also stated<br \/>\nin the affidavit that the plaintiff&#8217;s sale of<br \/>\npencils and other stationery goods, under the<br \/>\nregistered trade mark NATRAJ with the device of<br \/>\nNATRAJ AND APSARA BEAUTY is substantial and their<br \/>\ngoods are sold in every nook and corner of India.<br \/>\nThe sale figures of the plaintiff in respect of the<br \/>\naforesaid trade mark have been furnished and<br \/>\nexhibited as Annexures C &amp; D to the plaint. It is<br \/>\nalso stated on oath that the plaintiff is spending<br \/>\nlarge amount of money on the sale promotion and<br \/>\nadvertisement through various media of<br \/>\nadvertisement such as television, newspapers,<br \/>\nmagazines etc. and the details of the amounts so<br \/>\nspent are given in Annexure-D filed along with the<br \/>\nplaint. It is stated on evidence that the<br \/>\ndefendants adopted the trading style M\/s. Hindustan<br \/>\nPencil Factory and M\/s. Nataraj Pencils Industries,<br \/>\nwhich are deceptively similar with the name of the<br \/>\nplaintiff company, namely, M\/s. Hindustan Pencils<br \/>\nLimited and the trade mark NATARAJ of the<br \/>\nplaintiff. It is stated that defendants 3 &amp; 4 are<br \/>\nare selling pencils bearing the trade mark NATARAJ<br \/>\nand device of NATARAJ in the same packing material<br \/>\nlike Annexure B and the samples of APSARA BEAUTY<br \/>\npencils packed in polypack packets as well as<br \/>\ncartons used by defendants 3 &amp; 4, which are<br \/>\nexhibited as Annexures X &amp; Y. It is also stated<br \/>\nthat by the aforesaid action, the defendants are<br \/>\nnot only infringing the registered trade mark of<br \/>\nthe plaintiff but are also passing off their goods<br \/>\nas goods of the plaintiff.\n<\/p>\n<p>5. The aforesaid evidence placed on record<br \/>\ngo unrebutted and unchallenged and thus, it is<br \/>\nestablished and proved that the defendants for<br \/>\nulterior motives are using the aforesaid trade mark<br \/>\nNATARAJ and device of NATARAJ as well as are using<br \/>\nthe trade mark APSARA BEAUTY of the plaintiff in<br \/>\nrespect of pencils. On the basis of the evidence<br \/>\nplaced on record, I am satisfied that the plaintiff<br \/>\nhas been able to establish its claim, made in the<br \/>\nplaint. Accordingly, a decree is granted in favor<br \/>\nof the plaintiff and against the defendants<br \/>\nrestraining the defendants, their servants,<br \/>\nagents, stockists and all other persons acting on<br \/>\ntheir behalf from using the offending trade mark<br \/>\nNATARAJ and device of NATARAJ, trade mark APSARA<br \/>\nBEAUTY of the plaintiff or from using any other<br \/>\ntrade mark which is deceptively similar to the<br \/>\nplaintiff&#8217;s aforesaid registered trade mark.<br \/>\nThe defendants, their agents, servants, stockists<br \/>\nand all other persons acting on their behalf are<br \/>\nalso restrained from using the firm name of M\/s.<br \/>\nHindustan Pencil Factory and Nataraj Pencil<br \/>\nIndustries.\n<\/p>\n<p>6. As a decree to the aforesaid extent is<br \/>\ngranted in favor of the plaintiff and against the<br \/>\ndefendants, counsel appearing for the plaintiff has<br \/>\nfairly stated that he is not pressing for the<br \/>\nrelief of rendition of accounts, as claimed in the<br \/>\nplaint. The relief sought for by the plaintiff to<br \/>\nthe aforesaid extent stands rejected. The suit<br \/>\nstands decreed to the aforesaid extent.
