No.31274 of 2010\n                                VIJAY KUMAR MISHRA\n                                      Versus\n                                THE STATE OF BIHAR\n                                      ------\n<\/pre>\n<p>2\/      11.10.2010               Heard learned counsel for the petitioner and learned<\/p>\n<p>                     counsel for the State.\n<\/p>\n<p>                                 Allegation is about non-submission of expenditure of<\/p>\n<p>                     amount of Rs. 12,54,621\/- under N.R.H.M. Scheme. Specifically, it<\/p>\n<p>                     is said that petitioner did not hand over charge. Submission of the<\/p>\n<p>                     learned counsel for the petitioner is that for the same allegation,<\/p>\n<p>                     Rajgir P.S. Case No. 19 of 2008 by the same victim was lodged in<\/p>\n<p>                     which petitioner was taken into custody and after remaining in<\/p>\n<p>                     custody was allowed bail. So, again his arrest cannot be justified.<\/p>\n<p>                                 I agree with the submission of the learned counsel for<\/p>\n<p>                     the petitioner. Accordingly, prayer of the petitioner is allowed.<\/p>\n<p>                                 In the event of arrest or surrender within one month<\/p>\n<p>                     from the date of receipt\/production of a copy of this order in<\/p>\n<p>                     connection with Rajgir P.S. Case No. 190 of 2010 above named<\/p>\n<p>                     petitioner shall be released on bail on furnishing bail bond of Rs.<\/p>\n<p>                     10,000\/- (ten thousand) with two sureties of the like amount each to<\/p>\n<p>                     the satisfaction of C.J.M., Biharsharif subject to the conditions as<\/p>\n<p>                     laid down under Section 438(2) of Cr.
