PUBLIC PROSECUTOR for\nRespondent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE AKIL KURESHI\n\t\t\n\t\n\n \n\nDate\n: 04\/02\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\t\tLearned<br \/>\nCounsel for the petitioner submitted that, except, the present one,<br \/>\nthere is only one case of similar nature, registered against the<br \/>\npetitioner. He is in jail since 21.12.2010. The investigation is<br \/>\nover, however, the charge-sheet is, yet, to be presented.\n<\/p>\n<p>2.\t\tIn<br \/>\naddition to the above, I have also considered the nature of<br \/>\nallegations made in the complaint and the sentence provided under the<br \/>\nlaw, for the alleged offences.<br \/>\nUnder the circumstances, the petitioner is ordered to be released on<br \/>\nbail in connection with C.R.<br \/>\nNO. I-222\/2010,<br \/>\nregistered with BHAKTINAGAR<br \/>\nPOLICE STATION,<br \/>\nRajkot, for the offences punishable under Sections-454, 457, 380 and<br \/>\n114 of the Indian Penal Code, on his furnishing bond of<br \/>\nRs.25,000\/-(Rupees Twenty Five Thousand), with one surety of the like<br \/>\namount to the satisfaction of the lower Court and subject to the<br \/>\nconditions that, he shall:\n<\/p>\n<p>(1).\t\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p>(2).\t\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>(3).\t\tmaintain<br \/>\nlaw and order;\n<\/p>\n<p>(4).\t\tmark<br \/>\nhis presence before the concerned Police Station on every 1st<br \/>\nand 15th day of English Calendar month between 11:00 a.m.<br \/>\nto 2:00 p.m.;\n<\/p>\n<p>(5).\t\tnot<br \/>\nleave the State of Gujarat without prior permission of the Sessions<br \/>\nJudge concerned;\n<\/p>\n<p>(6).\t\tfurnish<br \/>\nthe address of his residence at the time of execution of the bond and<br \/>\nshall not change the residence without prior permission of  this<br \/>\nCourt;\n<\/p>\n<p>(7).\t\tsurrender<br \/>\nhis passport, if any, to the Lower Court immediately.\n<\/p>\n<p>3.\t\tIf<br \/>\nbreach of any of the above conditions is committed,  the Sessions<br \/>\nJudge concerned will be free  to take appropriate action in the<br \/>\nmatter.\n<\/p>\n<p>4.\t\tBail<br \/>\nbefore the Lower Court having jurisdiction to try the case.\n<\/p>\n<p>5.\t\tRule<br \/>\nis made absolute.
