JUSTICE R.M.DOSHIT)<\/p>\n<p>\tFeeling<br \/>\naggrieved by the order dated 11th April 2008 made by the<br \/>\nlearned Single Judge in above Civil Application No.11502 of 2007, the<br \/>\napplicant delinquent servant has preferred this Appeal under Clause<br \/>\n15 of the Letters Patent.\n<\/p>\n<p>\tThe<br \/>\nappellant, a Deputy Chitnis in the office of the District Development<br \/>\nOfficer, Junagadh was removed from service on 31st<br \/>\nDecember 1999 on disciplinary grounds. The challenge to the said<br \/>\norder has been upheld by the Gujarat State Civil Service Tribunal.\n<\/p>\n<p>\tFeeling<br \/>\naggrieved, the District Development Officer, Junagadh has filed the<br \/>\nabove Special Civil Application No.23107 of 2006 before this Court.<br \/>\nPending the said petition, the learned Single Judge by his order<br \/>\ndated 9th July 2007 stayed the operation of the order of<br \/>\nthe Service Tribunal on condition that the District Development<br \/>\nOfficer paid the legal dues of the appellant consequent to his<br \/>\nremoval from service on 31st December 1999. According to<br \/>\nthe appellant, the District Development Officer has committed breach<br \/>\nof the conditions imposed by the learned Single Judge by not paying<br \/>\nthe amount of difference in salary, commuted value of pension,<br \/>\npension, gratuity, leave salary, etc. The Court should, therefore,<br \/>\nvacate the interim stay for breach of conditions.\n<\/p>\n<p>\tIn<br \/>\nanswer, the District Development Officer contested the Application.<br \/>\nAccording to the District Development Officer, the appellant was paid<br \/>\nthe legal dues namely, Provident Fund amount and Group Insurance<br \/>\namount. The learned Single Judge has disposed of the Civil<br \/>\nApplication. Therefore, the present Appeal.\n<\/p>\n<p>\tAs<br \/>\nrecorded hereinabove, the appellant has been removed from service.<br \/>\nThe removal from service will have legal consequences of forfeiture<br \/>\nof salary, allowances, pension, leave encashment, etc. Since the date<br \/>\nof his removal, none of the aforesaid amounts is payable to the<br \/>\nappellant. The learned Single Judge has rightly rejected the Civil<br \/>\nApplication.\n<\/p>\n<p>\tThe<br \/>\nAppeal is dismissed in limine.
