Justice K.T.SANKARAN\n\n Dated :25\/03\/2010\n\n O R D E R\n                          K.T.SANKARAN, J.\n             ------------------------------------------------------\n\n                       B.A. NO. 1145 OF 2010\n\n             ------------------------------------------------------\n\n              Dated this the 25th day of March, 2010\n\n\n                                O R D E R\n<\/pre>\n<p>       This is an application for anticipatory bail under Section 438 of<\/p>\n<p>the Code of Criminal Procedure. The petitioners are accused Nos.3,<\/p>\n<p>1 and 2 in Crime No.67 of 2010 of Koothattukulam Police Station,<\/p>\n<p>Ernakulam District.\n<\/p>\n<\/p>\n<p>       2.  The offences alleged against the petitioners are under<\/p>\n<p>Sections 447, 324 and 308 read with Section 34 of the Indian Penal<\/p>\n<p>Code.\n<\/p>\n<\/p>\n<p>       3. The first petitioner is the father of petitioners 2 and 3. It is<\/p>\n<p>stated that the de facto complainant is the brother of the first<\/p>\n<p>petitioner.\n<\/p>\n<\/p>\n<p>       4.  Heard the learned counsel for the petitioners and the<\/p>\n<p>learned Public Prosecutor.\n<\/p>\n<p>B.A. NO. 1145 OF 2010<\/p>\n<p>                                      :: 2 ::\n<\/p>\n<\/p>\n<p>       5. Taking into account the facts and circumstances of the<\/p>\n<p>case,     the nature and gravity of the offence and the injuries<\/p>\n<p>sustained by the brother of the de facto complainant, I do not think it<\/p>\n<p>is proper to grant anticipatory bail to petitioners 2 and 3. However,<\/p>\n<p>taking into account the age of the first petitioner (75 years), the<\/p>\n<p>relationship    between      the   parties   and    also   the  attendant<\/p>\n<p>circumstances, I am of the view that anticipatory bail can be granted<\/p>\n<p>to the first petitioner.\n<\/p>\n<\/p>\n<p>       6. There will be a direction that in the event of the arrest of the<\/p>\n<p>first petitioner, the officer in charge of the police station shall release<\/p>\n<p>him on bail on his executing bond for Rs.15,000\/- with two solvent<\/p>\n<p>sureties for the like amount to the satisfaction of the officer<\/p>\n<p>concerned, subject to the following conditions:<\/p>\n<blockquote><p>       a)     The first petitioner shall report before the investigating<br \/>\n              officer between 9 A.M.        and 11 A.M. on alternate<br \/>\n              Mondays for a period of two months;\n<\/p><\/blockquote>\n<blockquote><p>       b)     The first petitioner shall appear before the investigating<br \/>\n              officer for interrogation as and when required;\n<\/p><\/blockquote>\n<blockquote><p>       c)     The first petitioner shall not try to influence the<br \/>\n              prosecution witnesses or tamper with the evidence;\n<\/p><\/blockquote>\n<p>B.A. NO. 1145 OF 2010<\/p>\n<p>                                     :: 3 ::\n<\/p>\n<\/p>\n<p>      d)    The first petitioner shall not commit any offence or<br \/>\n            indulge in any prejudicial activity while on bail;<\/p>\n<p>      e)    In case of breach of any of the conditions mentioned<br \/>\n            above, the bail shall be liable to be cancelled.<\/p>\n<p>      The Bail Application is allowed in the manner indicated above<\/p>\n<p>in so far as it relates to the first petitioner (accused No.3) and it is<\/p>\n<p>dismissed in so far as it relates to petitioners 2 and 3 (accused<\/p>\n<p>Nos.1 and 2).\n<\/p>\n<\/p>\n<p>                                                    (K.T.SANKARAN)<br \/>\n                                                          Judge<br \/>\nahz\/<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Thankappan vs State Of Kerala on 25 March, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 1145 of 2010() 1.
