Justice ANTONY DOMINIC\n\n Dated :24\/05\/2010\n\n O R D E R\n                         ANTONY DOMINIC, J\n                       -------------------\n                         W.P.(C).11976\/2010\n                      --------------------\n              Dated this the 24th day of May, 2010\n\n                             JUDGMENT\n<\/pre>\n<p>      By Ext.P1 proceedings issued by the 3rd respondent<\/p>\n<p>petitioner was     appointed as an Ophthalmic Assistant on a<\/p>\n<p>provisional basis under Rule 9(a)(1) of KS &amp; SSR. The period<\/p>\n<p>specified is one year and that the period has expired.<\/p>\n<p>2.    In this writ petition, petitioner seeks continuance in service<\/p>\n<p>relying on the sentence in Ext.P1 to the effect that the petitioner<\/p>\n<p>is liable to be ousted from service as and when PSC hands join<\/p>\n<p>duty or at any time, if found unsuitable. Learned counsel for th<\/p>\n<p>petitioner submits that      no PSC hands have joined duty and<\/p>\n<p>therefore, the petitioner should be retained in service. On a<\/p>\n<p>reading of Ext.P1, I am inclined to take the view that the clause<\/p>\n<p>providing ouster when PSC hands join duty, is meant to operate,<\/p>\n<p>if a PSC hand join duty within the period of one year specified.<\/p>\n<p>This clause is not intended to extend the period of appointment<\/p>\n<p>beyond one year. Admittedly, the one year period specified has<\/p>\n<p>W.P.(C).11976\/10<br \/>\n<span class=\"hidden_text\">                                2<\/span><\/p>\n<p>expired and appointment being under Rule 9(a)(1), petitioner has<\/p>\n<p>no right to continue in service.\n<\/p>\n<\/p>\n<p>     Writ petition is dismissed accordingly.<\/p>\n<p>                                  ANTONY DOMINIC,<br \/>\n                                       Judge<\/p>\n<p>mrcs<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Shilna T.S.
