NO. 8539 OF 2009 J\n                --------------------------------------\n               Dated this the 30th March, 2009\n\n                          JUDGMENT\n<\/pre>\n<p>     Petitioner has been assessed under the Building Tax Act.<\/p>\n<p>He carried the matter in Appeal. It was rejected citing delay. He<\/p>\n<p>took up the matter further before the District Collector in<\/p>\n<p>Revision. It is stated that it is not possible to consider the<\/p>\n<p>Revision Petition, in view of non-payment of fifty per cent.<\/p>\n<p>     2. I heard the learned counsel for the petitioner and the<\/p>\n<p>learned Government Pleader. Learned counsel for the petitioner<\/p>\n<p>would submit that the petitioner is prepared to pay fifty per cent<\/p>\n<p>as demanded and the Revision Petition may be ordered to be<\/p>\n<p>considered.   The Writ Petition is disposed of directing the<\/p>\n<p>second respondent to consider and take a decision on Ext.P4<\/p>\n<p>Revision Petition in accordance with law, upon the petitioner<\/p>\n<p>remitting the amount required in law and on condition that the<\/p>\n<p>Revision Petition has been preferred in time. A decision will be<\/p>\n<p>taken within two months from the date of receipt of a copy of<\/p>\n<p><span class=\"hidden_text\">WPC.8539\/09 J                   2<\/span><\/p>\n<p>this Judgment.
