According to the appellants, they are the  the<\/p>\n
land in Sy.No. 181 measuring 3 acres 21 guntas<\/p>\n
guntas of l\ufb01iarab land situated at Kolar Kasaba’ <\/p>\n
2. The main contention of the appellants’ is’to’the_ effect<\/p>\n
that inspite of preliminary notificationlin the yeaarl’  fdgllowed A.<\/p>\n
by the final notification dated  lthely_llposse:ssion of the
\nland in question was  ._to:ztl1e_ beneficiary i.e., the
\nCity Municipality._ Thef\u00a21″Of\u00b0.y   ifljurlicipality has no
\nsubsisting  of an award being
\npassed on:.   the compensation for
\nacquiringlllthe  that the Assistant
\n Officer gave an endorsement<\/p>\n
dated.3.121933VthatA7_th’e’frecords available did not disclose<\/p>\n
 polsse”ss’i’on of Sy.No. 181 by its owner to the<\/p>\n
 _C}v;:V.e1″nn*1eiit  in the absence of any notification published<\/p>\n
 Sectic1n5::16 of the Land Acquisition Act 1984, there is no<\/p>\n
l’,_taking~~ over of possession of the land by the beneficiary and<\/p>\n
“:f:”t:hei5e~fore, utilisation of t:he land for the purpose for which it is<\/p>\n
A acquired is absent. Hence they sought for declaration that the<\/p>\n
land in Sy.l\\lo. 181 did not Vest with the respondents and they<\/p>\n
have no subsisting rights.\n<\/p>\n
3. The facts brought on record before_-the– <\/p>\n

to be  “regular first appeal i.e.,<\/p>\n
R.S.A.l\\l . 3lG87,f;>,QQt\u20acSolVl fi.led..l_’vbefc–1celllthe High Court was also<\/p>\n
dismissed on  the very contention of the<\/p>\n
oWners..being”thai;itl1e  possession of the land in question<\/p>\n
‘ V’ >.;1Cz\u00a7\u00a3itive.d. by. the ti”ial”‘Court, which reached its finality in RSA<\/p>\n
glaijing at the owner, it is not open to the legal<\/p>\n
repijesentatixfesz of the original owner Mr. Rangaiah Sheety to<\/p>\n
V’-.contencl_ that they are in lawful possession of the property as<\/p>\n

4. Yet another lacuna against the appellants is that<\/p>\n
though the appeal came to be dismissed in the year.pl2;Q:O~5, at<\/p>\n
this stage it is not open to them to come up withljal’C:ont_en1i,i__on<\/p>\n
that no subsisting rights are available to tI:1e”i3enjefic*itary, _:Cl)I”}~ y <\/p>\n
the other hand, it is seen that the :ignci-..x,g;~I;s4ltal{eln’-oV’ei=__l)y:the<\/p>\n
Municipality and the records -demonisptrate the ;’S\u00a71′.II1e.:\u00a7 <\/p>\n
records of the Municipality i.e.,   indicates they
\nvacated in the year  dernarcating the land
\nacquired and possession’ Abf:i:1r_1g   Chief Officer of
\nthe City     records. So far as
\nthe revenue   pertaining to this survey
\nnurribearvll   Commissioner has
\nacquirertthe lat1d_.l’.andb”th_e”‘:p’ossession is handed over to the<\/p>\n
Muniyoipalityl”  these records make it clear that neither the<\/p>\n
“appellants rior theirlpredecessor were in possession of the land<\/p>\n
 xix\u00bb <\/p>\n
 i__in:c1o.ntended by them. On the other hand, it was<\/p>\n
the.__City Vfl\ufb02lunicipality, which has exercised its right and interest<\/p>\n
“-,over the land in question.\n<\/p>\n<\/p>\n
5. In View of the above discussion and the reasoning
\ngiven by the learned Single Judge, we are of the opinjan no<\/p>\n
grounds are made out to entertain the appeals.<\/p>\n
